Continuation Part 20: Amanda Knox/Raffaele Sollecito

If Rudi made a date, who would you expect to confirm it? Meredith was very circumspect and I can easily believe she wouldn't have shared the information. The only evidence there wasn't a date comes from the birds and I don't trust them. Also, they were most likely drunk as skunks.

The "evidence" in the CT relating to Rudi is CT saying months after the event that the pictures of Rudi looked like the guy he "saw" in his place in the dark in the middle of the night. He wasn't even sure and his girlfriend didn't see anything.

The cops early on believed Meredith had made a date and the sex was consensual. The initial read was consensual sex and murder with a pen knife. All PIP accept the pen knife.

Do you really believe CT saw Rudi the next night in a club and only had him 86ed? Obviously he couldn't ID the guy the next night. Btw, Rudi was able to go to those clubs before leaving for Germany. I think it was Domus where CT spotted him and where he went after the murder. You think he'd go to Domus after being thrown out?

I believe CT 10 times more than Rudy having a date with Meredith. I get the Keystone cops believed at first that it might have been a date rape scenario but only because, it was a college student that was killed in her own room and she was sexually assaulted.

1. There is no reason for Meredith not to mention she had a date that evening to someone....anyone. My experience is women talk.
2. No one saw Rudy with Meredith at the Halloween party.
3. People don't show up for their first date an hour early.
4. No calls, texts etc between the parties.
5. No one falls asleep on the toilet on their first date especially within 30 minutes of arriving.

I'm not buying.

This is full rationalization-mode LJ's style. <rest of rant snipped for brevity>

Hahahahahaha! Oh dear! Really, you need to face up to the fact that the Italian criminal justice system is not fit for purpose. It's broken. Corrupt. Patrician. Mendacious. Quasi-Fascist. Incompetent. Self-serving. Unaccountable. And each and every one of these enormous structural failings manifested itself spectacularly in the Knox/Sollecito trial process.

You can pretend as hard as you like that this isn't so, but that won't change a thing. That you refuse to see it is highly instructive in itself of course. Carry on :D

All of the above, plus:

6. Kercher believed there was college the following day (Friday)* and knew that she had work to do in advance of the next college lectures. It's therefore rather unlikely that she would have arranged for a man to come round for a romantic encounter that evening.
7. There's no other indication that Kercher was into parallel romantic liaisons. She was in a sexual relationship with Silenzi (from the downstairs apartment) and it would appear to have been out of character for her to have agreed to a meeting and a sexual element with Guede.
8. As a modification of (5) really: Guede didn't claim to have fallen asleep on the toilet. But he did claim to have sat on the toilet for at least 10 minutes listening to loud music on earphones. And that certainly is not usual behaviour for someone who is in the middle of a romantic encounter.

In short, I think that there's sufficient reason to come to a working conclusion that Guede's story of an agreed date with Kercher that night, and of consensual sexual activity, is self-serving and false. There's a lot of reason to believe that Guede invented this scenario as an attempted defence and as an attempt to account for some of the physical evidence.

Tesla you have demonstrated a lack of experience. Men talk women not so much. Meredith was critical of Amanda having more than one interest at a time, remember? She wasn't about to announce that while Giacomo was out of town she was going to fool around. The only people that might have paid attention were the birds and they were most likely smashed. Do you ever get tired of the text, email phone meme? He didn't have a phone at the time, remember? He didn't fall asleep. What are you smoking?

His testimony was as follows for the time:

We were to see each other in the evening around eight thirty more
or less… after that I went off, I didn’t hang around there with her and
I wandered around the place to look for other people in fact I met
people that I knew that evening one being Vicky this Ukrainian guy in
Domus, with another Albanian guy whose name I can’t remember
however I know him

Oh look he went to the club CT spotted him and had him ejected.

The police didn't think she was sexually assaulted. They thought it was consensual sex, read up. That's why they thought it was with a date from the night before. And it wasn't a date rape - just a date.

Wow!!! I guess our experiences with women are dramatically different. Meredith talked about ending the relationship with Amanda. Girls talk and in detail.

They didn't think she was sexually assaulted with her pants pulled down and her throat cut? You can't be serious.

Hahahahahaha - no sex on school nights - right

There is no indication, would expect a Myspace post? Giacomo said their affair was casual and it was the first time he had left town -

8. As a modification of (5) really: Guede didn't claim to have fallen asleep on the toilet. But he did claim to have sat on the toilet for at least 10 minutes listening to loud music on earphones. And that certainly is not usual behaviour for someone who is in the middle of a romantic encounter.

Okay, bad kebabs are not usual.

