Continuation Part 5: Discussion of the Amanda Knox/Raffaele Sollecito case

Repeatability. It had to be LCN in order not to be repeatable. LOL. I have said this about 5 times and no one pays the slightest attention

Perhaps that's because if they had planted a small amount of blood on the knife the test wouldn't have been LCN and would have been repeatable. If they had come back with a non-LCN result planting would be the only way to explain it away.

Now in terms of sequencing, the knife was collected well before the shoes went bad so perhaps at that time they weren't as concerned about the knife, still hoping to find the smoking knife gun.

:boggled: huh? You could be more obscure.

I suppose I could. I'd like to work otiose in here.

You asked why no one picks up on your point that if planted the test would have been repeatable which is an otiose (there) assertion. If they had planted Meredith's blood on the knife, there would be no problem with it being repeatable; therefore it wasn't planted.

Ann Wise reported, "Pasquali said that he had re-created the same conditions that were found in Romanelli's room at the time of the break-in. Pasquali said he constructed a window of the same size, with the same paint and the same type of glass, and threw the rock through it into a room with the same characteristics as Romanelli's room. Two video cameras -- one inside and one outside -- filmed the rock being thrown through the glass." And, "One witness said his office window had been broken with a large rock, and a computer stolen. The computer and a cell phone were later found in the possession of Guede, who was also found with a switchblade."

We are in danger of reaching agreement so I'm reversing myself. Why not daub some blood on the blade? There must have been plenty of it around. So what if it's repeatable? Great!

Thank you, Methos. My google-Italian skills are rusty, so I'm not sure what to make of this, but this line here

"The lawyer Maresca was then briefly focused on the simulation of the theft which he called "peacefully confirmed" and "why Amanda Knox and Raffaele Sollecito were convicted."

makes me wonder. Mignini helped convict Raffaele and Amanda by not pursuing burglary charges against Rudy and keeping the illusion of a staged break-in alive. Maresca was right by his side it appears from this.

I wonder how this case may have gone down differently had some other prosecutor handled Rudy's case. This was a loophole Mignini opened up by gaming the system.
What I got from those two is that Maresca and Perna had their say at Guede's appeal and that Maresca explained the reduction of Guede's sentence as plain math (fast-track = reduction of the sentence by 1/3), no outcry here no confusion. Why?

Well, since we are conspiracy theorising, I think the actors in the film know throughout where the clasp is. They make a great performance out of rummaging through all the clothes, looking in the corner where the rug is, going back to the kitchen to look at crime scene photos on the laptop and miming: 'oh, that's where it was - on the floor! Let's go look there.'

The rug is perfect because naturally it will have protected the clasp from contamination in all that time. It's as perfect as the soon-to-be-rusted little hooks themselves.

Actually a rug would be an ideal vector for random contamination. If someone coughs or sneezes or even talks, they will leave their DNA on the floor where it can get tracked around. This is one reason why I have never pushed the deliberate planting of evidence too hard. It could be a coincidence.

The other reason I don't push it is because the video shows the clasp being passed around by people whose gloved hands had been in contact with a variety of objects and surfaces. Raffaele's fingerprint was found on the outside of Meredith's door. Maybe his DNA was on the door too, and maybe one of the investigators picked it up on their glove before handling the clasp.

I know from other cases that random DNA pops up in unexpected places. Sometimes it benefits the defense. I have mentioned the Donnah Winger case many times in this discussion. Marc Winger was convicted of murder on the theory that he killed his wife, lured a cab driver to his house, shot him, and blamed him for the murder of his wife. There's no doubt in my mind that Winger is guilty, and there's lots of evidence to prove it. So why did Donnah Winger's DNA show up, mixed with the driver's DNA, in multiple samples taken from the driver's clothing? It might suggest that the driver really did attack Winger, but more likely, it was the result of random contamination at the crime scene.

The bra fastener, however, entered the equation at a point where the cops were flat desperate. They had the knife, but they knew it was a poor sample, and the knife was not plausible as the murder weapon for many reasons. All the other DNA samples for Amanda could be explained by her living there. And they had absolutely nothing against Raffaele. Suddenly they came up with exactly what they needed. It could be a coincidence, I can't prove it's not, but I somehow doubt it.

What I got from those two is that Maresca and Perna had their say at Guede's appeal and that Maresca explained the reduction of Guede's sentence as plain math (fast-track = reduction of the sentence by 1/3), no outcry here no confusion. Why?

He got mitigation (30 years down to 24) plus a one third reduction (24 down to 16) for going fast track. I don't get that. I thought he already got his fast track credit from Micheli. Maybe he should have appealed again and got another third off.

I'm sick of these attacks :p.

If the rock were thrown from the inside with the shutters closed, which held the glass from falling outside, then how would the outside shutter not be damaged extensively? If the rock were slung as you describe Sir Anglo, then why would anyone expect glass to fall outside? Oh that's what your saying ;).

