The state of FL v. George Zimmerman

You're falling for a meme. Zimmerman called for service 5 times in the last 6 months in a neighborhood that is undisputed to have a worsening crime problem. In fact, Wendy Dorival who is the SPD NW coordinator reviewed his calls and asserted that the behaviors he describe were the behaviors that SPD wanted reported. Sean, the NEN dispatcher that took his call, agreed.

But there were many more calls than that from GZ to the NEN reporting all manner of things. Definitely more than 5.

Today's summary goes something like this:

First order of business was the court ruling that Zimmerman's prior calls to SPD could be admitted as evidence and published to the jurors.

Next, it was revealed that Alternate Juror B72, a young Hispanic male, would be excused from court today for a matter unrelated to this case. I don't know if he will be allowed to return, but the case law seems to indicate that he will not be allowed to deliberate is something happens another juror. Maybe he tried a bit too hard to impress E-6 with his "one-arm pull up." (That's totally made up, BTW.)

The state continued with it's chronology of the incident itself.

Jane Sudyka, aka W8, was the inconsolable female who claimed to hear an aggressive voices and one of a little boy. She asserted several times that there were three gunshots and even re-enacted them for the jury. Pow! Pow! Pow! She claims with certainty that these three shots were captured in her 911 call even though she listened to it just minutes earlier. She also expressed certainty that her bedroom window was up, which allowed her to hear the voices even though in that same 911 call she clearly asks the dispatcher if she should raise it to see if she could hear anything. She claims Zimmerman was on top of Martin when she heard the volley. She denied expressing frustration that detectives didn't spend more time with her and take her up on the suggestion to look out her bedroom window, though she devoted a good bit of her 13-page initial statement addressing this issue. She clearly remembers the initial SPD officer was female with the first name Serena and, when asked, disputes that the officer was a male detective with the last name Serino. That was another guy. She also denied being on national television. When confronted with the AC360 interview, she pointed out that she was in shadow and disguised voice which apparently doesn't count as being on teevee. Moving on...

Jeannee Manaloo was an Asian, female, EASL who lives on the NW corner of the area, at the corner of the dog walk and cut-through. She heard scuffling and yelling move from farther away, south pass her back yard and end up a door or two down but all on the other side of the dog walk. She saw nothing but shadows. It was very dark. Later, after seeing images of Zimmerman and Martin on TV, she thought it Martin on top because of the size difference. On cross, O'Mara showed her pictures to identify which ones she used to draw her inference. Manaloo picked out the hoodie headshot, the Hollister photo (aged around 12) and the football photo that was probably aged 13-14. She really became confused when she realized the age difference and readily admitted that she could no longer be certain. The state had her repeat her claim that Zimmerman was the one on top and that he was the one that got up after shooting Martin. She claimed seeing Zimmerman after the shooting (her husband is W13 - the first person on the scene after the shooting) but could not identify the injury photograph. This witness was obviously trying to come to the truth in her own mind and trying very hard not to be deceptive.

The next witness was Ramona Rumph, the custodian of records for SPD. She had a great job today - sit in on the next big trial but not really be a fact witness. She authenticated the NEN calls admitted earlier and sat there while they were published to the jury. After explaining some event codes and such, Team Zimmerman got their shot to put her on the hot seat and grill her for an hour or so. Wait - she was an authentication witness, so that was just as pleasant an experience as direct. Mark O'Mara tried to get some other records in, but this was a state's witness so she left - subject to recall and with the same friendly smile she started the day with.

Next up, Racheal Jeantel, aka DD, aka Diamond, aka W8. I just call her "Court Nails." Ms. Jeantel don't play. I cannot do her justice - or understand her - so I'll defer to YouTube:

Upon hearing that Ms. Jeantel would return for another round of testimony tomorrow, it's rumored that the deputies escorted the court reporter to the first floor of the courthouse and confiscated her belt and shoelaces before allowing her to go home for the night. Drink up, Ms. Court Reporter Lady. Tomorrow is another day!

Good - If we had someome locally that called 911 for service that many times, they'd be on the crank list.

I think Ms. Rumph may have fibbed a bit today. She was asked that question today - about the crank list - by Mark O'Mara and denied knowing about any such practice. I'm not saying she knows about it, but I do know it's not uncommon for a local jurisdiction to take an obsolete S or 10 code and assign it to mean poor Ms. Jones is off her meds this week so whatever officer that doesn't have a current conflict with her needs to drive out there and get her off our phone.

Whatever side you are on Ms Jeantel is hard work! I think it is a shame she does not have more respect for the legal process.

She's a teenager, perhaps a bit learning disabled, she grew up black in Florida, and she's being badgered relentlessly by some white dude on national television.

I'm impressed that she's shown as much respect as she has. In her shoes I'm not sure I could do much better.

Question about court procedure. If we all agree that Rachel is learning disabled, and we know she didn't write the letter to Ms. Martin herself but had a friend write it, shouldn't we be concerned when she's being presented with previous testimony in writing that she's not actually able to read it? If so, can the court step in?

I think the other thing missed was that the state presented its first direct evidence of racial profiling today.

Ms. Jeantel asserted Martin initially described Zimmerman as a "crazy ass cracka."

Damnit, I can't find the link I saw before I rebooted. Found a lot of useless stuff so I'll again concede Cylinder is correct.

This issue is totally separate from the 46 calls to SPD since January of 2011.

My guess for a functionally-illiterate witness is that the parties can stipulate read-back or the court can direct a court reporter to do it. Usually read back is only allowed after a witness has a chance to read and address the impeachment. That was the subject of many objections today.

What if we don't all agree she is learning disabled ?

And if she can't read, shouldn't she just tell the judge ?

I think it seems obvious that she's learning disabled since she has terrible vocabulary and she'll be 20 years old in 12th grade next year and has the demeanor of a much younger person. And we know she didn't write the letter to the Martin family herself, which made me think she can't write.

As for why she wouldn't tell the judge (which means the entire world), it's pretty common for functionally illiterate people to hide this fact, since it's extremely embarrassing. Can you find any example of her reading out loud today?

She seems preternatural with dates, but language seems beyond her grasp. I honestly think she's on the autism spectrum.

I'm wading a bit over my head, but I'd think that a functional disability at some point becomes either exculpatory impeachment information or at least an officer of the court issue. A learning disability, for instance, can deny a defendant of their right to confrontation for the very reason you assert. The witness would pretend to read and understand something, but cannot really function at that level.

LashL??? Anyone???

Good point, Cylinder, but wouldn't the defense have done or said something if they suspected a problem when she was deposed? Certainly the prosecution would know.

It could also be she's so far out of her element, she's coming across in a weird way. She did appear to get more control after she'd been on the stand for a while. I would guess she was a special needs student who got lost in the shuffle of declining school funding. 20 is a little old to be a senior in high school.

She testified to sending and receiving text messages, so I'm not so sure she's illiterate.

I'd be interested to know how many of his calls resulted in an arrest and/or conviction, and how many were dry holes.

We had our self appointed neighborhood watch types in the jurisdiction where I worked, none of them took up carrying and following, but Zimmerman seems to me to have been on a mission.

That's some "summary"...

Her likely having LD aside, I can understand her just fine.

To put GZ calls in context:

The answer may lie in police records, which show that 50 suspicious-person reports were called in to police in the past year at Twin Lakes. There were eight burglaries, nine thefts and one other shooting in the year prior to Trayvon’s death.

In all, police had been called to the 260-unit complex 402 times from Jan. 1, 2011 to Feb. 26, 2012.
