Continuation Part 5: Discussion of the Amanda Knox/Raffaele Sollecito case

And THANK YOU - everyone on this site needed exactly what you have brought, you have done an excellent job battling wave after wave of, whatever they call themselves. I may not agree with all your points of view, but I do like the way you have stood up to them, good for you.

Nah. Michael/Fulcanelli was much better at this. However even Michael turned out to be very badly out of his depth on these forums once a few sharper minds got interested in the case.

DrTesla's just repeating tired old falsehoods from years past. He's reliving the glory days before we actually knew what the prosecution case was, before we knew about the state of Meredith's last meal and before the independent experts had utterly demolished any credibility that Stefanoni's claimed DNA results might once have had.

The bottom line is that just like you, DrTesla has no coherent theory of the crime that makes any lick of sense. He hasn't actually got a position to defend, as such, just a bunch of disconnected talking points that hint that guilt is possible without ever coalescing into a theory, a case or anything remotely logical.

We could do with an intelligent, informed, rational pro-guilt poster with a coherent theory of the crime. We could get our teeth into that. DrTesla is no such beast, sadly.

What 'cellphone' evidence? Are you talking about that nutty spam that The Machine (Harry Rag) and his merry band of 'Mandy'--haters spread throughout the ether? Most of that is mere sophistry, mistaken (Massei made an error in his Report on that issue--that can be proven by the hard evidence and he refers to it correctly elsewhere) or based on the fact that some locations had two towers serving them. Go out and find one and bring it here, it's not that tough to untwist but its not been seen in a while. Or you could read the threads and you'll find that garbage has been thoroughly discredited time and time again. Why do you suppose there's been something on the order of 100k posts on this subject here? ;)

As for Mignini, remember what happened to him. He was just an eccentric prosecutor who all of a sudden got major media attention for his 'investigation' of the Monster of Florence case. To make a long story short he made a bloody fool out of himself and ended up charging on the order of 20 people for being part of or protecting some satanic cabal responsible for the murders of a long-inactive serial killer. He ended up getting prosecuted himself and convicted of abuse of power, but (eventually) got the conviction quashed on a technicality which amounted to him having pissed off so many people in Florence he argued he couldn't get a fair trial there. It may end up being re-prosecuted in Turin, though sometimes things like that end up getting dropped in Italy.

In this case he did the same thing, essentially, came up with a bizarro theory for what was actually a pretty straightforward burglary turned rape/murder when the occupant returned unexpectedly. Again he ended up filing charges on more than 20 people, off the top of my head it's probably up to somewhere like 25-30 now. His entire life's work is on the line here, his 'legacy,' and his perhaps even his freedom. At this juncture he has to win otherwise he'll be remembered as some nutcase who ruined or damaged so many lives through abusing his office. He's the sort who cares about that judging by how he's courted the press and controversy the past decade or so.

cellphone evidence is referring to looking at Knox's cell phone history. Like turning off her phone the night of the murder, a first time event. calling her mother the night of the murder, a first time event. the fact she didn't let Meridith's phone ring very long when she was supposed "real worried" about her, and she only called the one, and not the other, likely b/c knox knew that they had thrown them out in those woods and they were together and if nobody picked up the one they weren't going to pick up the other. and there's a lot more of that, like when Raff called the police, after the postal police arrived but he told them he already had done that. just so many contradictions regarding the cell phones and when they called, and why they called, that don't make sense with the story they gave the police. it's really the cell phone discrepancies that buttress Mignini's case against them in a comprehensive way. they just got too much to explain for people who claim to be innocent.

well I haven't seen you directly refute me on anything. You can talk about me in 3rd person and proclaim yourself the man if that makes you feel better but people know the truth. :)

i think that I've put together a real coherent case and theory of the crime, Knox wanted payback on that little conceited bitch Meridith for slut shaming her over bringing all these men home to the cottage and the vibrator out in the open. the roommates and Meridith's English friends testified that there was tension b/t the two and they clearly did not hang out socially outside of the cottage. we can never know the specific motive but the general idea is Knox hated Meridith and wanted to shame her and teach her a lesson.

