Why are you so desperate to vilify this guy? None of this character assassination nonsense is relevant to the violation of his due process rights and the government's indifference to its admitted error.

I think this is an important battle to fight against Tramp's push to Fascism and I feel like this guy is not the right person to be fighting for. I fear it may turn out that he is in fact a gang member or was one. Or has associated with them in the USA. If this blows up in our faces we may not get another opportunity, and the whole Boy Who Cried Wolf thing.

Don't you worry, Trump will provide plenty of opportunities. They've already framed this guy as a violent criminal, not worthy of due process, He'll never see the light of day in the U.S. But sooner or later, they're gonna ◊◊◊◊ up.

The government has already admitted its error in renditioning Abrego Garcia, an error that would have been discovered had he been afforded his guaranteed due process rights. The Trump administration has deployed every distracting bit of falsehood and hearsay trying to say he's a terrorist, a gang member, a wife-beater—none of it with any credible evidence. It's prejudicial garbage intended to wreck his character in true Trumpian fashion, and you're not only gobbling it up but you're promoting it.

I as a citizen have many more avenues for Due Process than someone here on a tourist/work/travel visa, or someone who has no Visa at all.

But yes, ALL persons in the USA, regardless of their legal circumstances, have some level of Due Process.

I get your point but think it is wrong, even if your pessimism about the attitude of others is accurate. It's not crying wolf whatever some say. It's pre-judgment, deciding that because we presume guilt, we can skip the messy business of due process.

When we dole out rights based on an estimation of who deserves them, they're not rights any more. They're privileges, and privileges are always conditional.
 
There are two giant issues in then Garcia case: Abrogation of due process, and the breakdown of checks and balances. If you're looking for a constitutional crisis, here we are.

Every time I think Trump has said something that can't possibly be topped for idiocy, he proves me wrong. Even taking his "Biden flew half a million illegals into America" premise as a factual basis for action, what's his plan? Just grab up the first 530,000 people who look right for the role and assume their membership in the class he wants deported?

I just do not get how anyone who can be a US President can be so wholly ignorant of the very basics in how law works.

Yes, that's how due process works, in general. Classes can be certified for beneficial purposes such as for the assessment of injury and the awarding of damages. Where you intend to deprive someone of life, liberty, or property, you must make an individual determination.

That did not happen. The 327,000 migrants granted parole by the Biden administration arrived over the space of a year, not all in one day. CBP asserts that these individuals were individually screened for suitability for the parole program.

Each person gets his day in court. That's how justice works. As usual Pres. Trump can only imagine justice as him getting what he wants. Again, the Trump administration is proposing that due process somehow does not apply if the government prejudicially predetermines a likely or desired disposition.

In this case the identities and last known locations of the parolees have always been known. There's a case database including dates and times to appear, assigned judges, case workers, and attorneys of record. These were not people who snuck across the Rio Grande under cover of darkness. These were people who sought and received permission from the Biden administration to enter the country while their claims were being processed.

The Trump administration used this database to categorically revoke the parole of all the entrants, even though they are ostensibly satisfying the terms of their parole and in some cases even have valid visas. Because the administration is so inept, it actually also sent the "get out of the country" email to some attorneys of record in the case.

No, the judiciary is not going to allow such ineptitude to stand. This ranks right up there with Elon Musk offering an employment buyout to federal judges with life tenure.

Khalil is the right person to be fighting for.
Every single person who has had their rights denied is the right person to be fighting for.

Even if one of these guys turned out to be the grand wizard of the Ku Klux ◊◊◊◊◊◊◊ Klan, they should still be given the opportunity to face their accuser and contest the accusation. If you don't believe in that, then you don't really believe in due process, you believe in special privileges for a select few who were born into the upper classes.

Garcia's dead. From what I understand, his asylum stipulated that he was never to be returned to El Salvador under any circumstances due to a credible threat of death. He was sent to a death camp with piles of bodies visible in satellite imagery. He's dead. By the time SCOTUS ruled 9-0 not to allow such ineptitude to stand, he was already dead. You can maybe habeas his corpus if you ask nicely enough.

So what's the judiciary going to do? Not a solitary goddamn thing. They're going to say "well, at least we won't let this happen to American citizens!" while overlooking how it's already happening to American citizens.
