Why were they caught off guard that time?

Certainly they've been wargaming old and new options and contingencies for decades. I doubt they just started after Trump won.

There was definitely a feeling of not being ready for victory in 2016 though. Remember the Republican Healthcare Reform effort? No plan there.

Granted, that is a bit of a tough one for the GOP as the only way to go to the right of Obamacare policywise is to stand up on a soapbox and say that poor sick people should die.

All that the Dems had to do in 2016 was hold on to the House, Senate or Presidency. They didn't. Lots of people were caught flat-footed.

Trump probably didn't help himself by firing Chris Christie after the election. Christie was in charge of planning the White House transition staffing in 2016, a legal requirement that had to be done. Trump butted heads with him a lot over the act that he was spending campaign money, and Christie had to keep explaining that it was both a legal requirement and it would look bad if they didn't at least try to plan for a win.

Christie had about 95% of the work done on election night, but he got too close to Trump in some of the pictures being taken that night, and Trump thought he was getting too big for his britches. That, coupled with the fact that he didn't get along with the other Trumps ensured he was booted out, taking his binders of staffing work with him.
 
My top 10 list:
1) Appoint Walt Nauta as Attorney General
2) Order an end to all criminal proceedings and investigations against himself.
3) Pardon all 1/6 protestors
4) Order the DOJ to conduct investigations into everyone involved in criminal proceedings and investigations against himself.
5) Order the DOJ to conduct repetitive investigations into Biden, Harris, and the members of Biden's cabinet.
6) Rescind all honors and awards that Gen. Milley received during his Army career and cancel his pension.
7) End military aid to Ukraine
8) Withdraw from NATO
9) Change the rules to the maximum extent possible for federal programs to reduce the amount that goes to blue states
10) Bar CNN, MSNBC, the New York Times, and the Washington Post from press conferences and briefins.

Only number 1 on that list is not entirely probable.

Donald Trump vowed to "totally obliterate the deep state" and appoint a special prosecutor to target "the entire Biden crime family" if he wins the 2024 presidential election, just hours after the former president pled not guilty to 37 counts related to his alleged mishandling of classified documents.

After being arrested and processed, Trump addressed supporters at the Trump National Golf Club on June 13, 2023 in Bedminster, New Jersey, where he described the action against him as "the most evil and heinous abuse of power in the history of our country."

Trump is the frontrunner to stand for the Republican Party at the 2024 presidential election, with polling indicating he has a solid lead over Florida Gov. Ron DeSantis, his closest rival. The Bedminster remarks suggest Trump would use a second term to aggressively pursue those he believes have wronged him politically or legally.

Speaking in front of several American flags, Trump commented: "I will appoint a real special prosecutor to go after the most corrupt president in the history of the United States of America Joe Biden, and the entire Biden crime family. Name a special prosecutor. And all others involved with the destruction of our elections, our borders, and our country itself, they're destroying our country."

So, as he's still the "real" president, who won more votes than anyone ever had voted for them, how's he get to stand again in 2024?


That's the genius of it all. By tricking the Deep State and the Swamp into believing that Biden is president (and even make Biden himself believe it!), Trump has made it possible to return in 2025 and rule forever - or at least until JFK Jr. has been resurrected.
 
Repeal the 22nd Amendment.

With widespread acceptance of legal formalism and control over the courts there is no need to repeal or otherwise kill a right. A court can define it into obscurity or, more appropriate in this case, remove any remedy for breach.

Say Trump decides to run for a third term in 2028. The GOP falls in line like it does with all of his planned atrocities. All GOP legislature run states allow him on the ballot. As of now that alone gets him to 270 possible votes. Then he wins* and the Supremes rule that based on a mix of independent state legislature theory and political question doctrine that they aren't going to intervene.

What stops it?

This is, of course, unlikely, but far more likely than walking through the front door of actual repeal.

*Note that even if Trump gets less votes these states could try to override that via the legislature selecting their own preferred electors.

I would think it is pretty obvious that every executive department and agency will lose its independence from the president.

Manufacturers that don’t put enough money into Trump’s pocket will be investigated by the EPA. Airlines who don’t pay will have regulators descend upon them. Networks that air programs Trump doesn’t like will be fined and may even lose their broadcasting license.

His wish list also includes making it illegal to mock, criticize, or disparage the president. In his rallies, he’ll ask what should be done to a specific reporter or editor and the crowd will chant “off with his head.”

Also, say goodbye to the emoluments clause.
 
This is why I should avoid politics threads.

Trump is a danger to democracy, mostly on accident. he's mostly an incompetant narcissist. He doesn't actually want to destroy democracy, he just doesn't care about it.

The real threat is that if he gets elected, who will work for him? Mostly people that will do anything to please and some folks that really do want to destroy democracy.

That being said, I refuse to say that the MAGA crowd are actually conservatives, they aren't, they are radicals.

Also, the emoluments clause should also apply to Biden.

Also, The Dems are not the good guys in this fight. They are very much the less bad guys. Their pacs spent a lot of money getting Trumpist candidates through the primaries then casticating them as threats to democracy. At best that is gross and cynical.

And this is not, a you too argument. Trump is literally the worst in american politics. I will vote for anyone other than Trump. Biden, is basically the second worst in american politics. I will probably vote for a senile old liar because his opposition is a narcissistic man child and also a liar who is extrordinarily corrupt rather than ordinarily corrupt.
