Heya JREF2010,
No wonder The Guilter's believe it was Guede.
She was focused on his face and could state that he was a black man?

Here's what FS wrote, he was in court when Miss Formica testfied in Amanda+Raff's 1st Trial,
and for some reason I think he can tranlsate Italian to English great, well much better than Google does!:

It was an instant for Alessandra Formica and her boyfriend.
At about 22:30 of November 1, they are descending the stairs of via della Pergola that lead to viale S.Antonio, where their car is parked and where the cottage is. Suddenly a guy who walks in the rush, coming up, bumps into them and runs away. They wouldn't know in that moment but that man could be a murderer.
A few days later Alessandra will hear of what happened in that cottage and will go to the police. That's how people become witnesses, real witnesses, not buffoons seduced by unscrupulous provincial scribblers.

But one thing is a deposition in front of the Pm and another thing is releasing it in a trial.

If previously from Formica's deposition it looked like that running guy could be Rudy today she's positive: I can rule out that that guy could be Rudy Guede.Another unexpected element. That's what trials are for.
So, if that guy wasn't Rudy, if he was not someone who was late for the bus, we finally start to understand what happened while Amanda and Raffaele were on bed.
<snip>
Mignini has been great. A great lawyer, able to convince Gip, Gup, Court of Freedom, General Prosecutor, Supreme Court, another Pm and some lawyers. And even Massei seems to believe him. For not to speak of the public opinion, which actually is always easy to be convinced of someone's guilt.
But now is the time for him to show to be also a great Pm, a great judge. There's always a second chance. Even a third if you are lucky. And he has luck. Thanks to the intrusion into the house the investigation was reopened and he may now look in the right way.
Now is the time to have the truth from Rudy and to put under pressure the environment of immigrants and of the drug dealers of the town.
As long as Amanda and Raffaele are under accusation Rudy is going to use their position.
Rudy has to see Amanda and Raffaele in freedom. Only at that point he may finally say who was in that house with him. If he really had a minor role he will speak.

Guede was gone by then.
Miss Formica saw the broken down car, which wasn't at 10:00pm, I believe, but later.
I betcha Guede woulda mentioned seeing that broken down car too if he saw it,
to somehow use the info in his alibi, and also because maybe he was concerned that the occupants saw him leaving also. Much like he mentions Meredith's loud scream, because most of us believe, he was worried that someone mighta heard it. MOO...
See ya'll l8r,

That would depend on what was eaten was it a fatty cheese pizza and apple fatty crumble ? Was there alcohol consumed?Did my partner and I have a big blow up argument? All could delay digestion by hours. No in fact it was a lovely dinner in a great restaurant close to the Etruscan arch.So digestion would be in the normal range , having Just a little wine, and no cheese. Thank you for believing it was my video and the timing. For non believers a little wager and pay pal could work. I'd just have to dig up the SD card and post again under Briars. Were you at all interested in seeing the view to the gate from near where Curatolo sat? Were you at all surprised by the amount of traffic near the cottage?

I have had a quick look and cannot find any literature supporting your assertion an argument can delay gastric emptying by hours, can you point me to where you got this factoid from? Even if true this means the argument would have to commence almost immediately after 21.00, so could not have been between MK and AK or RS. Maybe the stress was due to an interaction with RG around 21.00, which RG is fairly consistent in admitting to? I wonder what RG could have done that would be stressful for MK and delay gastric emptying?

Is there any window that could have been broken that wouldn't have been used as evidence of AK/RS guilt by people that are convinced of their guilt?

Why would AK/RS pick a window to stage a break-in at that they couldn't be sure that somebody could climb up to and through?

You are the dishonest one here, A fatty meal with some alcohol can slow digestion. An ugly argument beginning after the group arrived could halt it Stress can halt not just only slow digestion.

We know Meredith had a mainly carbohydrate based meal. What time do you think that this speculative argument, which caused chyme not to pass into the duodenum, began?

Slightly and most of the slowing of that type of meal happens later in the digestive tract. Not in the stomach.

What's up everyone!
The other day I mentioned that I believe that Rudy Guede's awareness of time was off and hence, his recollection of the time of Meredith's scream was too early, as he was off by about 20 minutes or so.

But I forgot to quote + link an important detail that I'd just recently read::
Rudy says that he came back around 8:30 to hook-up with Meredith, she wasn't there yet, but arrived 8 minutes later, which we know was right around 9:00pm.

I'll try to explain better by using Guede's own words from a couple of different sources, ok? Cool.

I think we can all agree that Rudy did not walk through that front door with Meredith. I'd like to here from Briars if she is also in agreement on that one fact.

So Rudy is trying to account for the external factors of the real timeline by creating a false timeline with the same externally visible facts. But, does Rudy do a proper job of this.

Does Rudy know for instance what time Meredith came home? Before his arrest there was no news about the time when Meredith returned to the cottage. There was however speculation that she was stabbed sometime after 10 PM and died between 4 AM and 6 AM. Rudy would try to fit the news times and this could override his own sense of time.

I couldn't help noticing Rudy saying he used the bathroom closest to Amanda's room. We know which bathroom Rudy used (unless someone is claiming that the poo was switcharoo'd. We also know which room was Amanda's but Rudy obviously didn't. This brings up Rudy saying that Meredith showed him where Amanda kept her money in her sock drawer. Did Meredith lie to Rudy? Or does Rudy know about this sock drawer being searched because he searched it on his own when nobody else was there? Briars, have you answered this one yet?

Is there any window that could have been broken that wouldn't have been used as evidence of AK/RS guilt by people that are convinced of their guilt?

The window on the front door of the boy's appartment downstairs was broken and I haven't heard anyone using that as evidence of their guilt. Of course, that may just be an oversight. We should wait and see.

