He's just trying to pull the old "Commit-a-crime-to-get-the-death-penalty-so-the-bleeding-heart-soft-on-criminal-liberals-will-prevent-him-from-being-put-to-death" approach of keeping himself alive.

The fact that it is Tom Delay just makes it more delicious.
