The state of FL v. George Zimmerman

For those of us who agree that so far the states case is no looking good for them, and assuming that continues to be the case, what do you think the likelihood of putting GZ on the stand is?

It's a close call, in my layperson opinion, and depends on how well the state attacks his prior statements and how much Zimmerman is allowed to get in via completeness. Probability calculation: 49% Zimmerman testifies. That's really the best I can do.

"It's difficult to tell where the state is going with their witnesses," Braeley explained. "We've had a lot of witnesses on the stand that have given unclear testimony, a lot of stories that have been inconsistent, the details are vague. Usually when, especially in a trial like this where they've had so much time to prepare and they understand that it's going to be a massive media trial, they know exactly what they want out."

I'm thinking it's actually crystal clear. Once the evidence in this case actually came out, it was apparent why the original DA decided not to prosecute, and it was apparent that the decision to prosecute was based on politics.

Now everyone keeps asking "what is the state doing"? And the answer is, "what can they do, they don't have a case".

Can the judge tell the jury to consider a lesser charge than murder 2? That's the only way I see the possibility of a conviction here.

When he is acquitted I fear it's going to be ugly, and a TON of people are going to use this for their political purposes. The sad thing is I really do think we have a justice system which is horribly racist in nature, I just don't think this happens to be an example of it. I think this is a classic case where the bad and highly inflammatory initial reporting by the media can't be put back in the bag.

State's case does not depend on who was on top.
It now depends on the jury believing that the guy on top beating the guy on the bottom "MMA ground and pound style" is the guy screaming desperately for help.

The only witness who put Zimmerman on top came to that conclusion based on seeing an old picture of Martin when he was 12 years old and concluded he was too small to be the person on bottom and therefore it must have been Zimmerman on top.

State's case does not depend on who was on top.

Of course not, and no one has claimed that.

In support of GZ self defense claim, witnesses claiming TM was on top of GZ doing something that appeared to be "raining blows" and moving arms up and down on GZ are not helpful to the prosecution.

In addition, there have been posters who have implied or stated that they believed the evidence would show GZ shot TM while GZ was standing up and TM was on the ground. So far this testimony seems to confirm that TM was on top of GZ until he was shot, and then GZ rolled out and on top of him.

Also confirms the fight was moving as it was happening, even when they were on the ground. And it moved from the grass to the sidewalk just before the shot was fired.

Shocking new development!

3:30 p.m. ET: Zimmerman's nose was actively bleeding when Smith first saw it. His eyes were also watering.

Zimmerman told Smith he had shot the man on the ground and that he was still armed.

"At that point is when I upholstered my service weapon," said Smith, explaining that it's protocol. He pointed the gun at Zimmerman.

I wonder if he used a plain print or some sort of floral pattern?

Also, no witness to date has reported seeing anyone chasing someone else, let alone Zimmerman chasing Martin gun in hand.

Apparently Zimmerman had his gun on his right hip. Yet I noticed that when he writes things down while sitting at the defendant table he uses his left hand.

Is he ambidextrous?

Cross-pull?
The holster was displayed earlier, it didn't look like a crosspull holster to me and they showed both sides. But it was a brief shot.

eta: actually kept it near his back pocket, according this still from the video re-enactment the police made during the time they weren't investigating anything. :boggled:

It was not daytime. Street signs are not house numbers, either. It was also raining.
The units are all alike. George lives there. He knows there the house numbers are, They are illunimated. He has two torches.
This goes to his credibilty.
It comes down to whether you believe he doesn't know the two major (of a total of 3) streets in the complex.
We've done this

You say Martin confronted GZ...isn't it then more likely that Martin crowded GZ back down the T just prior to the sucka' punch? :)

Not if you believe George on how the confrontation developed.

He needs to take the stand and explain the discrepencies in his story.

The jury will want to hear him. If they don't, don't count of Don West for an Rumpolesque Golden Thread speech.

Back to the trial ... .on the stand now, Lindzee Folgate (PA at Altamonte Family Practice)
(where GZ went to the doctor the next day)