Comparing them? Who has missed the point? They are opposite .The blogger has been a main source for FOA , feeding distorted information about Mignini. His particular style blames his own shortcomings and crimes on others. His writing has been taken for truth by IIP , Dempsey ,the US media ,and you. That was my point.

I am curious about this. Frank reported on what was happening in court during the first trial, that is the subject of the majority of his posts. Has the pro-guilt crowd come up with a proven list of lies now that we have 95% of the transcripts? I know that Halkides was curious about the mathematical certainty quote that both AK and RS were called in to be questioned on the 5th that had only been reported by Frank. That is in the transcripts.

Do you have a link that shows that stress can halt digestion? How much alcohol is necessary to slow digestion? We know what Meredith ate, when she ate it, and what they did around the time of the meal, before and after.

I'm really curious when this stress happened? Does Briars think it was when Meredith was with her British friends? What reason would Meredith have to have this massive digestion halting stress?

The problem with her argument besides the fact that there is no evidence supporting this idea that stress halts digestion is of course, Meredith was enjoying an evening meal with friends and watching a movie. And according to Meredith's friends, she wasn't intoxicated when they saw Meredith and they didn't drink that evening. So here we are again arguing with a guilter about speculative nonsense that isn't backed by the facts. How surprising!!!!

At what point Briars do you acknowledge that the facts are simply not on your side?? At best you can say about this case is that you have a feeling about Amanda and Raffaele's guilt but no actual evidence to support it.

Does anyone know if Giacomo Silenzi and his buddies downstairs were selling any of that weed they were growing? If so this might be the most blinding obvious murder "mystery" ever.

The glass could have been dragged in from where someone kicked out the window in the downstairs door.

The blood on that bed could be from the cat. No test has shown otherwise. Meredith would have been down there tending to the cat and plants earlier that day and could have transferred the cat's blood to the light switch.

About what time did Meredith get up and when did she leave?

This unbelievably incompetent investigation....

13 to 17 fingerprints and DNA were found in MK's room and not accounted for.

Downstairs:

Blood is found on the bed and duvet in Stefano's room, also
blood on a lightswitch and wet flipflops.
None of this evidence is identified either.
How was entry gained?

What about the 2 cars outside....the dark car and the white car?
Why was Aviello's evidence ignored?

All possible leads should have been followed, however unlikely, if only to be eliminated from the investigation.

Sure Rudy could have had someone with him stealing, and the crime went wrong and turned into murder/rape.

But theres nothing in the "police evidence" to prove this. Of course they probably didn't look very hard as all focus was on convicting the wrong people.

Rudy and his MO, lone wolf or sometimes with a bad friend, who knows?

the prisonyard convicts supposedly testified Rudy spoke of two people, and the rape then murder.

only Rudy knows.

I would like to see the parking ticket, was it 10, 10:15, 10:18 10:30...10:35..

With the cell phone ping outside the cottage at 10:13 and the running man, the murder and scream was probably just before Alessandra walked towards the crime....kind of the first person bringing the Tow Truck event into the timeline.

Then adding in Raff's pc activity and the time of a walk it becomes harder and harder to imagine someone making plans to murder and then just moments before watching Ameilie and offering to drive someone to a train station.

but then again, who knows....I never covered the "poop motive" either, as the seed of this crime.

Well the middle of the day makes it even less of a point for what traffic is like there at night (after 8).

I think you are right that this video was during mid-day. But frankly, I don't think it's necessary to call Briars a liar about when he took the video.
Every day is a different day, every hour is a different hour. The only real question is what was it like at 9:00 on November 1st 2007. Everything else is BS.

One, I never said that you or anyone called Briars a liar. But the difference in your statement and others that the video was shot at midday and Briar's insistence was at 8:30 PM effectively does just that. There is in fact no exaggeration given that huge difference. I also didn't say that YOU were calling Briars a liar, even though I have my suspicion about the veracity as to the time of day as do you.

Who were you saying called him a liar?

Briars, as for the time it takes for food to commence transiting from the stomach, I will heed the analysis by the experts.

I dd look at your video. It shows light pedestrian and vehicle traffic on the summer evening when you made your video. I have to wonder how traffic on the evening you chose compares with traffic on the evening of Nov 1, 2007, All Saints' Day.

Your video shows me how difficult it is to see the cottage in the dark. I could see at one point the front door wall but could not discern detail or depth to that wall. I did not see the adjacent side wall where Filomena's window is located. That side wall was dark.

It is also very difficult to see the gate area and the interior of the driveway or car park. I only saw the gate in the headlights of a passing car when the car was immediately passing the gate area. The gate was not visible to me before or after the car's headlights illuminated the opening to the gate.

I realize you take pride in showing this video. You covered a lot of footsteps. Your video also convinces me that Rudy could very easily get to the car park area and do what he did without being observed.

As I have said before, our personal views and weighing of the pros and cons of this location are irrelevant. What matters is how the burglar felt about the location when he commenced his action. He apparently was satisfied.

Are you sure you looked at this video?

There is no view of the cottage at all in her video. You must be looking at another video.

That is complete rubbish. As others have said, any effect such as this is only slight, and it occurs mainly in the intestine, not the stomach. If Meredith still had all of her evening meal in her stomach five hours after eating it, she had serious gastric pathology, not an argument with her flat-mate. Except, she was a young, healthy woman with no medical history of gastric pathology.

What happens with severe stress is just the opposite. Intestinal hypermotility, and diarrhoea. Gastric hypermotility too - the stomach literally churns. This is part of the fight-or-flight reaction, as the body tries to get rid of as much intestinal content as possible to lighten the load, as it were. In extreme cases the person may actually vomit.

Rolfe.