Do friends of Amanda ever consider that their attacks on the prosecuter, on the police, on the DNA experts like Dr. Stef,

<Dr. Stefanoni has an undergraduate degree in biology, in Italy that entitles her to the honorific that is translated as 'doctor.' It doesn't mean she is any more qualified than all the rest of the people with four year degrees in Italy who can say the same thing.

on the various reporterss like Vogt and Nadaeu, might be seen as over the top and just not believable and actually be hurting the case for her innocence?

This whole case is over the top because Mignini is over the top, and his being a corrupt kook has allowed the Polizia di Stato in Perugia to become incompetent and corrupt as well. He's supposedly their oversight as PM, instead he's become a corrupter, as if you can give Mignini the evidence he needs for his current case...

you are really alleging that there is some kind of criminal conspiracy b/t prosecuters, the police, dna experts, reporters, and others to find Knox guilty of murder at all costs. you'd almost think all these people don't get paid unless Knox is found guilty b/c it sure seems unreal to me that they would be this passionate about some college bimbo being found guilty that they basically break the law or lie or whatever to make sure it happens. Mignini prosecutes a lot of other cases too and this is just one case out of many for him. he's nto going to lose his job if she's found innocent. that's not how it works.

This and the Monster of Florence case got him international press attention. That can have an effect on people. Keep in mind all the people who did speak out against him, the first place to look is all the people he filed charges on. Then look at all the scientists, journalists, law enforcement professionals, lawyers, forensic specialists and people from every walk of life, nationality and political persuasion who spoke out against him and on behalf of Amanda and Raffaele in Italy and all over the world.

However there's some who will assume that an authority is always right, no matter how ridiculous, stupid or dangerous they sound. The Milgram experiment demonstrated just how far some people would take it.

But I do know what you're talking about, I've noted on a couple of occasions that if they tried to make an entirely fact-based movie on this case and what it became that it would come across as totally unbelievable to many. Hollywood is going to have to tone down as opposed to sex up this one!

the thing is, it's just not believable that everybody involved in this case that might have chipped in to being found guilty is out to get her. i just don't buy that Dr. Stef babe is out to get Knox. she's just a biologist. it's my understanding that she passed a series of tough tests to qualify for her position so i don't think it's accurate to pass her off as just another undergrad degree person. i think she works for Italy's top DNA forensics unit.

I would actually like to direct a movie about Knox based on how I think it went down. that would be much easier than me trying to explain how I see it piecemeal on forums like this, in a lot of ways.

I'm going to try to dig up that case in America where the female roommate actually set up her roommate to be raped and killed by some guys, and I think she watched both. i think Knox's thing is the exact same kind of scenario....she was motivated to humiliate Meridith, it was a sociopathic hatred for Merdith she had, and the heinous way she was butchered and then just left to die in her room, even taking her cell phones from her so she couldn't call for help, while she suffocated on her own blood seems to support this theory. the murder itself seems like an Edgar Allen Poe story.

No worries.

I purloined this from friendsofamanda.org;

[qimg]http://i1320.photobucket.com/albums/u529/Oxford59/footprints_compared_zps9195bdab.jpg[/qimg]

Raff/bathmat/Guede.

Is this the image that if you're on that site and hold your mouse over the center picture it will super impose the image of each foot so you can determine which one is the better match?

If so, this was argued endlessly at the other site I read and the PG crowd claimed the prints were not at the proper scale making the demonstration deceptively wrong

Once again, I don't know who is right here but it left me scratching my head not knowing how to divine the truth among all the noise

you are just parroting Doug Preston's nutty talking points about Mignini now. you are too eager to believe that guy.

It's not just him who said it, he's one of many. Other places to look are the ones he threw in jail or charged for saying things like that! That includes other writers, government officials, (retired) police chiefs and others.

mignini has been given the green light to proceed in that Narducci murder investigation.

Is that a typo or is have you read somewhere he actually going to re-open that?

He never proposed the satanic rite theory in the MOF case, which was investigated back in the 1980s and the theory was developed by somebody on it back then.

And he was attracted to those satanic rumors like a fly to offal, giving them an official status.

There was evidence that the doctor was murder when some phone calls were intercepted that said as much and the doctor's own wife belives he was murdered, so that's how it was investigated. it's obviously a complicated case but there does appear to be a cabal of people who obstructed justice in the investigation of that murder. the case itself is weird and I tthink Preston and others know that but they still try to to make Mignini out as a nut simply b/c he is looking into this weird case.

