Does it not trouble you that the ISC would require the defense of Amanda and Raf to explain who the accomplices of Rudy were?
Do you not understand that when any evidence and in particular LCN DNA is used to convict someone that the authorities must show that the evidence was handled in such a way that contamination or other mistakes can't happen rather than the other way around?
So far the Caribinieri have published their results and prosecution and civil parties have laid out their case against Raffaele and Amanda, I have found it difficult to reconcile what folks believe the Supreme Court motivations stated with what is actually taken place in the appeal.
With all due, this is not a reply to Grinder's question.
But getting back to the nub of at least one issue you do raise....

The ISC clearly stated that one of the reasons for overturning the Hellmann acquittals, was because Hellmann (and perhapps Massei, too, since Massei did not see this as relevant either) did not consider the "sex game gone wrong" theory of the crime as fully as he should have.
And, as you note, what is it that is "Actually tak(ing) place in the appeal"? Prosecutor Crini, like Massei and Hellmann before him, is also taking issue with the ISC's motivations. No one, not Crini at least, has even talked about "sex game gone wrong". Why? Prosecutor Crini is talking about Rudy's pooh in Filomena's/Laura's toilet triggering some sort of murderous response from Knox towards Meredith!!!! Not the sex-game gone wrong.
So you're not the only one finding it difficult to reconcile the Supreme Court motivations with what is actually taking place at the appeal.
Prosecutor Crini is also bringing up something else completely unconnected. It is that Raffaele's kitchen knife, formerly known as the double-DNA knife, is now a supposed match for the bedsheet outline of what can only be some other, obviously smaller knife. This was something NOT mandated by the ISC, yet Crini finds he has to do it, for some other reason, doesn't he!
(The discrepency in size between the two is the reason why Mignini floated the two-knife-theory. Crini is at odds with Mignini on that one, too!)
The Kerchers petitioned the Nencini court to relook at ALL the evidence, which I assume means the evidence not tested at all. The Nencini court took the ISC's directive to do a retest of the DNA found on the kitchen knife, and discovered that the only untested piece available for either test or retest is 36i. 36i turned out to be Knox's DNA, meaning that there is now no connection between that knife and the murder, given that Knox had used the knife at Raffaele's while cooking.
Which is why, I assume, Crini is now desperate to make that knife now a match for the bedsheet outline. Because if it isn't then what is it that places that knife at the scene? The wounds?
But be that as it may, we are now very far from your observation, an observation I agree with, by the way.... and we are also very far from the Kerchers' stated intent, given that the presumed semen stain, now in the third trial, is going untested... and all guilters can do is to find some reason to blame the defence for it going untested!!!!

Perhaps you could help by saying what you believe the "Supreme Court motivations stated". You might also try a summary of what you believe about, "what is actually taken place in the appeal."
This is where, for me, the issue of the Supreme Court throwing back to a lower court the conviction of a 60-year old for interference with a child is relevant. There does not seem to be any rhyme or reason to what goes on in the three levels of Italian criminal procedure.
Your two observations are right on, as far as I am concerned. Yet you seem to find the fault with the commenters here, rather than the ISC. I'm not sure what else could be observed to convince you otherwise.
