Arrested for being naked at home

I completely agree. Trespassing as well.

It just seems to me that the police are trying very hard to clear themselves of overreacting.

This reminds me of a couple of years ago i was at a party, at the start of the night we notice a woman in the building across from us sitting in a chair with a beer and a pack of smokes, watching us.

this goes on from about 3-4 in the afternoon to about 1 am. And i finally get angry and take a vote to moon the person. I present my ass to the laughter of all.

About 30 minutes later the cops show up, the lady complaining that i had indecently exposed myself. My rebuttal to the police was that from where she was she would have had to be purposely looking. The cops hassled us for a half hour, but eventually everything went allright.

Why did she make you angry?

Why did you need to take a vote?

Who were they really laughing at?

You might be lucky that the cops didn't tote you back to the office with them. From a strictly legal perspective the element of intent to expose yourself to the public is sufficient to tip the scale into indecent exposure. That would have been pretty clear in the situation you describe. My guess is that they didn't want to bother with the paperwork they would have ended up facing just to hassle some drunk kids with arrested social development.

Mooning someone doesn't offend the public sensibilities as much as it used to. Now it tends to be viewed more with pity and sadness, as evidence of bad parentage and poor judgment, but the statutes are still there.

You must be a blast to hang out with.

1. I was angry because our privacy was being invaded, being stared at is not a pasttime of mine.

2. We took a vote because i wanted to make sure the owner of the apartment approved.

3. Lighten up bro.

If someone stars into an apartment, they deserve whatever they see.

Many people manage to have a good time even after they grow up. Maybe you'll learn how, someday.

If you've been following this thread tell me what you think the chances are that the dude in question would have been acquitted if his defense had been that he got angry at the woman and exposed himself because "she deserved it"?