But Tesla says a 5 year-old could do better. Apparently Tesla doesn't understand the expression as a six year should be able to do even better. Why didn't he name A&R during the Skype? He had almost two weeks and risking they would come up with an alibi shouldn't have deterred his working them into the story. Why was he so adamant it wasn't his sperm?

A British student murdered in Italy may have invited the killer into her home, police investigating her death now believe.
Officers think Meredith Kercher, 21, left three flatmates to go home alone after watching a film on the night she was murdered because she had arranged to see a man she had met the previous night at a Hallowe'en party.

And why did they think that? Or were they just spitballing? I bet they floated a lot of ideas at first. This doesn't mean any of it happened.

I don't think it was his sperm. But the stain should have been tested. I believe Rudy about that for the very reason you mention. They found his DNA on her vagina not semen.

Michele report (Guede's trial).

The roles are defined in the rubric by the PM. This was not a trial where Knox and Sollecito had full participation.

No, in the Italian system, the judge is not bound to the rubric the way you imagine. And anyway, Knox and Sollecito had full participation in the Micheli trial.
The paragraph you quote, by the way, even points out how judge Micheli claims independency from the Public Prosecution arguments ("ed era comunque già evidente in base alle risultanze processuali"): he says he didn't need the prosecturor's points to come that conclusion.

But the fact that Guede did not hold the murder weapon was also established by the Borsini-Belardi appeals' court, where the prosecution was made of different people, and anyway the lack of reprsentation would be a moot point: the fact that Knox and Sollecito are not parties represented in a trial doesn't make a finding become illegitimate or invalid. That Guede was not holding the murder weapon is a definitive finding universally valid.

It is a matter of fact that the courts established that Guede was not holding the murder weapon, and this is just judicial truth. It is apparent that you don't like this. I think such dislike is biased, anyway it doesn't make the finding become less credible, less true or less valid.
The fact that there are multiple perpetrator is a finding agreed by even more judges, this time also shared by Bruno/Marasca and. It is obvious in fact, from the reading of Bruno/Marasca, that they too hold as incontrovertible the fact that Guede did not kill Meredith alone. They point out multiple argumentations in support of that, so there can't be any doubt that B/M verdict emphasizes again the truthfulness and necessity of the multiple perpetrators scenario in their own assessment.

These are facts that I refer, not my opinions. I'm not bending things in a way or another.

Your opinion on these facts it's another matter. Just let's keep our opinions separate from something that can be referred to objectively.

This was actually just a non-sequitur.

It is quite obvious that your denigration/rant about the Italian justice system as a whole has the function of diminishing importance of the things courts said that you don't like, sweep them away as irrelevant. It's overt rhetoric.

Talking about the US justice would be like shooting on the Red Cross. One uninvolved observer that would like to make some dispassionate judgement on systems "as a whole", let's say on the UK justice system, might note that the UK system keeps an Australian citizen, Julian Assange, as a captive deprived of freedom of movement on an order of arrest on a charge that carries a 600 euros fine as maximum penalty based on Swedish penal code. I feel confident something like that would be legally impossible in Italy.

The lables & names ...mendacious, patrician, quasi-fascist etc..., are cheap, they're blah blah. Is the UK justice system "fit"? "Truthful"? Not "fascist"? Is it normal to arrest people on suspicion of 600€ fines? No political conspiracy?

When you climb down your cloud and talk about facts, well, facts are facts.

I note you skipped the fact that the ECHR quoted praises to the Italian Judiciary (among them prosecutor Armando Spataro), and slammed the Italian and American government.
They didn't say the judiciary is unfit to the purpose. They rather said the contrary, the government are not fit to the purpose, and the judiciaries who opposed them were right.

Other point you might deal with one day, that your reading of the Italian text of B/M was wrong (you failed to understand the meaning of "alla stregua di") and your theory that B/M is "protecting the judiciary" flies a bit in the face of the fact that the verdict opposes law points of the 1st Section of Supreme Court, and seems designed to shoot the jurisprudence in its foot.

You can't be serious. You believe Italian judges can be bought by the Masons. You even know the amount of money it took for Hellmann to get that car!!

This entire effusion is an exceedingly fine example of "black-white", a subset of "doublethink" from Orwell's Newspeak. In other words, "the ability to believe that black is white, and more, to know that black is white, and to forget that one has ever believed the contrary".

