HONG KONG (Reuters) - A Chinese primary school teacher and a beautician have filed a suit against CNN in New York over remarks they say insulted the Chinese people and are seeking $1.3 billion in compensation -- $1 per person in China, a Hong Kong newspaper reported.

The case against the Atlanta-based cable channel, its parent company Turner Broadcasting and Jack Cafferty, the offending commentator, comes after 14 lawyers launched a similar suit in Beijing alleging that Cafferty's remarks earlier this month violated the dignity and reputation of the Chinese people.

I assume this is only news because it's happening, but can a lawyer please tell me this completely frivolous and will go no where.

Asked if China supported the action against CNN, Foreign Ministry spokeswoman Jiang Yu characterized it as "spontaneous activity by Chinese civilians".
I thought the Chinese weren't too keen on spontaneous activities after Tiananmen Square and Tibet.

This one has the potential to give America money to Chinese citizens ... an exceptionally remote possibility, mind you ...

Then again, it may just be some pre-Olympics harrassment. Y'know, a warm-up for the main event - banning CNN altogether.

Your thread title violates the dignity and reputation of the Chinese people. Expect a $1.3 billion lawsuit in the near future.

Yeah, if you're going to insult any nation stay safe and stick with San Marino, or Lichtenstein! I hear Gibraltar's not too litigous......

Tony, would you mind elaborating on the thread title--what is it about the folks suing that you find idiotic?

By the way, here's the quote from Cafferty:
Cafferty said the United States imported Chinese-made "junk with the lead paint on them and the poisoned pet food" and added: "They're basically the same bunch of goons and thugs they've been for the last 50 years".

This is pretty much the same as when someone in the U.S. tries to file a lawsuit to sue the President. I doubt very much that any of these people actually expect to get any money, or have their case taken seriously; it is simply a form of protest that gets their message out very effectively. They garner lots of attention and media coverage, making people aware of what this CNN reporter said (which was, by the way, very stupid).

The link is very light on specifics, but that is par for the course in US news. It doesn't say for example what the specific allegations in the complaint are, or what law or laws the action is being brought under.

That said, the suit apparently amounts to suing for insulting Chinese people. I am not aware of any statute that would allow a suit to be brought for insulting people, and even if such a statute existed it would almost surely be unconstitutional. So, this will probably be dismissed for "failure to state a claim", i.e. there is no legal remedy for the acts even assuming the acts are exactly as the plaintiff claims.

Looks like a publicity stunt to me.

ETA: I suppose it could theoretically be a defamation suit, but even that seems like a stretch

I think "The Painter" was right when he said "I think all wolfmans posts are screened by the Communist regime in China. If not that, than he must make China look good to cover his ass. After all, he does live there.". :D

That's fine...but exactly which of my points do you disagree with, or feel is wrong?

That Americans do exactly the same thing (such as launching lawsuits against the President)?

That the Chinese doing this don't really expect to win, but are doing it to garner publicity?

Or that it isn't an effective way of not only getting publicity, but of also putting significant pressure on CNN?

I'm not saying that it is a great idea...just demonstrating that it is, in fact, little different than what is done in many other countries, when a particular person or organization does something that others find objectionable.

And for the record...I have made plenty of posts that are critical of the Chinese gov't ;)

See what I mean? It was a joke Wolfman. I think it's really getting to you. It being the Chinese gubmint! :D

I apologize...my handlers have problems understanding Western humor (and please do note the winky smiley at the end of my last post) ;)

Won't it turn the American people against them? ;)

  1. Poisoned pet food
  2. Poisoned toothpaste
  3. Lead paint used on children's toys

None of these things turned America against China, but you think this will do it?? No it will not turn us against China.
