That which the prosecution asked for in this retrial (the retest of the DNA and the rehearing of a witness) turned out badly for them, yet they still prevailed in court. It makes no sense.

ETA I am agreeing with you that her future is going to be tragic and sad but I am not agreeing with your tasteless remarks which should belong in a PGP site.

The Court of Supreme Cassation did a thorough job of treading science into the ground in their motivations report. Unless someone wakes up, Italy will continue to produce false convictions based on forensics that was buttressed by courtroom lies and continual stonewalling of reasonable requests from the defense.

If they can present a case for putting her into custody. To do that, they will have to clearly describe what they think her role in the crime was, and show the evidence they have to support their claim. They won't be able to present five possible scenarios and say, "We think she carried out one of these," which has been their case in a nutshell so far.

That's because you and I think that evidence should play a role in legal proceedings. We're so foolish. Apparently the Italians have different methods.

Well, that was disappointing and contrary to what I thought would (on balance) happen. However, the SC's hidden hand of influence always had the potential to be the variable that swayed the balance. I can't help thinking that this is what has happened. I simply cannot understand how Knox and/or Sollecito can be found guilty beyond a reasonable doubt, based purely on the totality of evidence (and non-evidence).

With that in mind, it will be fascinating to read the Nencini court's sentencing report.

I also have to say at this point that in my opinion Knox and Sollecito were both badly let down by their defence lawyers - Knox in particular. I think that their lawyers' collective and individual performances in the Massei trial were especially shocking and inept, and I think that the mistakes made in this trial unfortunately sowed the seed for everything that followed. I happen to think that even a first-rate defence team would have had some trouble securing acquittals in the Nencini court, given the previous history of Knox's/Sollecito's defences. I realise that this is not the time to be doling out blame, but I've long believed this to be the case, and I think it's a massively significant reason why Knox and Sollecito now stand convicted (pending SC ratification).

In contrast to Stilicho's claim, I think this is a very bad day for science, rationalism, critical thinking and common sense. I think we've witnessed a perfect storm of judicial reactionary behaviour, investigative tunnel vision and confirmation bias, poor judicial reasoning, adverse media manipulation, inept defence representation, and (yes) defendants who haven't done themselves favours through some of their actions and behaviour. A bad day.

My bet is that Nencini, like Massei, the ISC and Crini before him, will have to make up yet another formerly unheard of scenario to justify this.

Massei reinvented Mignini, the ISC reinvented Massei, Crini reinvented the ISC.... hey, whatever works to convict innocents.

The Italian prosecutors will need to present their case to the state department, which, through political channels, has now been fully apprised of Amanda Knox's case against this inquisition. They will need to explain the holes in their science, their general lack of anything resembling a coherent case, and their adherence to a system that blithely ignores the virtues of double-jeopardy laws.

I've got news for you, pal. Amanda Knox will not be going back to re-experience the gentle comforts of Italy. Full stop.