Mignini took the rumors and possibilities and created his own 'evidence' and the 'cabal' amounted to all the people who didn't like him as he was making a damn fool of himself and hurting people in the process, including especially the family of the poor doctor Narducci.

there is no relation b/t the Knox trial and the Nardicci case, other than Mignini was part of both. Preston appears to have a personal beef with Mignini for interrogating him for obstruction of justice in the MOF stuff, and it does seem like Preston and Spezi were pretty aggressive in pushing their theory of the MOF killer and there does seem to be some truth that they might have planted evidence to support it.

Nonsense, Mignini just 'hypothesized' that. That's what he does, he 'hypothesizes' things and then finds 'evidence' to support it. All kooks do to a certain extent, he's just the vengeful angry type who won't ever give up on them.

I never heard of a writer accusing somebody of a crime, a murder in their book, but that is what Preston/Spezi did and in my mind that should be a felony....how would you like to be accused of murder by some fiction writers in their book? that would piss me off.

I never read anything but excerpts from Preston's book. Demented serial killers don't interest me much at all. I did see "Hannibal" as I liked "The Silence of the Lambs" and I read somewhere that the guy in Italy was supposed to be based on the Monster of Florence, but that's about all I remember from that movie.

but reality is Mignini hasn't been involved in the Knox trial for quite some time as somebody else did the first appeals trial (I think) for the prosecution and now somebody else will do the prosecution for the 2nd appeals trial. it's funny and weird that you gusy spend so much time attacking Mignini when he's got nothing to do with Knox now. yeah, he made her cry back in 2009 or so but it seems prudent to focus on her defense and not attacking the prosecuter personally. show me when that kind of stategy ever won the day in a murder case.

You really don't know what you're talking about do you? You sound like you're getting your info from TJMK, a place run by one of Mignini's 'fans' who's made it his life's work to lie in support of Mignini and to the detriment of Amanda Knox, Raffaele Sollecito, their families and supporters as well.

In an almost unprecedented move, Mignini attached himself to the trial de novo that is an automatic part of the (non-fast track) court process in Italy. The idea actually is that a different prosecutor and different court reviews the evidence to ensure (in part) there's not a bias in the system. Mignini and Comodi, the prosecutors in the original trial did almost all of the court work in the appeal as well, which is very unusual and corrosive of the ideals of the system, which has its own problems and doesn't need any of the safeguards eliminated.

What are you talking about here? You think she never turned her phone off before? Or she never called her mother? Or are you relying on the fact the cellphone records only go back a little while and wouldn't show if she had her phone on or off anyway and she han'td called her mother before in the middle of the night (in Seattle) because she had never been freaked out by having her door open and strange dumps in the toilet with spots of blood around?

I can't even make sense of the rest of it, <Doctor. I don't recall if she called both of Meredith's phones or not, but I can't see how it could be construed to mean...actually what do you mean there?

Nevermind, come to think of it. I made something out about Raffaele not calling the carabinieri until after the postal police arrived. That's completely moronic and I've already addressed it this thread to someone else. Nutty nonsense.

The kitchen window that is accessible from the balcony did not have bars at the time of the crime. It did have a functional outside shutter that would need to be pried open before breaking the window. The shutter on Filomena's window was broken and could not be latched.

Another problem for a burglar is that the balcony is lit by a nearby streetlight and easily seen from the road passing by the cottage and homes further up the hill. Filomena's window was in the shadows and hard to see at night.

Those who broke in after the crime would have found Filomena's window boarded up making it difficult to gain entry via that route.

Duly noted, I retract my earlier statement where I said I thought Filomena's window was the only one without security bars

I do think her's was the only window whose exterior shutters were not fully closed and I believe she said as much in her testimony (from Massei):

filoquote.jpg

I am a builder and remodeler and have done this type of work for the last 20 years and I have encountered several houses with old windows and shutters and what happens is the hinges start to wear over time causing the shutters to droop and no longer operate as well as the did when originally installed. Add the weathering and swelling of the wood caused by moisture and what I found that happened quite often is I couldn't fully close them because the bottom of the shutter would catch on the sill leaving them slightly ajar, creating a V-shape with a gap in the middle where they couldn't be fully closed. This allowed me to open the shutters from the outside by pulling them or pushing them from the inside with force so they could be freed from where they were caught on the sill. Even if I was able to pull one side of the shutters fully by force, I could never pull them both because my fingers would get slammed into the shutter I had already closed because in order to pull the shutter I had to grip it from the outside. Make sense?

