Roberts would be a battle. I think this fits, since I have theorized that the nominee would have a record on enemy combatant detainee status. Roberts ruled with the 4th Circuit in Hamdan v. Rumsfeld which upheld the DOD's tribunal system.

Let the battle begin!

If I had my own cable news network, I'd play circus music over the grandstanding politicians at the confirmation hearings.

Is he really qualified?? I know thats just a typical question only when the nominees are women or minorities.

Hey! He did it early! I thought it was going to be at 9PM Eastern! I got all excited and turned it on.

Just screw us on the West Coast again, why don't ya?

No, wait, CNN is doing a countdown.

Way to wait for the announcement White House.

Dear Larry King,

Shut up. I know that the nominee is on the left and the President is on the right. This is because I can see. Even if I couldn't, it wouldn't matter because I wouldn't be able to know who was on the left or the right. You don't need to tell me.

Dear President Bush,

Stop making that freaky eye gleam. Also, stop looking like you're about to start laughing. But mostly, stop the freaky eye gleam.

He . . . . . . has often argued conservative positions before the court -- but they can be attributed to clients, not necessarily to him.

That includes a brief he wrote for President George H.W. Bush's administration in a 1991 abortion case, in which he observed that "we continue to believe that Roe v. Wade was wrongly decided and should be overruled."

Fuel for the fire my @$$. You left out the first paragraph. The Washington Post article describes Roberts as a fairly reasonable conservative: "a Washington lawyer, a conservative, not an ideologue," said Stuart H. Newberger, a lawyer and self-described liberal Democrat who has argued cases against Roberts."

If this is indeed the case, Bush should earn himself some reasonableness and fairness points from his detractors.

Heh. Trust me, if liberals had any sense they'd prefer a Scalia or a Thomas over a Rhenquist any day. Those guys leave a clear path, usually a legislative one, to overcome their decisions and even their anticipated decisions. On almost every issue that matters to the left, all you have to do is win the day with the legislature and you'll win the day with the Court. Rhenquist just (IMO) picks his outsome and shoehorns his judicial philosophy to fit it. A Brennan of the right and very difficult to overturn.

I'm just damned disappointed in the President tonight. If he doesn't nominate Janice Rogers Brown for Rhenquist's spot when the time comes I'll consider his SCOTUS record to be a failure.

There are other folks who would make great nominees to the SCOTUS, and not just Janice Rogers Brown. (Who came from out our way, IIRC.) My first concern, though, is that we stop people from legislating from the bench. That crap needs to stop, and stop now.

Further, there needs to be, ASAP, an overturn of the idiotic Kelo decision. Who the f*** thought THAT was a good idea?

My sincere apologies. I was being provocative in response to the thread title and I had not really considered the first paragraph.

That was for the presidents benefit to make shure he didnt forget the guys name. He likely never heard of the guy until Chaney and Rove revealed his pick to him this morning.

It's pretty amazing the kinds of people who accuse the President of being the stupid one. The kinds of people who don't know that Roberts has been associated with the Bush family for years and that the President's father nominated him, unsuccessfully, to the DC Court of Appeals way back when and that the President himself got Roberts the gig (after a long delay in the Senate) just a few years ago, for example.

Hee-hee!

What, the kinds of people who've been paying attention all these years?

C'mon, lighten up. The Cheney/Rove gag is admittedly an oldie, but it still works.

As for the nominee, I look forward to an informative and, by nature of the beast, entertaining confirmation process. May Mr. Roberts be well.

I'll admit that it was pretty funny on election night here in NYC, where 99 44/100% of the people had a look on their face of, "I can't believe we misunderestimated him AGAIN." After that the joke kind of aged.
