Patterico's sources are all mainstream newspapers (who quote a few anonymous people) and the actual affidavit itself. You didn't even read it, did you?

I don't have a dog in this fight yet, and it is unlikely that I ever will. I agree that Patterico seems to be quite biased, and was dismayed by the general tenor of his piece. I had never read any of his stuff before and had no idea what to expect.

However that article was first introduced in this thread (not by BAC) as a passage to the actual affidavit used to pursue charges against the parties involved, providing us with a less hysterical perspective than that making the rounds on TV.

I cannot describe the affidavit as an "unreliable source". You do yourself and your argument no favors by dismissing it as such.

When linked to a blog I usually just skip whatever the blogger said (unless that was the whole point of the link) and just check the links. He had MSNBC, WaPo, the affidavit, etc. I have no idea what lefty's problem is with those sources.

You seem to persist in describing the affidavit as an "unreliable source". Are you suggesting that this Petterico dude has bunged up some sort of forgery and linked to a fraudulent document? Is there a "real" affidavit somewhere that you can link us to as an alternative? TIA

The FBI affidavit is accurate. It states that they attempted to access the phone closet and admitted it.

There is, however, no affidavit saying that there is no evidence of an attempt to bug the office. The presence of a listening device is evidence to support a theory that that was their intention.

Any statements from an unnamed source are, however, just hot air. And if any of them can be traced back to the Federal Prosecutor's office, they may be summarily hung on that horizontal spindle on the bathroom wall next to the commode.

Well then, you're going to throw out the "presence of a listening device" argument then, right? It's not in the affidavit, it is in fact from an unnamed source and thus from your logic: hot air.

There just isn't any defense against that sort of thing. There are no exculpatory circumstances.

No, I do not incite mob violence.

The most violent I get is wishing that the Shrub, Nosferatu, rummy, Gonzo and Yoo should endure what they claim is a valid means of interogating terrorism suspects. They boast of their crimes.

The government is going to have to prove that their intent was to commit a crime. The defendants don't have to prove their innocence. The government is going to have a hard time doing that unless there's more going on with this than has been revealed so far.

With all the arrows now in the "Homeland Security" quiver I have to think that having conspired to, and then misrepresented themselves in a secure Federal facility and attempted unauthorized access to communications equipment, that if the Feds can't find something to lock them up for then they aren't trying very hard.

I'm not saying that this is a 'good thing'. Just a fact of our post 9/11 lives.

This very well may be the case. These guys are probably going to have the best team that the Government can put together against them.

If nothing else, they're nicked for entering a federal facility under false pretenses, which is only a misdemeanor. O'Keefe wasn't dressed up and didn't present himself under false pretenses, so maybe he won't get hit with that. Can he be charged with conspiracy to enter a federal facility under false pretenses?

It is a federal felony just to interfere with a phone system.

The fact that one of the maggots is the son of a political enemy of Senator Landrieu is pretty good evidence that he acted with malice toward Landrieu.

He can be charged with conspiracy to commit a federal felony.

That he and Dai are long-time associates is a slam-dunk proof that he was conspiring with Dai to do what Dai was doing.
