It is not up to the defense to explain the phones
In one sense it is surprising that Nencini even brings up the phones. It just brings to mind how ridiculous the notion of a late TOD really is. IIRC Andrea Vogt referred to the Nencini court as "serious."
Great post, but I am still confused about one thing. Why should the defense have to say anything about the phones at all? Their story is that they were not at the apartment that night. Shouldn' that be the end of it? I have a problem with the notion of Nencini's drawing any inference based on what the defense did or did not do, besides the fact that he fails to consider the things that you do (that turning them off would have been better; that Guede had as much or more reason to take them, assuming either the lone wolf or the Guede+someone else scenarios are true). In other words, isn't Nencini's logic wrong several times over? Maybe that is what Dalla Vedova is saying.Any PGPs want to argue this one out or are we all agreed that Nencini is a moron whose ruling must be quashed in the interests of justice?

it would be an ideal opportunity to respond to the unfortunate 'alibi' confusion that arose after RS's public statement.