I think this is why the window was chosen because not only did it not have bars, it had shutters that were ajar (because they couldn't be fully closed) that could be easily pulled open from the outside unlike the small window on the balcony or any other window with shutters for that matter.

Additionally as I showed up thread, you can plainly see the balcony when driving down the road toward the balcony, whereas you cant see Filomena's window when driving toward it from the other direction because its obstructed by trees. When you get right on the house, you could see the window, but would be forced to take your eyes off the road and look toward it which would still presumably be dark since to my knowledge there was no lighting illuminating that side of the flat.

well I haven't seen you directly refute me on anything. You can talk about me in 3rd person and proclaim yourself the man if that makes you feel better but people know the truth. :)

I guess you've forgotten those nonexistent fingerprints all over the house?

i think that I've put together a real coherent case and theory of the crime, Knox wanted payback on that little conceited bitch Meridith for slut shaming her over bringing all these men home to the cottage and the vibrator out in the open. the roommates and Meridith's English friends testified that there was tension b/t the two and they clearly did not hang out socially outside of the cottage. we can never know the specific motive but the general idea is Knox hated Meridith and wanted to shame her and teach her a lesson.

That's a motive. Not a very good one seeing as absolutely nothing dating from before the murder even hints at such animosity and all the available evidence indicates that Meredith and Amanda were friends who socialised together right up until her death, but it's a motive. It's not a theory of the crime.

A theory of the crime would have to cover such issues as when Meredith died, and how Knox and Sollecito managed to be there at that time despite the computer evidence showing them to have been home until long after Meredith was already dead.

It might also help if it explains how three people with no common language and no established relationship ended up in Meredith's house murdering her, how three people killed Meredith leaving knife wounds and a bloodstain on the bed more compatible with one knife, and how things progressed such that at no point did either of Amanda or Raffaele say "oh boy, this is out of control, I'm going for help or calling the cops".

Mignini made up a story where all three stabbed Meredith all at once in some sort of weird ritual, probably because he saw the problem and had a vivid imagination. However it doesn't qualify as a credible story by any rational account.

So have at it, if you're swooping by for another round of seagull fun.

The trouble with Barbie is that all of her errors tend to make Amanda and Raffaele look worse than the actual facts. It could be her bias is subconscious, but don't see her as being objective. Links here and here to discussions of her work through about 2010 on this case. I think her list of ten questions for Amanda, since updated, also show the same lack of critical thinking.

A blogger wrote, "Barbie Nadeau recently noted that there were mixed genetic traces in spots of blood in which Knox’s traces were higher than Meredith’s and according to dozens of forensic experts, this indicates mixed blood." Barbie never identified these forensic experts. Trying to decide that something is blood based on relative or absolute peak intensities is a little bit like deducing the age of a tree by counting the number of leaves it has.

Duly noted, I confess that I haven't followed all her writings so my perception may be off, she just didn't strike me as sensational or provocative like other writers I've read (who represented both of the views in this case)

lol, they do brown nose Mignini, that's not my objective. He's quicker to sue for defmation that I would ever be in his position b/c i don't think most of it really matters. i doubt he's a perfect person but he's not the Devil as you and others who are wedded to Knox's innocence no matter how illogical want us all to believe. all he did is get assigned a case to prosecute by another judge and that's what he did.

check this story out about the murder that took place with one female Laurie Swank setting up her "friend" to be raped by a group of guys, simply b/c she was jealous of her because these guys liked her more.

http://www.nbcnews.com/id/24792743/ns/dateline_nbc-crime_reports/t/conspiracy-silence/

that's one of the craziest things I've read. pretty awesome, really.

here is the testimony of Laurie Swank admitting to her role encouraging the rape of the victim by the group of men and subsequent murder http://www.youtube.com/watch?v=JMzf_GPvOd4

this is Amanda Knox. You see AManda Knox is this Laurie Swank babe. don't fight me on this.