Almost magical! :)

Remember AC, your reference to the final acquittal is an appeal to authority. Mach goes on and on about what the court found or didn't find and never puts together the coherent theory of the crime he alleges Raffaele and Amanda have committed. And yet it is you that appeals to authority. He is in a frenzy to relate the words of the various MRs in support of his conclusions. Oops, not his conclusions but facts. Yes facts! Facts determined by the courts. And words in text. Black and white text. Those are the *real* things that he can discuss! And the court and its various players are corrupt when against his dreams, and he hangs on every word when it helps convict in his mind AK and RS. EVEN though the final decision was acquittal. Then he will return to mLogic and make his "sense" out of the jumble of wordy words.

Magical. Yes magical.

His words are working hard for him. :)

The problem is we are at the limit of your knowledge of the Italian legal system.

Guede opts for a fast track trial giving up the right to challenge prosecution evidence. He pleads not guilty. The prosecution presents a case where he is one of three participants, and did not weird a knife himself. Guede has no interest in challenging these assumptions. It is easier for him to accept the murder was done by more than one person and just argue he was not one of those persons. He is certainly not going to argue that he did wield the knife. Being a fast track trial process the evidence cannot be challenged.

So the case for one vs more than one was never tested. The case for Guede wielding the knife was never tested.

You have previously said that these facts were decided BARD. I doubt this is true, there is a default position in convicting a person, the presumption of innocence and guilt needs to be BARD. There is no default for one vs more than one (even assuming this is a dichotomous choice), for Guede wielding the knife one might argue the presumption is Guede didd not wield the knife, therefore it would be necessary to prove he wielded BARD. In the latter case it means that the more probable case might be that Guede wielded the knife but it was not proven BARD.

So these issues become legal certainties despite the fact that they were never tested in court. We do not know what degree of certainty a court needs to decide these facts, on the balance of probability, or BARD. If the latter what is the default position. Are judges required to rule on all facts? In England a court could just say that who wielded the fatal blow is unknown, can Italian judges say some facts are unknown? Or are the forced into a decision despite uncertainty?

We here are not bound to the absolute certainty of facts ruled by an Italian court. We can say there is uncertainty.

What is concerning is that such facts that were never subject to testing in court can be imported as judicial facts. That they are imported as absolute certainty whilst the reality is they are probabilities. What may have been a 51% probability is converted by court into a 100% certainty.

There is no uncertainty the burglary was staged.

Quote from Massei: But the fact that all this was in fact just a simulation, a staging, can be deduced from
further circumstances. From the photos taken by the personnel of the Questura
(photos 47 to 54 and 65 to 66) one can perceive an activity which appears to have
been performed with the goal of creating a situation of obvious disorder in
Romanelli's room, but does not appear to be the result of actual ransacking, true
searching for the kind of valuable objects that might tempt a burglar. The drawers of
the little dresser next to the bed were not even opened (photo 51
, for example.

Given this key fact, the question has to be asked, "Cui bono?" from such a staged ransack. OK, so the PIP will dream up an "explanation": "Rudy was interrupted" (note, it has to be Rudy and nobody else to fit their shoe-horned theory).

Be that as it may, Massei further comments: The objects on the shelves in photo 52 appear
not to have been touched at all; piles of clothes seem to have been thrown down
from the closet (photo 54) but it does not seem that there was any serious search in
the closet, in which some clothes and some boxes remained in place without
showing any signs of an actual search for valuable items that might have been there
(photo 54). It does not appear that the boxes on the table were opened (photo 65) in a
search for valuable items. And indeed, no valuable item (cf. declarations of
Romanelli) was taken, or even set aside to be taken, by the - at this point we can say
phantom - burglar. One last aspect which bears repeating is the presence, noted and
checked by several witnesses, of pieces of glass on top of the objects and clothing in
Romanelli's room. This circumstance, which also reveals an activity of simulation,
...there are no two ways about it, the "burglary" was a sham, to conceal the true identity of the perpetrator/s of Mez' murder. The only person having such a motive would be someone who lives there, with direct access to the victim. Amanda herself boasted that she had faked a "prank" burglary on a student colleague once and had been forced to apologise. What type of person could fail to realise the effect of such a "prank"?

Further, Massei ruled: [49] Against any such need to dissimulate, which Amanda would have had, it has
been argued that the aim of sexual violence which the crime appeared to display (the
victim was a young girl and her body was almost completely naked and was in her
own bedroom) should have removed all suspicion from Amanda.

