ACORN filmmaker arrested

There's a guest post at Patterico from a federal prosecutor discussing what the Affidavit means and how things will proceed from here.

It's a pretty good read.

Based on this, if O'Keefe & co were not found in possesion of wire tapping equipment etc. Then it's a minor offence?

No. It is a felony to interfere in any way with a phone system in a federal facility. Ten years and $100K.

There is no way that the pimp can say he was not going to do anything illegal. He announced before hand that his larest caper would be spectacular comppared to his prior crimes. He and his associates acted with malice toward Senator Landrieu.

He comitted a felony as far as I can see. His only defense would be that he was not there for the purpose of entering the phone closet or in support of the dirt bags who would have entered it.

Fat chance of that.

Notice that SoT is calling me a twoofer?

Truthers come in several "flavours". 9/11 truthers, Obama birth truthers (commonly shortened to "birthers"), Trig Palin truthers (once a large portion of the liberal blogosphere, now consists almost solely of Andrew Sullivan) and now, Green Polo Shirt truthers.

If you're going to act like a truther, expect to be called on it.... truther.

Yup. It's really an over-the-top exaggeration, and out of good faith, he really should apologize to the Twoofers ASAP.

Because truthers have better aim? :D

The logistics of on-line wagers are inconvenient.

I bet.

Now what defense can you possibly think of that the maggots can offer? It is clear that they committed a crime and just getting a look at the telephone circuits is not going to be anything major, and the pimp did promise something major, so it is clear that they had more than criminal tresspass in mind.

I am not the one claiming to be certain about not only what happened, but about the law applying to the situation; you are. Or at least, you *were*. And then money got mentioned, and your certainty became . . . inconvenient.

Why waste time reading what an actual prosecutor thinks about it, when we have a resident legal expert right here explaining what *must* be true?

No, I do not incite mob violence.

The most violent I get is wishing that the Shrub, Nosferatu, rummy, Gonzo and Yoo should endure what they claim is a valid means of interogating terrorism suspects. They boast of their crimes.

The people that the pimp wants to hurt have not committed any crimes, as far as a rational person can see.

Yet you still incite violence and are therefore a dungball.

There remains, however,no exculpatory evidence of any sort that will leave the pimp and his thug buddies eligible for less than ten years and a few hundred thousand clams in fines. They were caught dirty. The pimp announced that he was up to something big.

There just isn't any defense against that sort of thing. There are no exculpatory circumstances.

And his credibility as a witness is somewhat less than zero, given all the lies he has told over the last ten months.

Want to explain what possible exculpatory evidence the boy could offer? I don't see any. He was there with an enemy of Senator Landrieu after announcing that he was going to do something remarkable. I do not see how he can possibly claim he did not fully intend to diddle the phone system.
Funny how clear cut video evidence off the ACORN slimes assisting in prostitution and tax evasion got dismissed with fantasy defenses, yet there is no possible defense in this case and incarceration is pretty much a foregone conclusion with a trail just going through the motions of justice since the conviction is certain.

You don't get to do that. There are gaps in the videos that even I can detect. We also have the dirtbags lying about how many offices told them to pound sand. The fact that the pimp is a liar calls ALL of the video into question and renders it fruit of a poison tree. Who in their right mind thinks the pimp proved anything when so much of his evidence and his snivelling defense of his crimes against ACORN are total BS? Edited video offered as defense of one's own innocence and proof that another person is guilty is actually proof of one's own criminal conduct.

yet there is no possible defense in this case and incarceration is pretty much a foregone conclusion with a trail just going through the motions of justice since the conviction is certain.

I'll put it this way.

The pimp announced that he was going to do something major. He got caught doing something utterly illegal. He filmed himself doing something illegal.

He just made all of you who think he is actually persuing justice look pretty stupid.

And if there's nothing to prove that there was an intent to shut off the phone system or interfere with it. The FBI agent who wrote the affidavit says their plan was to shut off the phone system and tape the reactions of the senators staff. The government will have to prove that beyond a reasonable doubt. I don't know if there's evidence to support that claim or not yet.

h, I'm calling the anonymous "prosecutor" full of crap. He could be real, he could be fake (and, given the venue, that is high on the list of probabilities for me) or he could be one of the dirt bags that Diapers Vitter wants to keep on the job in Louisianna.

I have, thus, no reason to extend much respect to his crap.

Attempting to interfere with the phone system is a felony.

If you now tell me that a lying, malicious, crooked, worthless little pimp with an anti-American aggenda is just curious to see what the phone closet is like, I shall have to post a pack of laughing dogs to express my opinion of your opinion.

The pimp is dirty.

If they intended to do anything unauthorized to the phones, it is a felony.

So if I search the Spanaway, WA white pages for "Sergeant, Lefty" will I find you or are you just as anonymous, just without the claim of legal expertise?

I am not posing as an authority in defense of a piece of garbage pimp. The "prosecutor" can identify himself or take his liumps along with anybody else who defends the sorry pimp and his band of merry morons.

I have no use for some fool who claims that the pimp is not in hot water and facing probable felony charges just for attempting to diddle the phones when the law clearly states that it is a felony to attempt to interfere with them.

O'Keefe has issued a statement on his arrest:

The government has now confirmed what has always been clear: No one tried to wiretap or bug Senator Landrieu’s office. Nor did we try to cut or shut down her phone lines. Reports to this effect over the past 48 hours are inaccurate and false.

As an investigative journalist, my goal is to expose corruption and lack of concern for citizens by government and other institutions, as I did last year when our investigations revealed the massive corruption and fraud perpetrated by ACORN. For decades, investigative journalists have used a variety of tactics to try to dig out and reveal the truth.

I learned from a number of sources that many of Senator Landrieu’s constituents were having trouble getting through to her office to tell her that they didn’t want her taking millions of federal dollars in exchange for her vote on the healthcare bill. When asked about this, Senator Landrieu’s explanation was that, “Our lines have been jammed for weeks.” I decided to investigate why a representative of the people would be out of touch with her constituents for “weeks” because her phones were broken. In investigating this matter, we decided to visit Senator Landrieu’s district office – the people’s office – to ask the staff if their phones were working.

On reflection, I could have used a different approach to this investigation, particularly given the sensitivities that people understandably have about security in a federal building. The sole intent of our investigation was to determine whether or not Senator Landrieu was purposely trying to avoid constituents who were calling to register their views to her as their Senator. We video taped the entire visit, the government has those tapes, and I’m eager for them to be released because they refute the false claims being repeated by much of the mainstream media.

It has been amazing to witness the journalistic malpractice committed by many of the organizations covering this story. MSNBC falsely claimed that I violated a non-existent “gag order.” The Associated Press incorrectly reported that I “broke in” to an office which is open to the public. The Washington Post has now had to print corrections in two stories on me. And these are just a few examples of inaccurate and false reporting. The public will judge whether reporters who can’t get their facts straight have the credibility to question my integrity as a journalist.
