Continuation Part 20: Amanda Knox/Raffaele Sollecito

Not open for further replies.
Now you're fibbing. You have talked TODAY and AT LENGTH about what other people talk about. Hoots!

I talk directly about an object of discussion. It means I talk about facts.

B/M written statements are certainly facts. A text is an object, is reality. Something that can be checked directly.

Mach I appreciate my comment may not have been clear.

When ruling on a fact such as one vs. more than one how do the courts rule this BARD. Surely the ruling just has to be on the balance of probability. Unlike innocence vs guilty there is not a clear default state for these facts. So the courts will merely decide which is more likely i.e. they rule the odds for one murderer are less than for more than one, but this might be only 49 vs 51% odds. I f ruling e.g. 1 vs 2 vs 3 vs more than 3 the odds might only be e.g. 25%, 24%, 26%, 25%. The courts do not rule this is an exclusive certainty only that they think this is the most likely of all alternate explanations.

Sorry, but this seems to me a bit of a climbing on glass. In a way or another it seems you are seeking to explore alternative interpretations for the B/M ruling that could be framed in some way less unfavourable to the accused.
The facts are that B/M state that there were multiple perpetrators and present such finding as certain. Whether they come to such a conclusion through a BARD standard or balance of probabilities, this is something they don't tell, and would be quite sterile to make speculations about it. The fact is that they wrote this, which is now a judicial finding. About why they came to believe so or why they wrote so, we could have any kind of speculation. Actually, there is much more than that to be speculated about the B/M verdict.

I'm still stunned you regard what I say or don't say as important enough to accuse me of ANYTHING. You've kind of made my day!

I have dealt with it. I have said that I can see your point of view, while still disagreeing with it. I have written at length why. Right now as months are turning into years since the definitive acquittal with no one other than (apparently) you (and Rudy Guede) pushing this particular point, I am getting bored with engaging you about this and perhaps just about anything else.

But man O man you can type at length at me - and it serves not to advance your own point of view one iota. Have at it dude!

In fact, you refuse to acknowledge facts. You keep on calling it "my point of view", which means you refuse to acknowledge it is a fact, and not my point of view.

Mach I don't really care what M&B ruled. If I got upset every time an Italian motivation report said something stupid I'd already be in the loony bin. I'm more interested in seeing a PGP theory that makes sense.

Since there is no longer a concern about official court evidence why don't you stop worrying about the following bs:

- Curatolo
- Quintavalle
- 112 call timing
- The kitchen knife
- Nara
- The coerced statement
- Raffs bathmat print

And try to put together a theory that at least is coherent. I previously brought up the possibility that Amanda made the bloody bathmat print and all the luminol stains. Do you think such a thing is possible? If not, why not?

You are entitled to have your view. I can only repeat, the real way to determine who is right would be to reengage an Italian court over this.

One can only conclude that yours (and Rudy Guede's) point of view in this regard is not catching traction, because no one in Italy sees it as important enough to move into a courtroom. From this vantage point, if M/B is either unclear or vague or contradictory, and this is a view (as you might claim) well recognized in Italy, why are we only hearing about it from you and Rudy Guede?

From what we here heard, Rudy's claims about M/B got a good airing and then basically disappeared. Sollecito said he would not stand by and be defamed.

There it sits.

The fact is, truth won out over fiction, evidence triumphed over innuendo and good triumphed over evil. The victory is ours. And losers only whine. Nothing will change the fact that Amanda and Raffaele were exonerated. They are free and the guilty killer is in prison although sadly not long enough.

There is a lesson there for Italian jurisprudence but I suspect they won't learn it. What was it? About a 170 people were exonerated in the US this last year alone. No system is perfect but putting one's head in the sand or up your backside is not an answer.

Question, why does Machiavelli argue a case where the highest court in his/her nation declared them not guilty. Even if the state tried to do an "Oops, we changed our mind" response, the rest of the developed world would just laugh at them. I am curious why Machiavelli suddenly appears now?

The same can be argued why you are bothering to argue with him/her as well?

This is said far better than I've managed. And on the last point - guilty as charged.

I haven't never mentioned Heavey, Hampikian, Gill, Hendry or Douglas. I really have no opinion on their work since I have never read any of it.

My only point is that your contributions to debate mostly revolve around
1. Obsessively posting about Knox's sex life in college
2. A claim that your "expertise" proves that Kercher's phones could not have been in Lana's garden at 22:13. An "expertise" which is contradicted by the Sollecito's defence consultant.