you will begin to understand what Knox to poor Meridith was in the same vein...she wanted to teach Meridith a lesson.

one thing I always forget is that Knox expressed some jealousy over the fact Meridith wa dating one of those drug boys who was supposed to be the best looking of the bunch. meanwhile the best Knox can do is that weird looking Harry Potter weirdo Raffie. that had to hurt our heroine Knox's pride. LOL

I think for Barbie this was an open and shut case. She caught somebody inside the sealed crime scene on the morning of November 14th and in exchange for priveledged inside access to the prosecution she kept her mouth shut about the incident.

where are you getting this info if she kept her mouth shut about it in exchange for inside access?

since when has anything Knox done seen logical? you act like the murder is supposed to make sense in some way which strikes me as child like. Just re-read Knox's written declaration to the police and you will understand that woman is batty.

the reasons for murder is never all that logical unless its out of self defense.

I think they hate Barbie b/c she wouldn't dance for the Knox family like the other ones clearly do, Nina Burleigh for example. You are suppose to root for Knox if you are an American, is how they see it. not supposed to report anything that points to Knox's guilt.

Knox has a real sweat soft personality in my view and it seems silly to try to demonize her. it will be hard to paint her as some kind of zealot foaming at the mouth for them to string up Knox and the "boyfriend".

Barbie always seems to indicate she thinks it can go either way, she doesn't seem to have strong conviction about it either way, like a typical female. ;)

I was surprised her book was titled Amanda Knox: Student Killer b/c her articles at Daily Beast don't have that kind of strong conviction. she comes across as more as thinking this is all too confusing and she's glad she's not the one who has to sort it out.

I caught a clip on CNN or maybe MNSBC where she was on, she seems real laid back and dispassionate about this case. the interviewer asked her some questions and then she went off and then the interviewer talked to Steve Moore and he's just attacking her in a real mean sort of way and just redneck emotional about the case. for some reason these two didn't debate each other and they never even talked to Barbie again, so I got the feeling that she said she wouldn't do the interview if she had to argue with this guy. just doesn't mean that much to her to convince you Knox is guilty, she just wants to report what happens in the trial and what the defense says, and what the prosecution said.

hey doc, guess what? We agree on something, right or wrong thats the similar impression I had of her

yeah, Knox was so freaked out about her door being opened, the blood, the mysterious turd that she decided to take a shower, then she scotted the bathmat with the bloody footprint across the floor to her room b/c she forgot the towel. she also showed no interest in what was going on with Meridith despite her claims to the contrary. like i said, her phone call to Meridith only rang 3 seconds or so and she only tried once, and then she didn't try the other phone, which is odd if she's really concerned about her roommate. Also, she and raff claimed they tried to break down meridith's door but couldn't, but one of the guys who showed up was able to do it no problem. Knox also told the postal police that Meridith always kept her door locked so no big deal, which strikes me as inconsistent with somebody truly worried about her roommate, and probably somebody who wants to delay the discovery of the body as long as possible.

there is a lot of inconsistencies in what she claims and what she does that is seen by reviewing her cell phone records.

Nadaue made the point that there was no blood found in the rest of the house, except for the 5 mixed blood samples, which is surprising given the volume of the victim's blood in bedroom. you would think the multiple killers would have tracked some of that around into the other rooms so this is evidence of a clean up effort. also she points out that no fingerprints were found on the door to the victim's bedroom that was locked and pulled shut. so obviously they were being careful about fingerprints at that point and so it logical to believe they probably engaged in some kind of clean up effort.

LOL, or there weren't multiple killers

Reminds me of the witch test I heard on Monty Python (IIRC) where they would determine if a woman was a witch by tying stones to her and placing her in water. If she floated, she was a witch and would be burned at the stake immediately. If she sunk and drowned, then she wasn't a witch.

ok, well I've been over why there had to be multiple attackers several times. the Massei court agreed with that, and so did the court that convicted Rudy, and so did the Supreme Court that validated the Rudy conviction with the idea he had two accomplices. Just can't see the same court rubberstamping any appeals trial verdict that argues for the lone wolf killer theory to find those two innocent.