Despite Papa Raff testifying his offspring claimed he had just washed dishes after dinner and had had a mishap with the pipes under the sink when he last spoke at 20:42 of the murder night, Massei comments, "the statements by Amanda Knox in which the hour of dinner is
postponed until 10 pm or even 11 pm constitute an attempt to reduce insofar as
possible the length of time devoid of activity that could be documented in some
way, during the final hours of November 1, 2007, thus creating an alibi that could
put her and Raffaele away from the Via della Pergola house where, precisely during
that time, the murder of Meredith Kercher was being perpetrated.
"

As we know, a great flurry of activity occurred at the cottage between Mez' last phone signals circa 22:13 and 23:00, with four or five independent witnesses reporting various commotions of some sort. Therefore the PIP expend a great deal of energy trying to contrive a scenario wheein "Rudy killed her straightaway", asserting not only was he there from circa 20:45, but that he hung around until after 22:13, a whole hour and a half or more, and only bothering to steal Mez' two phones, one credit card and €300 in cash, completely ignoring all other valuables in the property, disregarding Filomena's gold jewellery and Amanda's €300 rent, he could easily have stuffed into his pockets, whilst he was busy at his PIP alleged profession of, hello? burglar.

Mez' meal with the "British birds" was any time between 18:30 and 20:30 "Dr. Lalli, knowing that the duodenum was
still empty "because the stomach had not even begun to empty itself" (page 19 of the
transcripts), the time of death must lie between 21:30 pm (three hours after 18:30)
and 22:30 pm (four hours after 18:30), and that this timing agreed with the less rigid
133
data provided by the analysis of the hypostasis, of the rigor mortis and of the body
temperature, considering the uncertainty of the body weight which was guessed
without weighing the body.
" Therefore, Rudy by the PIP imaginary timeline must have hung around the cottage at least three-quarters of an hour, if we accept their proposed early time of 21:30 (some half an hour after Mez supposedly "interrupted Rudy the burglar").

As for the strong DNA of Raff found on the bra clasp which was underneath the body and sheet, contamination from other objects was ruled out. None of the hooks were deformed and ruled out having been stepped on. Tertiary transfer would have rendered a negligible amount of DNA, and the defence at no point provided a credible scenario of how that would have happened, anyway, Massei states: For the elements and the considerations indicated above, it is ruled out that the
hooks could contain DNA transferred by contact with other objects.
... It can thus be asserted that no contamination occurred on the hooks on the piece of
bra seen on November 3rd and collected on December 18th. These conclusions are
based on the arguments given above and are consonant with the manner of finding
of the hooks: they form a tiny surface which would be difficult to contaminate; the
piece of bra shows, from the attachment of some threads from the strap of the bra
and by the partial deformation of one of the hooks, that a rather firm and violent
pressure was applied to that piece and in particular to the hooks, a pressure which
adequately and convincingly explains the presence of DNA of the person exerting
this firm and violent pressure.

We know the phone which received a signal at 22:13 was at the cottage at 22:13:19, the phone connected to the 30064 Strada Vicinale Ponte Rio Monte La
Guardia cell, the base radio station which Chief Inspector Latella referred to as the
same one that was detected by their measurements near Meredith’s bedroom (in
addition to having reception in the courtyard of the cottage).
The immediate deduction which the Polizia Giudiziaria arrived at is therefore that
Meredith’s English phone was at Via della Pergola 7 on the date 1 November 2007,
in the time period from 14:31:43 to 15:55:57, and lastly at 22:13:19, when the phone
made a GPRS connection (to which we will return) rather than a voice connection.

Without even mentioning the luminol, footprint and shoeprint evidence and evidence of computer activity which proves Raff was lying when he said he was surfing the net all evening until 03:00, These facts also provide proof of the presence of Amanda Knox and of Raffaele
Sollecito in the house on Via della Pergola when Meredith was killed and clarify the
role that they played, outlining a framework of evidence that leads to a declaratory
judgement of guilt with regard to the crimes imputed to them.

The fact-finding court determined that Amanda wielded the knife which inflicted the fatal wound dynamic requires the presence of a second attacker, of a second knife. This
Court holds that the second attacker is Amanda Knox and the second knife is Exhibit
36.
This is not hypothetical or open to argument, it is factual, and in circumstances of This eventuality of death, highly probable, came to be accepted [by the attackers]
and the harmful actions [were] carried out and followed through both by Amanda
and by Raffaele, who acted pursuing the same objective that made them similar to
Rudy: there is therefore the awareness and the will to cause death in the context of
sexual assault.

The pair were acquitted by Bruno-Marasca on the grounds of "insufficient evidence" based on "investigative flaws" and "media attention pressures". They affirmed the facts found by the merits courts stood, save for the fact that although Amanda definitely, and Raff probably, were there at the cottage during the murder, with Amanda washing off Mez' blood from her person (blood dries within half an hour, so she came into contact within that time range) and Amanda covering up for Rudy as the grounds for her criminal calunnia, they couldn't know for sure they had done it.