Since Vixen has left no one is attacking Knox and even if they were, I very much doubt she would want you to "defend" her. What you are doing is following a personal interest. A personal interest that mostly concerns Knox's private life in 2007, which you are free and entitled to do. But don't expect that Knox should feel in any way gratified by your somewhat prurient interest.

...Hullo...hullo...

B/M written statements are certainly facts. A text is an object, is reality. Something that can be checked directly.

No, they are words and beyond the acquittal they have zero effect. The point was made with the statement "Not Guilty" That is really the only fact. The rest is legal babble.

You can spend your life parsing the motivation, it still will be in the context of Not Guilty.

That the courts might of said there were multiple attackers does not make it so.

Frankly, I find the 6 out of 7 experts who said the murder could have or was the actions of a single assailant far more persuasive than a fat ass in a robe. There is much more reason to believe Detective John Douglass than Nencini or Massei.

Repeat after me Machiavelli, "Not Guilty".

Now, go write it on the blackboard a thousand times. Maybe you'll learn the lesson.

Query Grinder's Theories

QG has introduced a theory, not dissimilar to the Real Grinder's, that, rather than the kids being participants in the murder the 'missing partygoers' werre Daniele de Luna, a Rome resident, brother of Gennarro, who owned 'Domus' nightclub, and Hicham Khiri, a Morrocan who had worked in Perugia for over twelve years, and possibly, Giacomo Silenzi, himself, one of the boys downstairs. Daniele's other dubious claim to fame was nipping upstairs one night and laying Amanda.

More recently, newspaper reports allege that two men with drug dealing connections have been charged with breaking and entrying the cottage during the 2009 trial leaving wax and knives, and stealing the mattress from Mez' room. QC states, hopefully, these will be Hicham Khiri and chum.

I was quite sceptical, but looked up Khiri's testimony and it is quite creepy. He was in the vicinity of the cottage on the murder night, just after midnight, claiming he had his car parked at the Sant 'Antonio car park in via della Pergola 7. Police interrogated him the 3rd and 4th November, before even Amanda and Raff, and also took out a warrant to wire tap (phone intercept) Khiri and his girlfriend Sophie Purton.

Of course, he claimed he saw and heard nothing, saying he didn't even know Amanda and Meredith lived there.

Police eliminated him from enquiries so he obviously had a sound alibi (he was at work up to midnight).

I don't parse the motivations. I read the motivations. And no, the "not guilty of murder" is not a frame above the rest. Not in the world where I live.
It's going to be relevant, in the contexts that matter to me.

That the courts might of said there were multiple attackers does not make it so.

In fact, it is just so, regardless of what the courts said.

Frankly, I find the 6 out of 7 experts who said the murder could have or was the actions of a single assailant far more persuasive than a fat ass in a robe.

An idiotic comment. The expert witnesses are like lawyers - at best they are only witnesses. Their number is irrelevant to the point. Their arguments need to be persuasive, not their number.

There is much more reason to believe Detective John Douglass than Nencini or Massei.

Really? And what's your problem with Massei and Nencini? Isn't that a nationalist prejudice maybe?
You decide to "believe" a guy who 1) presents an opinion that obviously contradicts his own handbook; 2) has not been cross-questioned, and has not even dealt with the case; 3) is obviously not neutral; 4) does not respond to the points Nencini & Massei point out.

Repeat after me Machiavelli, "Not Guilty". Now, go write it on the blackboard a thousand times. Maybe you'll remember it then.

Repeat a thousand times: proven fact Amanda Knox was at murder; she heared Meredith's scream; there are multiple perpetrators; Guede was not holding the knife; Knox washed her hands from Meredith's blood, in the best hypothesis while performing a cleanup; Knox is a convicted felon who accused an innocent without being coerced and maliciously, in order to protect a killer.
You'll better start getting used to the tune, because you'll going to be hearing it forever.

Then you may also become aware about the points of law established by Chieffi, which B/M doesn't have the power to overturn. Such as for example, that those who claim DNA contamination should bring evidence of that; asserting violation of alleged "protocols" doesn't work; reliability of witnesses cannot be re-assessed by SC panels; evidence must be onsidered as a whole and not parcelled out; pieces of evidence cannot be ruled out only based on their being imperfect taken in isolation; and so on.
Those points are valid, and in conflict with Bruno/Marasca.
Frankly I think the establishing of points of law is a far more important issue than the life of Knox, and will bring important consequences.

The Friends of Amanda (FOA)

It's not so much they are a racist, or racial, group, but more that Black Americans didn't particularly care for Amanda blaming the nearest Black guy for the rape and murder, referring to him, as her boss, to police, as, "the African raggazzo".

