If Dewani is acquitted, will the pattern where the family of the victim is outraged and writes books in pursuit of their elusive dream, the incarceration till eternity of the accused be followed?

I just read the wiki. Maybe a good rule of thumb would be to use character profiling to exclude only. Would have helped all of above accused, even Pistorius.
Retrofitting character, then finding motive is a disaster.
 
Oh, and yesterday she told the defence lawyer he didn't need to bother attacking Mbolombo's evidence.


That's pretty huge. Indeed, among the sweetest words that a lawyer can hear from the bench after the other side has made its submissions are, "We don't need to hear from you, Ms. [LashL]."
 
It's not too early. Given that I think you must be right about not giving reasons if she rejects the application (as Henney did in the Mngeni voir dire, he left the reasons to the final judgment) waiting until 8 December says to me that she is preparing a reasoned judgment. She seems to have made it pretty clear her view from day 1.

I think the case was scheduled to end on 8 December anyway, so it all fits in.

Sigh, she might be right, although I did think there was enough to continue if not convict. What's the point of continuing? He wouldn't give evidence anyway now I wouldn't think, especially given her remarks about the evidence of Tongo, so it would be a fruitless exercise.

Sorry for the delayed reaction to this post which nicely shows how barristers think. Never mind the evidence, consider the diary and other Kremlin-watching signals you guys tune into :). As LashL just said, it doesn't get much better than when the judge tells you she doesn't need to hear your submissions.

And of course he did it. That's been obvious ever since we heard about the piss-drinking. But rules are rules and the total absence of any credible evidence at all just about counts as a legal technicality so he gets off. Lucky so and so. :D

The other day I read somewhere that Anni's family has once more taken up the mantra of asking Shrien to say 'what really happened', which veterans of the Knox saga easily recognise as code for 'we know you did it so cough'. Given the UK's vicious libel laws, they are going to have to tread warily if and when the judge chucks this out.

I know several urophiliacs, none have shown homicidal tendencies.

Oh, I doubt I can. According to lane99 I have a track record, presumably for being wrong (s/he didn't elaborate). I'm not wrong about this one, though. I called bull **** from day one.

Five or six I'd say; it depends on what variations of urophilia you count.
It's a moderately common kink in the BDSM community.

I wouldn't know what to ask. Tell you what I will ask, though. Does your knowledge of the subject give you any take on this case? You already said the urophiliacs aren't psychopaths. What about the ones who are leading a double life and whose culture might view such activity with particular disfavour?

Hmmm, OK.
A few general points, There's a pretty sharp divide amongst those who practice BDSM between the light recreational players (light bondage, spanking, toys, pegging et cetera) and the more hardcore lifestyle players. The latter are generally going to be subject to embarrassment and even legal problems should their habits be revealed, and thus tend to be more secretive.
Incidentally in some areas where there's a noticeable BDSM subculture it can be quite cohesive and protective of members.

In general BDSM practitioners enjoy somewhat better health than the norm. Now this may be a surprise to some, who associate such activities with a reaction to past trauma or abuse, but it's been verified by a number of studies (most notably the peer-reviewed Dutch Tilburg study in 2013 of more than a thousand active BDSM practitioners). However as with anything that's seen as "deviant" by society it's a potential stressor for some people, due to the societal repercussions of being outed. Similar to homosexuality, atheism and other societally disapproved behaviours.

Now as for the specifics of Dewani I doubt that his specific sexual practices would be any more likely to attract disfavour from his community than his homosexuality; the latter explains to me a great deal of his supposed secretiveness and other behaviour interpreted to suggest guilt.

And finally, the repeated evocation of urophilia by a certain poster here say far more about him/her than about Dewani.

Interesting, thanks. Does this mean you share the judge's surprising (to some, including the prosecutor and, I confess, myself) lack of interest in the whole German Master thing?
