The most important bit, from a Tr00ther/Skeptic perspective, is that UL's motion to dismiss says not one word about any of Ryan's claims. They do not deny them or comment on what UL did or did not do. If the case is dismissed at this level (and it should be) the record will be of no help to the tinhats. That is not to say that they won't spin stories of government intrigue and judges being coerced and whatever, but the record won't support them one bit.

I really feel sorry for Ryan's lawyers who now have to answer this motion. I wouldn't be surprised if the next thing we see is a motion from one or more of Ryan's lawyers to be removed from the case. In fact, I'll give 3-1 that the motion to dismiss never gets answered by anyone.

I think the woowoos are going to hold this complaint in high regard just as they did with Willie Rodriguez' complaint and that RICO suit that was brought against Bush. Useless lawsuit if you ask me. I wonder, is there a legal way to make Ryan pay not only for wasting the court's time but for uL's lawyers. That would be about what he deserves.

Actually, if it hadn't been for LossLeader's posts about the searches he'd done and if it wasn't for his suggestion that someone with PACER access look at other levels of court, I probably wouldn't have bothered to search PACER for it at all. I mean, with a gazillion local courts and such, it's just something that I wouldn't have done absent further information or a real incentive to go looking.

But since LL (the other LL) did search out the local courts thoroughly and tediously, that made a world of difference since I could eliminate all of those in my search, and conduct a simple search that exluded all of the work that he had already done. In other words, he made it easy for me to do what I did, by doing what he did in advance.

(Sorry if this is verbose, but bottom line is that I'm just trying to say kudos to Loss Leader for pointing this in the right direction)

Agreed. They responded brilliantly by deliberately leaving out any argument about the tinhat stuff that Ryan was trying to draw them into, and instead sticking to the law, which, on a motion to dismiss for failure to state a cause of action, is the perfect response

Yep. Someone trying to describe Russia.

On another board where I fight the woos in a hostile environment (to me), they've posted a message to contribute to Ryan's "legal defense fund". Calling him a "whistleblower". I posted a request to NOT give him a dime. But that seems to spur them on. Was answered by a woo who gleefully sent Ryan twenty bucks and bragged about it.

Maybe running the woos out of their money could be a good thing?

Based solely upon the limited research I've done on this case and the lawyers involved, I would guess that the initial lawyer was acting pro bono when he brought the suit in Monroe County Circuit Court.

After UL was successful in removing the case from the Monroe County Circuit Court and sending it to the District Courrt, it looks like Ryan's initial lawyer had to call in reinforcements, and it appears that's where the other two come in.

I don't know enough about them (yet) to say whether they are acting on a contingency basis or not, but if I had to guess, I would guess that they are. None of them seems to have any particular expertise in this type of case, or in litigation in general for that matter, and frankly, any lawyer who would put his or her name to that pleading (the complaint linked earlier above) has earned my derision, as it is really poorly drafted.

Ok, suppose that the working speculation is correct; CT vs. NIST is actually what Ryan and his lawyers want to make this case about, what would their next move be? Do they have any legal method to try to force UL to address the NIST claims? Or is this really a "we gave it a try, but they saw us coming and trumped us before we could even get out of the gate" (to mix metaphors) situation?

Thanks for doing this LashL and enigma! Ryan's complaint seems to have been written in a hurry by people who don't have high expectations. U.L.'s motion to dismiss is a delightful controlled demolition.