No doubt it was too much shades of the woman in To Kill a Mockingbird who saw the Black defendant hanged, even though she had seduced him and then cried rape.

I can imagine the majority Black members of the various Innocence Projects Amanda hooked herself onto probably looked at her and thought, "Hey, man, she ain't innocent, what is she doing on our patch?"

Now that she has renounced being "a speaker", it is clear to them she was just a 'user', whilst it suited her purpose.

The FOA are professional liars. They stand like sentinels, like the jackal-headed Ancient Egyptian god Anubis, who guards the tombs, at the port of every internet comments strip, forum, tweet or Amazon review, waiting and watching for any hint of the truth, and they are there in readiness to butt in and rebut any so-called "guilter" or "hater", in their high school terminology, with FOA spin and soundbites, completely ignoring any evidence or rational argument.

It reminds me of when The Bell Curve came out, there was relentless propaganda from a group of racists repeating over and over again like a broken record that Black Americans had a 20-point lower IQ than European Americans, quite regardless of scientific and sociological facts that showed the tests were culturally flawed and skewed towards the well-educated.

The FOA have a belief that the more they repeat, "the kids are innocent" the more it will become part of the hegemony and people will simply take it for granted as "fact".

They fear and loathe anyone dispelling the myths they spin.

They spend all of their energies trying to dream up scenarios wherein "Rudy did it all by himself" even when the truth to the contrary stares them in the face.

Another reason is that they have based their view of Rudy on stereotypes taken from the streets of Harlem or Straight Outta Compton and transposed that radicalised view onto middle-class Italian, Ivorian-born Rudy.

Mach, the writing in the judgement is complex and beyond my Italian. So you may or not be correct. However, even if the court had concluded that Knox and Sollecito were guilty BARD, I would still think that this was a miscarriage of justice. If the court has concluded this I do not think they are correct. Courts are poor places to discover truth. In England this has been recognised and there is an extrajudicial system to address miscarriages of justice that is not bound by previous court opinions or strict rules of evidence.

So whether the court said Knox and Sollecito were there at the time of the murder or not; I think there is no reliable evidence of their presence. I think whether or not the court ruled the murder was committed by more than one person, there is no reliable evidence that can determine this. No there is not evidence BARD that Knox and Sollecito were elsewhere (nor do I have evidence I was not there), No there is not evidence BARD that only one person was involved in the crime.

The court did determine that Knox and Sollecito were not proven guilty BARD, and that the police investigation was too inadequate that there was any possibility of a safe conviction being achieved.

The bizarre thing is that seemingly the ENTIRE reasoning behind the Marasca SC panel's views on Knox's presence at the cottage at the time of the murder is based upon Knox's own now-infamous "confession/accusation". Marasca et al write that it can be deduced that Knox was there because she said she was there in the statements given to police on 5th/6th November! Eve more strangely perhaps, Marasca goes on to "reason" that this implies Sollecito might have been present too, since (in his court's view) there's little reason to think that Sollecito wouldn't have been wherever Knox was!

And of course there is a huge error involved in this reasoning. The vast bulk of everything Knox said and wrote on 5th/6th November was - entirely correctly and properly (for very obvious reasons) - inadmissible against Knox in her murder trial. So Marasca clearly shouldn't have used the statements as the basis (seemingly the whole basis!) for concluding that she was in the cottage during the murder. And of course this whole issue is currently being processed by the ECHR.

Italian criminal justice is broken and rotten from top to bottom. That the Marasca court came to the fundamentally correct decision (based on the correct deduction that there is/was no credible, reliable evidence of Knox's or Sollecito's participation in the murder (and that there never will be any such evidence) is of course to be welcomed. But the Marasca ruling is riddled with self-protecting strategies (in the sense of protecting the judiciary at large, and protecting the prosecutors, and protecting the might of the Italian state and its machinery) and is clearly faulty in a number of areas.

The whole thing is and always was a fiasco of the first order. Italy and its citizens should be hugely ashamed of how its authorities and its judiciary have acted throughout the entire investigation and trials process in respect of the Kercher murder. There desperately needs to be change, and it's only strong executives and legislatures (whether or not they are directly addressing public clamour for wholesale change - which the Italian public absolutely ought to be doing) who can effect and enforce such change. Perhaps the ECHR (and to a lesser degree the European Courts of Justice and the European Parliament) will also do its part in tearing up Italy's broken and botched system, and putting in place a system that's fit for purpose and worthy of a country that wants to call itself a modern liberalised democracy (as opposed to a mock democracy with quasi-fascist hangovers, in which the authorities wield inordinate and improper levels of power and control over ordinary citizens and the media). We'll see........

