The Human Rights Act 1998WP is the incorporation into UK Law of the European Convention on Human RightsWP, which was first drafted in the early fifties.

The HRA was designed to allow British citizens to bring cases which would fall within the scope of the Convention in UK courts rather than have the additional cost in financial terms and time of having to have them dealt with the European Court of Human Rights.

It's often featured in the press, usually when long established practices have been challenged . One that springs to mind is the prison regime of slopping out* where inmates have claimed for compensation. A couple of articles related to this:

Dave, of course, previously said burglars left their human rights at the front door (but what if they enter through the window? -Ed.):

The Angry Mob blog has some useful commentary on this announcement:

Won't anyone think of the fish!!

Dave and his chums proudly bringing back the 19th century.

News story this morning about how a minimum wage constrains jobs and how it should be abolished according to certain tory sources. IMHO nonsense, a cheapskate employer will merely drop his wages, employ the same number of people and pocket more £££££s

If the Human Rights Act was repealed, would people still be able to go to Strasbourg to make the government comply with the ECHR?

Yes - it would just take longer and cost more both for the appellant and the government.

This is a rod they've made for their own back by making out that these rights are somehow "new" see the crap the t'other day in which Cameron lied about the prisoner transportation story that the Daily Mail made up.

If I was more CT minded I would say Cameron and Clegg have come up with this wheeze. Clegg can tell his lot "look we are stopping those callous tories from repealing this act" and Cameron can tell his lot "we would repeal it but those wishy-washy libs won't let us".

As Clegg reminded folks these are in fact pretty much a British drafted set of rights that was strongly pushed by the likes of Churchill 60 years ago.

Well Clegg has assured us that it will stay and he will not allow a change.

Therefore we can be quite confident he will support Cameron's attempt to remove it, probably citing the changes in Greece as a reason.

...snip...

I have to admit that I was relieved to hear him say that, if there is one politician that you can be sure will stick to his principles and his promises it is the C man...... ;)

Is that a swear filter evasion?

'What people don't understand is when I said the Human Rights Act was 'Here.to.stay' I obviously meant it was here to stay in the minds and hearts of every Liberal, not on the statute books.'

I don't know what you mean. I leave it up to the individual to fill in whatever name they wish to use for the Deputy Prime Minister. ;)

How about glove puppet? Ventriloquists dummy? Mrs David Cameron? Pledge breaker? Sold my soul for a hint of power? Mr unpopular?

Obviously there are many other names, but I'm trying to be polite.

It shouldn't really surprise anyone that the CONDEMs are trying to repeal the human rights act. Even more than previous governments they are a bunch of posh, privately educated twonks with the same level of respect for ordinary people as I have for slugs.

There are aspects to the Human Rights Act that are unpalatable, such as the Nigerian rapist that fought deportation so long that he has "formed a life" in Briton.

http://www.telegraph.co.uk/news/uknews/immigration/8777138/Family-life-ruling-means-Nigerian-rapist-can-stay.html

Or Siraj Ali, the Eritrean who was convicted of aiding the 21/7 bomb plotters. He's fighting deportation to a country that Britan sends people back to every year.

I do find it incomprehensible that those who seek to damage or destroy the country they live in are allowed to stay there.

That's the problem with having human rights - they apply to everyone. All of the above appeals could have happened before UK courts could consider the human rights, all that would have happened is that they would have taken even longer to get resolved and cost a lot more.

What folks seem to forget is that all the legislation did was allow UK courts to consider human rights rather than such cases having to go to the European Court of Human Rights to be decided.

And of course the likes of the Daily Mail like to create confusion and anger by making it seem as if the European Court of Human Rights is the EU telling us what to do.

ETA: Reading a little bit more about the case of Akinshipe - it appears that it was a screw-up by the Home Office as they even though he had been convicted of a serious crime indefinite leave to remain. It isn't for the courts to sort out such mistakes!

Whilst it is fun to mock the Mail and it's overcurrents of racism, reducing the story to it's component parts it is still "foreign citizen commits a serious crime in a country other than his birth and is allowed leave to stay". I see a lot wrong with that.

But it's not as black-and-white as that. He was a minor when he committed the crime, and in the 9 years since then he's had an exemplary record in education and employment. Aren't prisons supposed to be for rehabilitation? Besides, originally he was allowed to stay in this country because a UK tribunal blocked the deportation order, nothing to do with the EU. They blocked it because he was still a minor, and his mother had been given leave to stay in the UK because she wasn't any sort of a criminal.

Edit: Mind you on the whole I agree with you when you say "foreign citizen commits a serious crime in a country other than his birth and is allowed leave to stay" is wrong. Just that reducing the story to just that removes a lot of the shades of grey that shouldn't, in my opinion, be ignored.

Ta. Every case should be judged on its merits but there is a feeling, not isolated to the UK, that if you is a for'ner and you commit a serious crime, you is out. Innit?

Although emotive, as well as championed by some proper bastards, it's not that idiotic an idea, especially when some of those for'ners have been convicted of terrorist offences. At what point does an individuals rights override those of society (and its safety) as a whole (and BOOM goes the thread!)? :D

How long have you been Clegg's speech writer?

I'm currently working on a line for when his wife catches him in bed with another woman:

'What you don't understand is that when I said 'I will love you and honor you' that was before circumstances changed and I got the raging horn for this Tory minister'

I'd rather have Clegg's missus as Deputy PM. She'd savage Cameron.
