I see I made an error in the possibilities I listed above. If no candidate gets the required 270 votes in the EC, the decision for president is kicked to the House - which gets to choose from the top-3 -

But doesn't that election in the House have some hinkey rule that each state gets one vote, not each member?

If some complicated issue, say a Bush type of recount or say a death (Hillary has seizure?), came up and there still was no decision at the end of December, who is president till they resolve it?

The current president and vp would serve until Jan. 20. After that, without an elected president or vice president, I believe that the Speaker of the House -- third in line of succession -- would serve as acting President. The new Congress would have been sworn in earlier in January.

If both Ryan and Hatch are unable or unwilling to serve, it gets real tricky, because the next dozen names are outgoing cabinet members.

But speaker and president pro temp are elected positions. The House and Senate could replace them at will.
