Continuation Part 18: Amanda Knox/Raffaele Sollecito

Did you notice in the report whether the callunia verdict was mentioned as being unshakeable even in the event of an adverse ECHR decision?

I'm also wondering if Machiavelli met Mignini and can tell us how he's doing now that he's the laughing stock of the Italian press.

It sucks to be Mignini today.

I don't know. If the report really does say Amanda was present in the house that night then it provided no real closure beyond procedural. The case would exist much as it did in 2013 post Chieffi, Amanda and Raffaele are free while the official word at Italy's highest level is a bunch of nonsense. And that would be the final state of the case forever.

Uncertainty is an irrelevant element as for the crime of calunnia. Only malice is relevant, not certainty. Calunnia is the malicious placing of false evidence against an innocent, no matter if such evidence is certain or solid. An expression of doubt has the same potential of being a crime of calunnia as an expression of certainty, as long as it is a malicious.

So a statement made in a state of collapse and exhaustion, a false vision implanted by police, that too in your mind is "malicious" and criminal?

Anyway, welcome back.

Can you fill us in on the court proceedings today? Did Ficarra testify yet?

I do wonder how much of the outcome was a consequence of dealing over the verdict. In common law jurisdictions you can get dissenting opinions and even judges agreeing on the verdict may differ in reasoning, and may produce additional comments to the definitive ruling. I wonder if the comment on the callunia was the result of some sort of internal deal.

I do think that ECHR will take a dim view of the PM Mignini pretending to be a notary. They will take an even dimmer view of the continued denial of counsel during which she produced her written comments.

Someone above made a comment about translation. I think this was a good point. Anyone reading in English what Knox wrote gets an overwhelming feeling of uncertainty. i do wonder if the Italian version fails to convey that sense and instead conveys more certainty. It would be interesting to back translate the Italian version. I have only seen the original English not the Italian translation given to the courts.

I agree with that! The original translation of Amanda's handwritten 2007 statements that the court may have recently been basing their opinion upon, those translations (part of the court record) likely were done back in 2007 when the dirty cops (and Mignini) were still openly trying to hang Amanda, thus they could very well be very skewed translations!

If only the Italian justice system would pay more attention to the ISF's <cough> Gooder Than Italian Justice Brain Trust (GTIJBT™). Don't those Italians realize our not having gone to nor investigated the crime scene nor having interviewed any of the pertinent witnesses is actually an advantage for the prosecution? If only.

Hey maybe some of you can get some robes and hold a mock court and convict her. Say in downtown Saginaw or Little Rock or something. Call Amanda Knox up, invite her to town, kidnap her when she arrives and then hold court so as to make her pay for her sins against humanity. Because ******* justice!

Don't give these nut jobs any ideas.

Right now, Mignini and his gang of thugs looks petty. I'd love to see how the Italian media covers both the motivation and the new trial in the coming months.

The trouble is that they seem to, in very real ways, run the asylum.

I'm afraid the laughing stock are Bruno & Marasca. Their report wrote seems written by Mad Hatter & March Hare.

Anyway the report never mentions the prosecution. It looks like their scapegoats are the police detectives.

Oh well, you know what Vinny Gambini says, win some lose some.

Her hand written memoir "implanted" by someone else?
I'm sorry.

Ficarra testified on Sep. 3.

Well, you didn't actually deal with the issue of the press.

Perhaps it's my version of Google Translate which is at fault. The press is reporting on blunders, errors and incompetence in the investigation. One piece I read (true, through Google Translate) talked about the utter incompetence of not establishing time of death - something Mr. Mignini himself was personally responsible for.

So.... can you point to ONE Italian language news service which is saying that Marasca/Bruno got it wrong. Just one. The ones I am seeing seem to make it hard for Mr. Mignini to go out without a bag on his head.

Ficarra testified on Sep. 3.

Are you referring to the statement prepared for her, written in an Italian she could barely speak? Or the one in which she attested to doubting the "verity" of what she had attributed coming out of her interrogation?

No matter. It's more than apparent you'll continue spouting this irrelevant tedium til the Crack of Doom.

Meanwhile, the conviction for calumnia means nothing outside the borders of Italy, and the fetid consciousnesses of certain nut job habitués of a couple online hate sites.

Will these transcripts be available to the public? It would be interesting to hear everyone's accounts of the interrogation. I'm also curious about defense arguments today.

Do you think the trial of Rudy Guede will finally be unsealed and available to the public? Why was that trial ever sealed?

Amanda's drug empire was so successful she became a capo di tutti capi, masterminding her operation from her jail cell in Capanne. All the prison guards ended up in her pocket. Now, while she lives an outwardly Bohemian life on her olive oil ranch in Washington, a blood-soaked battle is raging through the Italian courts between her devoted followers and the demented Mignini and his dwindling crew of brigands, ne-er do wells, judges on the payroll, ice cream vendors ... (Continued on page 94)

Vixen - the above is a segment of the plot of the book you advised me to write. Can you run your eye over it and give me some feedback?

To me, this was a just end to an unbelievable crime marred by sloppy police work from the beginning. They were both innocent and should have gone back to their respective homes right after they provided statements and DNA samples. :boggled:

Is Mach looking for one? Or did he run away? Place your bets.

I beg to differ. The crime was not unbelievable. It was actually mundane. The police solved the crime rather quickly. What was unbelievable was how they all screwed it up.

I think the motivation confirmed my position and that was the biggest mistake was the press conference. It put the police and prosecutors in the position of ignoring the salient evidence to save face in view of the International spotlight.

But the trial of Rudy Guede is not sealed. Its papers have been available to the public for five years now. We also have some hearings on themurderofmeredithkercher.com site, including Stefanoni's hearing.

The type of crime that Rudy Guede committed is extremely rare so I would not call it "mundane" however I also would not call it "unknown" such as the story the prosecution spun.

Just to bump this up, because apparently Machiavelli missed it.

I wonder if Machiavelli's latest theory will be how much control the Masons exercise over the Italian press?

The prosecution had nothing to do with the press conference.

This is a point of context that seems something still to hard for the pro-Knoxes to understand. The Questura is government, the Prosecution (Procura) is Judiciary. Two independent powers.

Moreover, the police actually said very little in the press conference (not what the pro-Knoxes claim), even declared their evidence was still volatile and changing; and in fact few days later they didn't have any problem changing their theories publicly.
The press conference was nothing but political routine by a political power who needed to calm media attention and population fears in a specific moment, since in that moment it was startling their witnesses and didn't allow them to work properly.
