Because they aren't yet included in one of the groups where it would be illegal to base termination only on belonging to that group.But they are. It's against many company policies to date subordinates, for example. And most states are at-will employment states, so a person can be fired for any reason at any time unless it is specifically illegal. I can fire a worker who happens to be homosexual tomorrow for absolutely no reason and face no legal consequences.
It was legal to fire someone for their race or religion until the 60s, and for being disabled until 1990.

It takes a gradual shift in position, which is why this admin ruling is so significant. Sexual orientation is a group with a history of being discriminated against in law and in fact for no other reason than belonging to that group, and IMO, that should change.
