Shrien Dewani - Honeymoon murder

Queue a new conspiracy theory - the judge was bought by the Dewani family. Yup. I heard that this morning around the water cooler.

The local media has convinced most South Africans of Dewani's guilt, which of course means the only way this could have happened was if the Dewani family has the judge in their pocket.

Yep and straight from good old PMF

Oh, if it's the Guardian, that's just Dan Newling, who was Clifford's retained man-on-the-case. Sure, it's a conspiracy, but a different one. Dewani's family, who have millions available, bought off a certain prosecutor to throw the case, as is obvious.

mrjitty is one dumb kiwi lawyer by the way.

'Cue', not 'queue' :)

Now mrjitty, and sorry for taking to task a fellow nzder, says

So the problem is not the lack of evidence - they have got 3 guys to say it was Dewani's plan.

But the three guys were getting attenuated sentences for agreeing on the plan, including agreeing on the distribution of chump change for an international celebrity murder.

Achod Hindocha was on BBC Radio 4's Today programme this morning. Still banging on about the German master. Mind, I don't blame the Hindochas for being pissed off that he's bisexual and had a sordid secret sex life, but the smear campaign they're going in for re: the murder case is not classy.

Heh, goes to show what they understand about evidence at PMF.

I do. I find these people increasingly repellent. They can't be so unintelligent as not to know how the criminal process works. These coded demands for 'the truth' don't confound me. They think he's guilty and has got away on a technicality and would say so if they had the courage of their convictions rather than a deep love of money.

Moreover, it's none of their business whether he misled Anni about his bi-sexuality. That is between him and her. For all they know, he told her about it or he was going to do so and be forgiven. Anyway, in English law, so far as I know, no cause of action lies for mis-representation of sexuality as an inducement to marry nor can anyone in my office think of a valid cause of action arising from the known facts.

I know legally they shouldn't have a leg to stand on and the people they really should be haranguing for the truth are obviously the SA police and Mbolombo.

However as I said this whole saga smacks of Greek tragedy and despite it being a personal matter between Anni and Shrien, I can see that they are angry that he possibly didn't and probably couldn't make her happy. They probably see the situation as that, even if they thought him innocent, Anni shouldn't have been with him in SA at all. If he'd been honest about his sexuality, they'd never have married.

That said, I believe that Shrien genuinely felt that he loved Anni and wanted to make it work. Not sure Anni would have felt the same had she known what he got up to in secret. All my speculation, naturally!

What they should sue him for murdering her. Do an OJ and prove the case in a civil court. At least that would be honest. They would very probably lose expensively. It's cheaper and less risky to smear him, which is what they are doing instead.

Do you think their lawyer will advise them against bringing a civil suit?

Depends on the lawyer. And the suit. My guess is they will sue for something. Maybe someone can concoct some claim arising from these facts based on some long-forgotten law. There are plenty of chancers out there. All I can say is if they came to me I would be unable to think of a cause of action except trespass to the person and my advice on the merits of that would be extremely negative. London, however, is awash with lawyers willing to pursue all kinds of weirdo claims. I suggest they go to these guys. They have an impressive track record of losing high profile cases and are sufficiently useless for the role.

The latest articles I've read say the Hindochas are waiting til after Christmas to make a decision.

The BBC reporting on this case is bothering me - they consistently refer to Qwabe and Mngeni as "hitmen" and write things like, "Mbolombo was the middle man who arranged the murder".

I think this is a biased way to describe what happened, as it makes it sound like the intention was always to kill her. I expect that kind of bias from the papers, but the BBC should be more careful with the wording. No wonder people think Dewani is guilty.

Leila Schnepps is always interesting (to me), as she is very analytical sometimes coming to logical conclusions.

On this case she has this to say.

But did you know that her family forced her to marry him? That she tried and tried to get out of it before the wedding, broke it off four times, even took off her engagement ring and threw it at him, and told her family she wouldn't go through with it, but her family told her that she would dishonor the whole family forever if she didn't? Have you ever read the text messages she sent her cousin during the days before the wedding? I have no sympathy with the older members of her family. They contributed to the murder by forcing her into a deadly marriage against her will.

Is she saying Shrien organised a killing here?

Followed by this with some actual swedish texts translated.

quote:
Anni sent a series of text messages to her cousin Sneha in the lead up to the wedding
But doubts remained. ‘Anni told me she was not comfortable with Dewani and that they fought and argued a lot,’ Sneha told police. ‘These trivial arguments were continuous.’
In May 2010, shortly before their engagement that month, Anni emailed Dewani again, calling it off, but he promised to ‘change his ways’ and it went ahead.

Anni’s texts to Sneha, translated from Swedish, begin in August 2010 when Anni was visiting Shrien’s family:

August 5, 2010: ‘Miss you so much. Don’t want to be with these people. I don’t know what to do. I’m much more comfortable alone. I hate them. Want to cry myself to death.’

August 25: ‘Feels very empty without you. Can’t understand why I’m crying all the time.’

By September matters had reached a head while Anni was in India for wedding preparations:
Honeymoon: The couple went to South Africa to celebrate their wedding, but it ended in horror.

September 3: ‘Crying every day. My clothes catastrophic and so much to do that I can’t cope. I feel abandoned by everybody.’

September 16: ‘Fighting a lot with Shrien. Told him I’m going home. Wish I never got engaged.

Everyone tells me how fortunate I am – even my designer tells me that he’s good-looking and that I am lucky. Absolutely sick. We’re seeing each other for three days and only fight.’

September 21: ‘I don’t want to marry him. I’m going to be unhappy for the rest of my life. If I know [sic] news like this I would not have got engaged.

'Do you think I will be able to find someone else if I break this? Feels bad that everyone has booked their tickets.

'I’m not happy. One cannot even hug him. We have nothing in common. He is putting pressure on everything.

‘He’s a perfectionist. Don’t want to, but I feel sorry for my parents.’

September 22: ‘Told his and my parents I don’t want to get married.’

Mr Hindocha, 64, an electrical contractor, told police he received a tearful call from Dewani’s grandmother Ansyuben in India at this point.

He said: ‘[She] begged me to talk to Anni, stating that she must please not do this as their family reputation would be zero if Anni decided not to go through with the wedding.’

End Quote

ETA she predicted Masipa's Pistorius judgement accurately while the bloodhounds would hang him high on PMF.

The most interesting thing about Leila is that, despite having a brain, she is content to mix with that nest of malicious vipers. Aside from that the texts you quoted do not suggest someone being forced into marriage by her parents.

Hard to say from this quote. Anni was murdered and had she not married Shrien she would not have been in SA and would not have been hijacked.