To be clear, I have said the defense didn't need to prove who the others were and didn't need to put all their eggs in the lone wolf basket. Also, I would like more information about Kokomani and don't understand why he wasn't a suspect as he was there and knew Rudi and fled to Albania right after the murder.

Why would you call Sophie Hicham's girlfriend?

To repeat my main point is there is as much evidence that someone else was in the cottage that night as there is evidence Amanda was there.

It is interesting if true that there is a connection to Domus.

In checking how much had been stolen, the man noticed that very few banknotes were missing and three credit cards; the next evening immediately after, going to the discotheque “Domus”, he thought he saw again the young man in question among the customers of the local. After some time, seeing GUEDE’s photo in the newspapers, TRAMONTANO had the impression that it was really him who had been the burglar.

But the point is, I am not here to talk about what other people talk about. I am not Bill Williams. I am interested in talking about truth, not about "traction".

Oh really? Well, the truth is as follows:

1) There is not (and there never was) any credible, reliable evidence pointing to the participation of Knox and/or Sollecito in the murder of Meredith Kercher.

2) There is more than sufficient credible, reliable evidence to prove BARD that Guede participated at a significant level in the murder of Meredith Kercher.

3) The credible, reliable evidence (and lack of evidence) is all wholly compatible and consistent with Guede acting alone.

4) There is plenty of credible, reliable evidence pointing towards Knox and Sollecito having spent the whole evening/night of 1st/3nd November 2007 (from about 6.30pm onwards) in Sollecito's apartment.

That's the truth. How's that for ya....?

What I am discussing about is why the pro-Knox supporters lie. Didn't you notice that?

Why do the pro-Mignini* supporters** lie about the true nature of the forensic evidence, the truth about Knox's phone activity on 2nd November, the true nature of Kercher's wounds, the true assessment of Curatolo's testimony (in terms of its factual content and its credibility/reliability), the "disco buses" issue, and so on and so on and so on..........?

Didn't you notice that?

* But of course it's as reductive, silly and incorrect to pejoratively title people who harbour a belief in the guilt of Knox/Sollecito "pro-Mignini" as it is to title other people who harbour a belief in the non-guilt/innocence of Knox/Sollecito "Pro-Knox". And to bandy around those sorts of stupid labels is rather a betrayal of motivations in and of itself, as well as being a clear indication of a very poor level of argument and critical thinking.

** And similarly, it's as reductive, silly and incorrect to imply that all those who harbour a belief in guilt of Knox/Sollecito are some sort of homogeneous grouping following some sort of agreed strategy/rulebook as it is to imply that those who harbour a belief in the non-guilt/innocence of Knox/Sollecito are a similar sort of homogeneous grouping. In reality, outside of a small group of advocates, every other pro-acquittal commentator is an unconnected, unaffiliated individual who happens to have arrived at the intellectual conclusion that neither Knox nor Sollecito likely had anything to do with this murder, and that neither of them should ever have been convicted of anything to do with the murder. Once again, this form of artificial grouping of one's "enemies" into some sort of malevolent coalescent mass is a betrayal of motivations, and a clear indication of a very poor level of argument and critical thinking.

To be clear, I have said the defense didn't need to prove who the others were and didn't need to put all their eggs in the lone wolf basket. It was only a casual relationship. They had kissed at Halloween. The police were suspicious and ordered a wire tap.

What Detective Douglas had to say about the Kercher murder and Amanda Knox and Raffaele Sollecito and their involvement in the murder.

“They are innocent—I'm convinced of it,”

KE: What was your conclusion of the behavioral profiles you conducted?

JD: From the profiles created, none of the behavioral or forensic evidence leads to Amanda and Raffaele. There's no history or experience related to violence or mental illness in their backgrounds. None of the behavioral or forensic evidence leads to them. This is not a case of serial killers, cold blooded murderers. They used marijuana, but that’s not some hard core drug that will change a normal personality. They should’ve walked out of there.

KE: What behavioral evidence should there have been?

JD: Well, fleeing for one, which only Guede did. They would’ve been nervous, may drink heavily, or become rigid in their personalities, behaviors along that line – certainly not buying underwear and kissing. The fact that they were kissing - people looked at this as a sign of guilt, if anything; I look at it as a sign of innocence. These two individuals – Amanda and Raffaele, for them to commit this horrific crime and leave the crime scene that way – it was a massacre – and then hours later, be back at the crime scene, just doesn’t fit. These were two young people who couldn't fathom what had taken place. (It was so surreal) they thought they were going to stroll in and out of there and justice would prevail. But, it didn’t happen that way. Justice did not prevail.

