First, the police interview was discredited. It's hard to know what his actual testimony would have been or was, he wasn't the brightest bulb on the string.
So I have to go by the scenario the defense attorney presented and the fact there are no videos of him waving the gun around or even holding it. They presented the material bunched up around the trigger scenario.
You can believe whatever you want to believe about what happened but the issue is a decision in a court of law, beyond reasonable doubt. It's supposed to keep innocent people out of jail though we all know that happens anyway.
The defense presented reasonable doubt that the only way the gun could have fired was with Zarate having his finger on the trigger. They presented an alternative that cannot be reasonably ruled out.
