Obama prepares order on guns

Can an Executive Order be used to mandate stricter enforcement if existing laws? I keep hearing that Obama cannot create laws through Executive Orders - does anybody think otherwise? Is there any chance that he can just use the EO to require changes in the way the various agencies implement existing laws?

I'm not sure what can legally be done via an EO or an EA.

I will be surprised if the Obama admin does not try to make new law, though.

Fearless prediction:

Nothing of note changes, Breitbart and their ilk make memes for facebook saying "They're cummin' fer yer gunzz!"

The best way for Obama to strengthen guns laws is to get shot by a right-wing nutjob, preferably a high ranking member of the NRA.

If he does anything, it likely won't make too much sense, won't affect criminals at all, and will mostly be for show.

Or, it will be so wrong/illegal/unconstitutional, that even people in favor of gun control will be shocked.
Or, it will actually be effective and gun nuts will really get upset.

Or, it will hasten the Apocalypse and all the faithful will ascend to Heaven with their guns.

Or... isn't idle speculation fun?

Certainly, that is EXACTLY what EOs do. But in this case there is no FEDERAL law requiring back ground checks for private sales. So he's got nothing. Though 18 states do have such laws. And there is a proposed law in the works. And Obama would sign it, but it is still in committee. And has a slim chance.

My prediction? Gun sales skyrocket. Again.
The most effective thing he could do would be to recommend everyone go buy a gun. That might curb gun sales.

I just box a 525 round box of .22 and 100 round box of .45 acp just because I am afraid of that. . . .And I support tighter registration.

Trying something is not necessarily better.

I support training, improvement of the background check system, and stricter enforcement of the many gun laws we already have.

The first thing I would do is get rid of the "3 days and you're good" rule on background checks that cleared the way for Dylann Roof to buy a gun.

I would make it a more reasonable time to investigate, like 1 week.
I would also not allow a "non-response" from NICS to mean that the purchase is legal. I would require a definitive yes or no from NICS.

With a time limit on it or must issue and the time limit no more than two weeks. No time limit is justice denied.

Lol

I still can't get 22wmr ammo at my local supplier, thanks Mr. President!

It means the pen is mightier than the sword, and remember, you never want to take a knife to a gun fight.

Depends on how close you are before the shooter sees your knife!!! Also, if you have a gun and a knife you can take his scalp for 'afters!!! or a nice odd hairpiece!!

Both can be fatal if you use enough force to jam them into someone. You get better reach with a sword but you can get closer without arousing suspicion with a pen. It really boils down to whether the victim is someone who trusts you or not.

, and remember, you never want to take a knife to a gun fight.

Really? I'd always want to have a knife at a gun fight, so that when I pretend to surrender and put down my gun and everyone relaxes then I can surprise them with the knife. "My dear bishop, you really should pay more attention to words. I swore not to shoot you; I never said I wouldn't kill you. Your plans are undone, the amulet is mine, and your time is up." Then I jab a pen right through his throat and ascend the throne as the new pope of Mars. And to think people worry about Obama!
