His actions serious jeopardised the trial. A re-trial would cost millions and would potentially leave the accused on the streets for longer (if convicted).

At the risk of derailing the thread, what public interest is there in knowing that (say) a particular eight year old girl was raped, as opposed to her having anonymity which she can choose to break if she wants to? How does having her name, age, address and school bandied about in the press help the child recover from that ordeal, or help her to live as normal a life as she can?

What sort of prurient person needs to know the name of a child victim of sexual abuse anyway? Isn't it enough that to know their age and gender?

Because to tolerate this would be to tolerate a sliding slope that would eventually end in islamo-communist matriarchical totalitarianism... or something.

You don't know what I'm objecting to. I have no issue with the court applying restrictions to people observing the trial. I have said so repeatedly. I do have a problem with restricting people not observing the trial.

There are no public spaces in libtopia. The standard Libertarian viewpoint is that all spaces should be privately owned witch means there is no such thing as a public space.

Observing the trial or not, he’s taking an action that harms someone else. This is a no-no in Libertarianism.

Even if you don’t accept that, he’s selling or giving away something that isn’t his which at a minimum violates the property rights of those involved. “But he wasn’t the one to commit the theft” doesn’t matter either because if you happen to receive stolen property Libertarianism doesn’t acknowledge any right for you to resell it or give it away.

Why? Predjudicial material is predjudicial no matter who publishes it. I know that pesky presumption of innocence is a bit of a nuisance, but it’s necessary for a fair trial.

We have an inalienable right to publish and read prejudicial material if we are not interacting with the trial itself.

We have it period. If a reporter gets to attend a trial, and publishes anyway, that is their right. I'm fine with them not being allowed back, but they have a right to not be punished for it.
