That is certainly disputed, but the "legality" of Israel's claim to lands beyond the 1949 Rhodes Armistice Lines has not been adjudicated properly. Some jurists have expressed their opinions about that.
Others have said the complete opposite.

I would be fascinated if you could show me one single map of historic Palestine or Israel or Canaan that includes the whole of the Negev or even the Sinai. I have seen many many maps, and NONE of them go much farther south then Gaza City.