KE: Do you believe more than one person could've killed Meredith?
JD: Based on my experience, the crime scene does not indicate the presence of three individuals in the room where Meredith was murdered. What was done to the victim, the way in which the crime occurred, was not the result of three people. This can be concluded without a DNA test.

And of course this whole issue is currently being processed by the ECHR.

Well, I wouldn't say Bruno/Marasca draws the conclusion of Knox presence during the murder from Knox's own statement, since Bruno/Marasca merely points out how this fact is "alla stregua di" = "in accord with" the statement of Amanda Knox.
It points out that Knox's statement is in accord with this scenario and tends to confirm it. But it doesn't place the statement at the fundament of the reasoning.

In fact, Bruno/Marasca doesn't detail on the actual basis for the conclusion. It just points out this fact was proven in the trial, without specifying the details, as if was to be regarded as self-evident.
The hearing of the scream seems to be an original observation by Bruno/Marasca to emphasize that the timing of Knox's presence was when the murder took place, a kind of further confirmation.

Strangely I agree with LJ on part of what he says, that Bruno/Marasca shouldn't have used Knox's statements as a basis for a reasoning and draw a conclusion (albeit it is not true that it was used as a basis in a consequential reasoning, Marasca actually presents it only as an accessory: linked by "alla stregua di", such connector rules out a casual link and makes it instead an accessory, a mere confirmation or analogy, something just "in accord with").
But the reason for this is not the reasons expressed by LJ, who has an erroneous interpretation of it as a reasoning based on causal logical connectors - which is not. The reason why they should have better avoided entering the topic at all, instead, is that Bruno-Marasca is a Supreme Court panel. It is not suppposed to draw conclusions assessing directly the reliability of a testimony, such as that of Amanda Knox. It doesn't really matter that this was just recalled as an element of confirmation. This is not exactly what the Cassazione is supposed to do.
To be fair to Bruno/Marasca, here it seems they intended to express a favourable judgement on the work of Nencini on this particular part of his judgement. Therefore one may see it as a judgment on the judgement, rather than a judgment of the testimony.
But anyway I am strongly perplexed by everything B/M wrote.

This is full rationalization-mode LJ's style. It's entirely nonsense. It's not worth to point out the absurdities in it. Only think about the way Bruno/Marasca creates a conflicts of res judicata with Chieffi on points of law. Does that make sense from the point of view of a panel poised to "self protecting" himself or the judiciary? Bruno/Marasca is so idiotic and foolish, self-contradictory and incontradiction with jurisprudence that seems rather designed to sink the prestige of the judiciary. It's hardly readable as a strategy for self-protection.

The whole thing is and always was a fiasco of the first order. Italy and its citizens should be hugely ashamed of how its authorities and its judiciary have acted throughout the entire investigation and trials process in respect of the Kercher murder.

I am ashamed of Hellmann & Bruno/ Marasca, you bet.

There desperately needs to be change, and it's only strong executives and legislatures (whether or not they are directly addressing public clamour for wholesale change - which the Italian public absolutely ought to be doing) who can effect and enforce such change. We'll see........

With due respect, you have no clue of what the Italian debate looks like.
You don't know, just an example, that the parliament of Tuscany has a comittee investigating conspiracy related to politics, judiciary and Masonry, and Mignini testified there something like a week ago.
There's something ironic: You should read the latest ECHR ruling against, egregiously in favour of the Italian judiciary, praising magistrates, while slmming the Italian executives and legistatures and, yes, also the United States. The recent ECHR ruling on Abu Omar kidnapping affair also points out the political conspiracy between corrupt executives and United States security agencies.
See some quotes praising the quality of italian magistrates and police as reported in the ruling:

"This is not a case of serial killers, cold blooded murderers". You tell me. What an idiot. And whoever talked about "cold blooded" murderers?
That has never been the case. Those are three idiots who shared a half brain in three, and that one was on drug or alcohool. They did not plan to kill. They were unable to plan even where they were going to sleep the next night.

KE: What behavioral evidence should there have been?

"based on my experience" ... "without a DNA test" .. full of gas, the dude should be my oracle? "Without a DNA test". What an idiot.
You are really telling me I shall listen to this idiocy. It's hard to believe.
