Which part of "interrupted" could possibly cause you any difficulty? He made himself at home, used the bathroom and the kitchen, did a bit of looking around and going into things, none of this necessarily in that order. Then, Kercher came home.

The whole "hardly anything was taken how can it be a real burglary" idea is explained by the return of Kercher.

If you'd been planning a burglary and end up committing a murder, how much do you think would your mind still be focussed on a couple hundred euros worth of fenceable gear taken from the house of the girl you've just killed? It's hot, hot, hot! And you need to clean up and escape.

Fulcanelli was big on the "if this was a burglary, why didn't he still the laptop meme"? These are the same banal and idiotic arguments that have been made for years on this forum. Every guilter thinks they know exactly what every burglar would or wouldn't do. When given alternative explanations, i.e., maybe he didn't see the laptop, maybe he just got his hands on whatever he saw first and got the hell out of there, etc., the goal post just moves. Vixen's lame arguments are nothing new, though the attempt at wittiness makes them somewhat more cringe worthy than the others.
 
No. The attempted burglary was premeditated. Throwing a rock is designed to elicit a response from anyone inside. If no response, the way is clear to burgle. Unfortunately, the strategy does not take into account the coming home of a resident later. Hence, an unpremeditated murder.

Burglars, on the whole, go out of their way not to get into a confrontation. It's bad for business. I've asked a few.

My own suspicion, which I really cannot prove, is that Guede did not want to get into a fight with Kercher, would have preferred an escape, but was challenged by her in a manner, which was sufficient to cause him to attack, restrain and ultimately kill her. This would appear to have aroused him.

If not, the balcony nearby was a far better bet in gaining entry, not least, because it was concealed from the road and there are no shutters in the way.

NO. The first GPS enabled phone was the 2008 Nokia N96. But most telecom companies in 2008 did not log GPS location data. And any pinpointing location of the phones was through logged antennas servicing calls...and that isn't always done either.

This is where you do not know what you are talking about. The balcony is totally exposed to the road, and illuminated by street lamps. This thread has been around this topic four or five times.

Apart from the fact that the previous sentence is an unequivocal truth, a simple tester of the truth is the fact that GPS location communications require a pretty serious amount of battery power. If customers were switching their phones off at half power, then switching them back on a day later to find virtually no remaining battery, they would be rightly perplexed.

It also bears saying here (especially as Vixen is so embarrassingly ignorant on the subject) that when one talks about GPS on a mobile phone, the phone is acting as a GPS receiver, not a GPS transmitter. In that respect, a phone acts in the same way as an in-car satnav: it receives signals from a number of GPS satellites, then uses an algorithm to calculate a position from those received data. When one talks about a phone "broadcasting" its GPS position, this now has nothing to do with the GPS satellite network - i.e. the handset is not communicating any info back up to the GPS satellites. Instead, any reporting of the handset's GPS position must be done via the standard mobile network. Another reason why, if a phone is switched off, it's impossible to track its GPS location.



Guys, if you don't want a trace, for example, going into a store which tracks "Pathway Technology", it's not enough to turn your phone off, you need to put your phone in "flight mode".


Hahaha. This is laughably wrong in many respects. Putting a phone in flight mode does no more and no less than stop the phone's ability to transmit any signal. It does not stop a phone from receiving data (including incoming GPS data). Lastly, putting your phone in flight mode then turning it off has exactly the same ultimate effect as just turning your phone off.

I believe the cottage has been burglarized a few other times since the murder as well, albeit I don't believe through the same window. I also note you have to mischaracterize reality in order to make your argument, i.e., referring to a rock as a "boulder", assuming anyone could see Rudy if he climbed through the window, describing the cottage as Rudy's "friend's house" (which it wasn't, although he had been there, but that doesn't help you because it just means he knew the surroundings, which again doesn't help you because, you know, it's nice for a burglar to break into a place he is familiar with). Oh, and he also burglarized the office a week before, so he kind of had an M.O.

When you get past your rather unlettered attempt at a witty creation of what would be going through Rudy's head, your post was pretty empty of any real substance.

But hey, maybe you're an expert in burglaries and can enlighten us all.

That's where you are wrong. As Raf discovered after switching his phone on circa 6:00am of the murder morning, his dad's message of 11:00 the night before came through, and, what's more, the gps records were retrievable.

Likewise, if you go abroad and switch your phone off, as soon as you switch it on, all the queued texts and missed calls come through.

When I was outside Europe, I kept my phone on "flight mode", as just the cost of receiving a text was prohibitive. This gave me a nice low phone bill and anyone who rang or sent a text, did not succeed in getting through at all, and there was no record.

This is funny. I think Rudy is a burglar because there is evidence that Rudy probably committed 4 burglaries in the month leading up to the murder. But there is NOT enough to convict him of those crimes. I wouldn't say he was a drug dealer.But it is dam clear he is a killer.

And Rudy did not even bring over some condoms...

WRONG WRONG WRONG. There are NO, Absolutely NO GPS records. What there are are antenna records such as Piazza Lupatelli or WIND 30064. But if you would like to attempt to prove me wrong..go for it. Come back with a cite, This has been gone over thoroughly. I personally mapped every cell tower with in miles of the cottage.

I will repeat slowly: putting your phone on flight mode prevents any radio transmission from your phone. That also in effect means that you cannot receive any incoming calls/texts/MMS, since a handshake is required before such communication can commence (and also the handset needs to regularly ping the network to let it know where it is). Since this handshake (and pings) cannot be done (because the phone cannot transmit), the communication cannot take place.

Therefore, if you are (for example) sent a text message when your phone is on flight mode, exactly the same mechanism happens as if your phone were switched off: the network searches for your handset in order to deliver the text, but cannot find it (because it hears no handshake return from the phone). The network therefore stores the text message on its own servers, ready to deliver it to your handset the next time your handset "checks in" with the network.

I have no idea at all what you mean by "and what's more, the GPS records were retrievable". I suspect that you don't either. On the offchance that you think you do know what you mean, could you elaborate further?

I will repeat once more for clarity though: turning your phone off entirely eliminates the possibility of tracking the phone via GPS (or, for that matter, any other form of location tracking). None of the phone's electronic circuits are getting power. The phone simple cannot be receiving GPS satellite signals, and therefore the phone cannot be capable of calculating - far less recording/storing- far less transmitting - its location.

In the same way, your car satnav isn't continuing to receive GPS satellite when it's switched off. If you have a car satnav, you may know that when you turn it on, it takes a little while to establish reception from the GPS network and to calculate position. That's because it has not had any communication whatsoever from the GPS satellites since it was last turned off. Exactly like a mobile phone.

It appears to me that on the subject of mobile phone technology and GPS, Vixen a) has very little innate knowledge on the subject, b) is making things up to compensate for that lack of knowledge, and c) is making things up in a confirmation-biased way to fit a prior agenda. That's quite some going! :)
