I can guarantee it will never be enforced "to the letter". There will be thousands of exceptions on an individual basis. I lived and worked illegally in Australia some years ago. About every two years an amnesty was offered to anyone who "turned himself in". I am sure the US will offer some similar deal.

The Smith Act appears to be one of those lovely laws that noone really cares about, because it's never been enforced, until it suddenly is.

It's been like that for a long time, a lot of countries do it. I'd be scrubbing those .mp3s that you downloaded from Napster in 2001 before crossing any border if I were you. Just take cheap burner devices you can afford to lose and store all your "stuff" in the cloud.

And no, I don't think the WH Press Secretary referring to violation of this law colloquially as "a crime" can reasonably be interpreted as the President inventing a new crime beyond his executive authority. If you read the EO she's referring to, nowhere does it say that this violation is a crime.

If the law isn't clear to you, and you fear you might be found in violation of it, you should probably consult an immigration lawyer.

Besides, other parts of the law define what does and does not count as an alien, in exhaustive detail. I bet your confusion has already been addressed in those section.

No, none of this establishes being an unregistered alien as a crime. It is not a crime, punishable by fine or prison, to be in the USA illegally. Nor is their any criminal statute stating a criminal penalty for doing such. The only possible penalty, is deportation. Which is simply an administrative procedure.

To put it simply, if you are deported from the USA because you are here on vacation but didn't register, your criminal history is clean.

Beyond this, a crime is something you stand trial for, before a judge & jury. You cannot be put on trial before a judge in jury for being in the USA without registration. Cuz its not a actual crime.

Who will provide this form? And will I leave it with one of the bellboys of one of the many hotels where I am staying? Or in the room trashcan for the cleaning staff to gather?

I know, those I-94s can be tedious and don't get me started on the massive inconvenience of carrying around an extra piece of paper in your wallet. At least these G-325Rs are free. Freakin' Australia charged me $20 for an ETA.

Every 30 days i need to re-register, whatever that means? How do they expect to find us if we miss a deadline? Divination?

It's stupid. If you want to track people, travellers already register at hotels using passports. Use that data, for Odin's sake.