So for the staging the window would have to be swung open and the rock thrown against the inner shutter leaving the dent on the inner shutter, but then all the rest of the evidence doesn't fit, drat.

The rock was thrown from the outside whether it was a real break-in or a staged event. I do think the ten pound rock makes another argument that Raf or Amanda didn't do the staging, if that's what it was.

bingo!

Don't you,
doc???

Amanda Knox likes sex,
so does Raffaele Sollecito...

Meredith Kercher liked sex,
heck she borrowed a coupla condoms from her friend Amanda before she was so brutally murdered. Gosh, the girl even luved to experimnent, goin' so far as having anal sex with her new boyfriend of only 10 days...

Isn't sex fun, daddy doc?
:)

Hey doc,
gotta question for ya:
How come I've never heard of Rudy Guede having sex?

Come on doc, you're a dude as I am, no?
Surely Guede-o thought about sex constantly,
as any healthy male does daily, no?

With whom was the Guede-o getting laid?
Meredith was getting laid, Giacomo was getting laid,
Amanda was getting laid, Raffaele was getting laid,
Filomena was too, as was Laura...

But what about Rudy Guede?
Didn't he like sex too???

Gosh, doc,
in between lookin' for jumpin' sharks here in l.A.,
shootin' surfpix+lotsa hot lookin' gals, well I've taken the time to read alot about this read strange case that we both, (weirdo's it seems, per a post of yours) are very interested in...

From all that I have read, doc,
it does not seem that Guede-o was gettin' any luvin',
ya know, any sex, from any women
nor heck, even any men!

Don't ya agree, doctor???

So I have to wonder:
Is that why Rudy Guede raped a dying woman as she lay bleeding to death, choking on her on blood, with Rudy Guede most likely masturbating himself to climax and then ejaculating between Meredith Kercher's naked, spread apart legs???

Why is it that an apparent semen stain has still not been tested?

Hmmmm...
RW
 A doozy, RWVBWL.

Barbie is critical of the defence lawyers, but I think she's the only one. One always has incomplete information with these things. The lawyers may indeed have been crap but Cicero himself would have lost in front of Massei.

Cicero! There was a human being. And look what Rome did to him.

Guede's first sentence was "life" reduced to 30 years because of the "fast-track"-trial. (btw. if he'd been found guilty of one of the other charges (theft, etc.) the sentence had been"life" anyway because in that case only the solitary confinement part of the sentence would have been discounted..
On appeal the judges found him guilty as before, but recognized "mitigating circumstances" as there are: his clean criminal record, his youth, his willingness to name Knox and Sollecito, the so called remorse, and so on...
Actually the appeals judge set his penalty at 24 years, the same base, judge Massei set for Knox' and Sollecito's penalty. (Thankfully to the PM they had a lot more on their plate than Guede...) This 24 years based on the mitigating circumstances judge Borsini found were cut by a third to 16 because of the "fast track-trial"

Yes, so he got his reduction twice. There is something in B-B about his sentence having to equate to A & R's which is why the 30 came down to 24. The mitigating circs that cancel out the aggravating ones are pretty sick. Like he tried to help her with the towels. Jeez.

Not really, B-B sentenced him to 24 years, the fast track reduction was always looming in the background... :(

Rudy was dead broke, that's probably what started this whole tragedy. Putting him in prison longer doesn't get anyone paid.

Raffaele on the other hand has some money, some three million euros, mostly in property as I understand, left to him by his mother. If letting Rudy off easily gets Raffaele convicted, Maresca would get a big payday for the Kerchers, adding to his reputation.

I was reading about another case in Italy where it was said the prosecutor had to propose a fast track mitigation and a judge had to approve it. That was for a financial crime or something, do you suppose it works that way with murder too? I'd think at least as many would have to sign off on it for truly dangerous people.

I wonder what utter nobodies like the Kerchers and Maresca value more; millions of Euros, or knowledge and truth?

Actually, I don't - they've already made it quite clear.

no equality

That so-called equality never made any sense to me. The prosecution appealed mitigation for Amanda and Raffaele. If they had been successful, the sentences for the two would have gone back up to thirty years, unless I am missing something.

They don't like it when you insist you're innocent is the impression I got. Had Raffaele and Amanda admitted guilt they could probably have been walking the streets in a couple years like Rudy might be.

But by failing to confess they must be dangerous psychopaths who need to be locked up longer!

We are zeroing in on another farcical aspect of this case: that all three were not tried together. It will be interesting to see the SC motivation.

The Guede sentence is what is truly shocking about this case. Didn't he even admit to cellmates that he did this alone?

I'd also like to know how someone who had been in Italy for only a few weeks could have possibly had the language skills to persuade two men to help her rape and kill her flatmate - when she could probably barely order a pizza? Or was there one giant game of murderous charades prior to the event - maybe they misunderstood and all Amanda really wanted was to play a game of Cluedo! It's beyond ridiculous and far fetched and virtually science fiction
