Coal executive sues John Oliver for making him sad

Here it is.

Mods: this is officially uploaded by the show to their channel.

I never got to see the video posted in this thread as it had been taken down, however, in another video I saw, Oliver described him as a "geriatric Dr. Evil"

That got a good laugh from the audience

Must be a regional thing then

I so want this to actually get into court. But I kind of think a judge might throw it out early on.

If Oliver's team wants it to get into court can it even though it has zero merit?

If Murray moves forward with a suit, Oliver can refrain from filing a motion to dismiss, then it would go forward. I don't see the point, though.

(not a lawyer)

I do.

If Oliver was absolutely 100% certain of his ground, he would have an opportunity to make a complete public asshat out of Murray. For a political commentator/satirist, that would be pure gold.

IIRC, they are claiming he deliberately ignored evidence of an earthquake to bias the story.

Well, that ought to tell Oliver's lawyers that they have no intention of going to court. Murray's people can keep claiming it was an earthquake in press releases, but I doubt they want to have to defend that proposition in court.

IANAG, but all evidence seems to point to the "earthquake" actually being the seismic readings of the mine collapsing, and not an actual quake. The University of Utah told them this the morning after the collapse and has reconfirmed it twice.

Isn't this the clown who tried to buy off the miners by telling them not to worry, they'd all have jobs waiting.... at the closing down of the rescue efforts? (Well... except for the dead guys. The miners' bodies are entombed in the mine - never recovered.)

That is just an insult though. You can insult people as much as you want and it does not rise to slander.

Is this the same clown who ordered employees to take time without pay and attend a Trump rally? I suspect it is.

In the USA, the working man is well protected from the abuses of his government but, it seems, his boss can practically own him.

Getting the case dismissed quickly might embolden victims and whistle-blowers to come forward, more than a full court procedure would.

I don't think that follows. A drawn-out court case where Murray and company get completely crushed would provide a lot more publicity for that purpose.

It depends on the impact to the defendant I think. SLAPP suits are frustrating precisely because they benefit even if they lose, since some judges refuse to reassign legal fees. If they cost Oliver $25M, but lose, it'd still be a signal to other journalists to pull punches.

Fair point, though we have here a defendant (HBO/Warner) that can easily afford to outspend a mining company and its CEO when it comes to legal fees. If (and I readily acknowledge that my opinion could be completely wrong) there's a point about speech-stifling lawsuits to be made with a full trial, better this one than one against a newspaper where readership and revenues are in free-fall.

This is what I'm hoping happens in the Maddox vs. Dick Masterson case. Two comedians going at it (actually more since there are many defendants) where one is the plaintiff in an obviously frivolous lawsuit.
see lolsuit.com for more.

Though ultimately I think it would be best for frivolous suits to be dismissed with prejudice and reimbursement.
