I think the point is that he has actual corroborative evidence and witnesses, while the person leveling the charges does not know where or when it took place.

Should be obvious, one would think

A signed statement from someone who is refusing to testify about what happened (but whose girlfriend is willing to testify what he told her about the incident).
 
Even if he's telling the truth, this sniffling, weepy, self-pitying display isn't what we expect from a Supreme Court justice. We're learning more about this guy than he thinks.

We expect them to be thoughtful, deliberative and reflective, and to recognize that their responsibilities to us all are greater than their ambitions for themselves. If you're not watching this guy, tune in.

If a woman testified at a Senate hearing in the manner that Kav is displaying, she would be roundly criticized as emotional, overwrought, self-righteous, self-centered, unreasonable and worse. Not very judge-like. A calm statement of the facts as he sees them would be more persuasive.
 
Clear cut cases of Constitutional law usually don't make it to the Supreme Court. It's a court of final appeal for all the edge cases and gray areas that lower courts are unable to resolve. The goal isn't to get agreement. The goal is to formalize disagreement in a way that both represents the best effort to resolve the disagreement, and guarantees a decision regardless. E.g., by putting the matter to a vote by an odd number of panelists.
Good point but it makes me wonder why the GOP was fine with an even number of justices for a year and a half?

The thing about a false dilemma is that reasonable people actually aren't forced to choose between the two false choices.

I expect them not to take their case to Fox News, the only media outlet Trump doesn't call "fake news."

This still rubs me the wrong way and I'm not exactly sure why, but it is such naked partisanship. "Naked" might not be the best choice of words.

"Sober as a judge" will never have the same meaning again.

Interesting speculation, but I was interested in hearing what we're supposed to be learning about Kavanaugh.

No doubt about it, Kavanaugh will be confirmed!

Or conclude that he (probably) drank at parties when he was in HS and college and took advantage of co-ed's. I'm not 100% sure he's guilty. But, a supreme court justice should be pretty much above reproach. This isn't a criminal case.
 
The testimony is just a stage show The Republicans have already decided they are going to believe Kavanaugh, hell we already know that even tape of someone basically admitting to sexual assault won't persuade them someone is unfit for high office...
