How does youtube disable videos due to copyright claims?

I've been trying to upload a video to youtube many times about the Tesla VS Edison debate. Now I'm using a 50 second clip from Family Guy about Edison. First of all, I tried to upload it by itself as the flv that I downloaded online from various places. This was rejected when it was uploaded "This video is no longer available due to a copyright claim by FOX." which I thought fair enough... so I tried to convert the video to another format... the same thing happened.

So I then imported the 50 second clip into movie maker after converting it to wmv format. I added some titles at the beggining, and some other clips from a video about Tesla that I have the copyright rights from the maker to use, some quotes from Einstein about Business and Science and what makes a good scientist, etc. In total its about 2 minutes long. Even after publishing this the video STILL gets rejected after the youtube "processing" process.

So how on earth does youtube check all the millions of clips that are uploaded to youtube every day? Because I'm quite confused as to how they could possibly know that the short 50 second family guy clip is in the middle of a video I made and converted myself. Unless every video gets viewed by a person and checked... which I find extremely unlikely due to the huge amount of clips uploaded to yt. Usually all clips I upload take about 1-2 minutes to get past the "uploading processing" stage, and I've never had any issues with any other clips.

I thought that there was a law that any clip under 1 minute was allowed to be used irresective of the copyright anyway...

this is the error message I get (I dont know if you can view it or only me) http://www.youtube.com/copynotice?video_id=6wfv2MHjMk8

Your video, Tesla VS Edison , may include content that is owned or licensed by these content owners:

* Content owner: FOX Type: Audiovisual content

As a result, your video has been blocked worldwide.
What should I do?

Please refrain from uploading someone else's copyrighted content to YouTube without authorisation. Note that simply purchasing the CD or DVD does not give you this authorisation.
What can I do about my video's status?

Please note that the video's status can change if the policies chosen by the content owners change. You may want to check back periodically to see if you have new options available to you.

Under certain circumstances, you may dispute this copyright claim. These are:

* if the content is mistakenly identified and is actually completely your original creation;
* if you believe that your use does not infringe copyright (e.g. it is fair use under US law);
* if you are actually licensed by the owner to use this content.

I need more information. I want to learn more about the dispute process.

Please take a few minutes to visit our Help Centre section on Policy and Copyright Guidelines, where you can learn more about copyright law and our Content Identification Service.

It searches for matches in audio tracks and video tracks of copy written clips.

So I've gotta add some reverb or some audio effect to the audio / change the bit rate / stretch the tempo, etc, and screen/video capture the video in a different visual format to bypass it? Hmm. That should be easy. I've got cubase 4 for the audio edditing, and wmcap for the video :)

Thanks.

The automated detection system doesn't acknowledge Fair Use, as far as I know. If you believe you have a legitimate case for Fair Use, then you need to contact YouTube with your claim.

On a side note, just a bit of a heads-up.

I got 3 or 4 videos removed from public view on YouTube for copyright violation (I won't dispute that, since the videos are copyrighted indeed, but I thought they were playing deaf ears on very short segments - two of them were < 1 min long Formula 1 clips).

The thing is that right after the last email notification of video removal, my account was permanently disabled.

Looks like they run a program that automatically disable accounts after a certain number of copyright warnings/removals.

Just FYI.

That would suck. And I'm sure that my ~4000 subscribers would be pretty pissed off too. Thanks for the warning.

I have deleted videos that have had copright claims in the past... so I hope youtube have noticed this and it will count in my favour.

I know exactly how. But, I would never counsel to commit an offence.

aww come on'!

I've sorted the audio bit easily being an audio technician, but the visual bit is still preventing me for uploading.

Anyone else? :)

Nope.

When one of your videos gets disabled due to copyright claims, this counts as a strike on your record. Buried way down in your profile settings is someplace where you can check your copyright standing and community standing. After a single claim from Warner Bros. – even though the video had a fair use notice and I later deleted it – I’m “not in good standing”.

I’m seriously thinking of creating a new account, because quite frankly this is a bull way of doing business.
