Thing is, Biden could with literally a single signature put absolutely everyone Trump is upset with out of the legal reach of Trump AG : just pardon them for all and everything remotely connected to Trump.
And while he's at it, pardon everyone or the crime of being undocumented in the country.

After that he can pardon Hunter.

it would literally save millions of dollars in legal costs for Smith and the others, as they would force the DOJ to go via the Supreme Court before they get to do anything. And if the SC overturns the Pardon Power, that would make Trump and his cronies vulnerable to what comes after 2028.

And it would make prosecuting undocumented migrants orders of magnitude more complicated and expensive, which in turn would reduce the number of people deported by orders of magnitude.

What you might have wanted to say is that Democrats will "trust in the system", i.e. Trump handpicked judges, as not to appear to be as blatant as Republicans.
But staying on that High Horse will cost people their freedom and lives.

Nope. Trumpy's DoJ will be given all the power they need under presidential imprimatur to do whatever Trumpy tells them to do, bugger what Biden may or may not do now. All Trumpy would need to do is make an order that all Biden's pardons are null, void and rescinded. Not to mention Obama's. And the SCOTUS has already ruled Trumpy's powers are unassailably valid and legal, whatever he does.

Did I say anything even remotely like that? Or even about the Democrats or Biden at all? Let me check... Nope, I didn't. Not a word about the Democrats or Biden at all. So if you want to invent imaginary scenarios for other people to act out, just leave us out of it, please.
 
Biden pardoning people will only make all of what those people did look illegal. It's basically saying, "you are guilty of crime for doing what I asked you to do". His cultists will always believe that anyone going after Trump was corrupt, but some "swing" voters may be convinced by a pardon as well.

Individuals must know that they are not going to be left alone having to fight Trump's henchmen at the DOJ.

Understood.

But a better way would be to simply mire and strangle those henchmen in the DoJ. Whatever purges they order, whatever the programs of oppression, wrap them in red tape, smother them in inquiries, divert their funding from suppression programs to suddenly much more urgent purposes, reassign staff away leaving only one or two to do the work of dozens, delay things with unseen legal problems and trip-hazards, etc. Any public servants worth their salary knows how to efficiently stop stuff happening rather than make stuff happen, while pretending to be studiously at work. To bollox up and quicksand the system and make it grind to a halt. That would leave the the one or two Trumpy gruppenfuhrers all on their own to implement their pogroms but with no money, people or resources. That would be sad. ;)

There were 13 at one point. Now there are fewer. How did that happen? Natural attrition? Or can a president reduce the number of justices? Does appointing power include the power to appoint fewer justices? Selectively?

If I'm recalling high school civics class correctly, what happened was Sauron took back some of the justices and the others were consumed by dragons.

I believe that article 3 of the US constitution has been interpreted to give Congress the power to determine the size of the Supreme Court.
 
Penn Jillette joked on a recent podcast that he was going to ask King Charles for asylum. For four years, anyway. Penn had a lot of stories about Trump (he called him "Donny Jingles" -- I don't know why) before he got elected the first time, but I didn't hear much about him on the show after that. He had been on Celebrity Apprentice so probably has a lot more stories.

That kind of misuse of the pardon power is something we would expect from Trump, not Biden.
 
My thoughts exactly. I read an opinion piece that Trump will not be able to tame the bureaucracy for this very reason. On top of that, Trump is appointing sycophants who do not have the skills to manage let alone influence change on large bureaucratic institutions.

It's just like his first term, when he would say "Do (thing he wanted), now!", and would then be surprised to discover that there was no process in place to actually do it. He thought it would be like his companies, where he would just give an order and people would find a way to do it because he said so.
