In a brief glance at the web and the history of executive privilege, it would appear that the president's claim of executive privilege is based upon two principles. One that national security is involved or that the House of Representatives does not have oversight of diplomacy with foreign nations.
Both Clinton and Nixon had court rulings (I believe from SCotUS) that said they did not have a basis for invoking executive privilege because there was not an issue of national security involved.
So in the recent GWB invoking of executive privilege we have two possibilities to begin with, that:
a. There is an issue of national security
b. That there is no oversight in the power of congress in this case
We have the president allegedly invoking executive privilege in the case of Alberto Gonzales and the attorney firings and a number of other situations.
So what support and evidence is there that the president has met the past standard or presented new standards by which to invoke executive privilege.
