Why is it an issue of free speech at all? Especially in the USA sense?
That's in part what the oral arguments and the briefs were about.

To sum up, American content creators have a First Amendment right to broadcast speech (even on silly video sharing platforms controlled by foreign multinationals) and American viewers have a First Amendment right to listen to it.

Just want to take a moment to give you kudos for resolving a mild misunderstanding like an adult. Been seeing a lot of pissy snipe fests over trivialities lately (not you), and it's reassuring to see that it's not the rule.
 
They have a right to be hosted by TikTok? What if TikTok doesn’t want their content?

I 100% agree with you....TikTok like anyh other business has the right to refuse business if they think it will hurt them in the long run..

I just think any attempt by government,,,,except in certain very limited circumstances the shout fire in a crowded theater doctrine. to control content of Free Speech is a direct threat to Free Speech.
Oh, I think speech should have consequences, but they should happen after the speech has been uttered....not before.
 
The free speech stuff is just a decoy. The critical issue is the app collects data from phones worldwide and sends it to somewhere that can use that data for their own purposes. Doesn't matter if you watch cute kittens or insurrection material or hard raunch on tik tok. That's just window dressing.

ACLU disagrees; they think free speech is the core issue here.

I've heard the arguments but I still don't see the free speech issue here. Its about as much a first amendment violation as anti-graffiti laws are.

Americans have a myriad other places they can express themselves in identical ways that don't constitute a potential national security threat. The only thing unique about tiktok is its algorithm and the only speech being restricted is ByteDance's ability to use that to manipulate Americans.
 
Apparently the ban on TikTok is Biden trying to distract from Trump's inauguration.

The Magas seem to have forgotten Trump instigated the TikTok ban. Now it looks like it helped his presidential campaign he's all for it and will reverse Biden's ban.

Has anybody noticed that everyone wants to go after, and destroy, TIKTOK due to China influence and National Security. When I wanted to disable TIKTOK 3 years ago, I was met with opposition from RINOS to Democrats to everyone else. They actually went to court in an effort to stop me. Now they realize I was right, and have changed their tune. Sadly, I've been right about everything!

Must be tiresome to be a Drumpf cultist. Imagine having to constantly check what the Führer wants, tirelessly arguing for that position online and with family, friends, and co-workers, and then have to do a 180 whenever he changes his mind on something. I imagine that tomorrow a lot of office workers are going to hear Ron raving about how great it is that God-Emperor Drumpf has become President just in time to save the social media app Ron has probably been ranting about and wanted banned for months.

It's going to be a long four years for the sane Americans.

Other social media is replete with screen captures of TikTok's notice of suspension of its service. Some have noted that the wording of the message changed in short order, the second version of which promises working with the Trump administration to restore service. They opine that the whole thing is a Trumpian ploy to manufacture a high-visibility crisis that he willl then "solve" and endear him further to the younger elements of his base who voted for him.

Sounds like he wants to leverage the sale of TikTok to an American operator (Musk?). But yeah, he'll let people suffer, weep, and wail for 24 hours and then ride to the "rescue" in his golf cart. "I saved TikTok from peril I put it in... Love me!"
