Is Prop 69 Constitutional?

I think that happened, more or less, in CA.

Proposition 187 restricted benefits to illegal aliens. I believe that Gray Davis maneuvered some how to prevent defense of it and it was declared unconstitutional. My memory may not be exact on this though.
 
Don't think real-world police and FBI won't try to abuse the system, "slippery slope-wise". Two real-world examples:

1. Gov't. swears new Patriot Act only intended for terrorism, then immediately proceeds to redefine drug running as terrorism using Rube Goldbergian arguments that would make an "Interstate Commerce Clause" fan proud. (Note to Interstate Commerce Clause fans: sucks when the shoe is on the other foot, doesn't it?)

2. Some town had some rape or murder "by a black man". Police ask for all black men to come forward and voluntarily give DNA for testing. Police promises to use it only for this purpose then destroy it. Police later on decides it's gonna keep it and use it on future cases anyway, causing a scandal.
