Tucson Mayoral Election - Freeman or hamburgler

I am loathe to poke fun of my own city as I am involved with the Start Our State movement and would like to demonstrate how much better southern AZ would be without Phoenix's intervening. However two of our Mayor candidates make me just shake my head in shame.


Marshall Home - The Freeman
Ron Asta - the hamburgerler

Lets start with Mr. Home. He has been been designated a "vexatious litigant" in federal court for all of the laws suites he has filed. He claims to be a multi billionaire but wont release the source of his wealth. In a recent interview he claimed,

"We owe our poverty to the fact and law that the Arizona state Legislature has failed to provide all free inhabitants of Arizona with a statutory inland Legal Tender declaring what 'thing' shall be for At Law discharge, payment and extinguishment of debts, damages, fines, court cost/fees inter alia," Home wrote in his affidavit to the court. "That we are American Freeman, free inhabitants of the Arizona state, and we find it impossible to obtain State declared Legal Tender at Law."

He is convinced that President Roosevelt held some kind of meeting in 1937 and because of that there are no judges in America just administrators. Perhaps his best stunt to date is filling to have another candidate, Rothschild, thrown off the ballot for being a lawyer...because lawyers can't serve in public office according to Home.

Last week, Rothschild said that Home's claim that lawyers can't serve in public office "would be a novel legal argument. I guess a judge will have to decide that."

Home backs up his argument with a brief excerpt from a 1955 opinion written by then-Arizona Attorney General Robert Morrison.

"All lawyers are licensed and are in judiciary," Home argues. "Well, if they are in the judiciary, they cannot be in the Legislature or the mayor's office."

Home has is own problems namely that he was convicted for assaulting a federal marshall in 2002 and served 10 months in prison. His rights have not been fully restored and thus may himself be ineligible for public office.

Moving on to the Hamburgerler. Ron Asta who has a checkered past in S. AZ. He once served in office as a staunch liberal and anti sprawl guy. He has since morphed into a conservative and is employed as a consultant to home developers. I call him the hamburgerler because,

Aside from his earlier political leanings, he also pointed to what he called a mistake he made 33 years ago when he stole a steak from a supermarket. "It was one of the great humbling experiences in my life," he said.

Much more serious was a car accident he caused in which a girl was killed and he fled the scene.

The impact was severe. Officers estimated the pickup truck was launched 60 feet through the intersection and into a private yard to the north.
Asta said the ticket was dismissed after he attended driving school. Court records for the case have been destroyed.
Jennifer, who was 18, was about to start her senior year at Amphitheater High School.

While apologizing for the steak theft Asta was recently asked about Jennifer to which he said,

"That's the car accident, right?"

Needless to say that came off as rather crass to Jennifer's family.

On an even better note Asta recently asked Tucson to decide if he should stay in the race. The answer was a resounding "NO" but Ron has decided to stay in the race anyway.

So there you have, two of Tucson's choices for mayor...

I truly feel sympathy for the citizens there. :/

Every city has its crazies, don't let it get you down. Compared to some of the yahoos we have in Texas those two look downright sane. If either of these two get elected, that's another story.

I miss Tucson and it looks like the employment links I had there have totally dried up. It makes me sad.

There are other candidates running for the office and neither of these two is likely to get through their primaries. Also the job description for Tucson Mayor is limited to, "Hold scissors, smile, cut ribbon."

I actually think we should elect the freeman and see what he does.

I think the summer heat just fries peoples brains.

Ha! No thanks I suck at cutting ribbons. Those are not the only choices and we have not had primaries yet. Those two just stand out.

I see it as a separation of powers thing. Legislation or Supreme Court, not both, eh?

When you exclusively have legislators who have no idea about how laws are implemented writing them, you wind up with things like the Paris Commune.

exactly. I have no problem with provisions that state that while serving in a legislature or executive position, you cannot practice law (might already be covered in conflict of interest regulations), but the idea that someone who is a member of the bar cannot hold office is just counterproductive.

An extension of that mindset would be that the executive and and legislature cannot even have lawyers on their staff (would still be part of two branches). That would just shut down government completely (which is probably the actual goal of Freemen)

Weak. While Lute will always be "coach" Miller is our head wildcat now.

Either one would be better than these clowns.

I read that both have now dropped out of the race.

He is definitley a freeman

Quite aside from his quirky defense of a (successful) lawsuit to get him removed from the ballot in the mayor's race, the Democrat was in Phoenix seizing "ownership" of nearly two dozen properties belonging to Fannie Mae.
Although he changed the locks and posted no-trespassing signs - and has made the point repeatedly in his short-lived political campaign that foreclosures are illegal - Fannie Mae begs to differ with his legal theory.
