I was about to post that here in the US, we have laws to prevent getting close to the many migrating whales, then I read down and saw you have similar restrictions in OZ/NZ as well.

I'll add... I would love to swim with whales or even better, the giant Manta Rays down Baja way. But I don't think the rays, even by accident, will give you the bitch slap of your life.

No, he was in the right, but... maybe he should have secured the services of a Pilot to steer him through the clot of busybody surfers blocking the whale lane.
Honestly though, if he lazily rolls over... I'd rather not be on a board if a fin was coming down on me.

A doctor was surfing at Bondi Beach
A whale popped up, within arms reach
The whale flipped with his tail
Through the air the doctor did sail
A lesson in relative mammal sizes we teach!
The doctor landed on the water with a splat
His eyes were blackened and his lip was fat.
The whale huffed off to the deep in a pout
The doctor was cold cocked - knocked out
An ambulance came - and that was that.
The moral of the story is clear.
Stay away from sea beasts, children dear.
Whales are strong and punch hard
They are not all blubber and lard
Sometimes we are right to large sea animals fear!
