Continuation: Discussion of the George Zimmerman case

Haven't we done the 'where are TMs hands' dance already ?

George says out, witness 6 says like a chalk outline (so out)

Page 14, report of Ayala, Ricardo.

2-1, hands out wins, unless you have a better idea. ;)

Well, we can discount George because he's the epitome of a biased witness, so that leaves John and the professional. I'll go with the professional but I know there are crime scene photos that the jury will see to resolve this.

One other item from that link I posted above:

He said: "It is very clear this witness saw what happened and clearly indicated the person that he saw that did the shooting. The other part that really strikes out for me is that he seems to have not seen the apparent injuries from this altercation that Mr Zimmerman claims that he suffered.

"It seems clear that Zimmerman's statement about Trayvon following him back to the truck is totally untrue because from this witness's statement all the interaction happened in one particular area, so I think Mr Zimmerman will be arrested very soon."

This is interesting in hindsight because it backs up what I've been saying today. This witness, according to the family's lawyer, will place the argument down by the debris field. If the start of the argument can be placed there, then George is really in trouble with his story. Also, if this witness saw him and he didn't have that bloody nose and wasn't bloody, but a few minutes later he DID, then I don't know how George explains this, do you?

Because no one says "homie" anymore. Do you know any 16 year olds?

My son, his friends. And I agree, they don't say homie. They don't have fake gold teeth, they don't get suspended from school, they don't smoke dope ... they don't have much in common with an inner city youth from a dysfunctional home, so I am not sure whether they say homie or not is important.

Well, that's where we disagree. But I think my narrative fits the evidence much better than George's.
OK, but you are not disagreeing that the state will need to prove murder beyond a reasonable doubt, are you ?

It must have been in his hand. Where else would it have been? And doesn't that make sense that it's why it was dropped? Who knows why he claimed it didn't work, but I think that was just to explain why he didn't head right back to his truck.

He claimed that is why he was tapping it, and Serino(?) agreed it didn't work as well.

You have his word on that, vs the fact that he didn't head back to the truck when he claimed he did and the fact that he ended up, with that same flashlight, all the way down by the body. Also note that in none of his walkthrough did he explain what he did with the flashlight and how he "fought back" while holding it. It just sort of disappeared as a prop. If that were a movie it'd be a continuity error.

It's a valid point, I'm curious to know where the flashlight was. Maybe it was in his pocket like TMs phone ? Unless you think TM had his phone out ?

Witness 6 no longer can tell you who is who or what they were doing. Let's wait to hear him on the stand before placing all your hope that he'll back George up here.

That's untrue. Witness 6 stands by his statement that GZ was on the bottom. That GZ was yelling for help. That TM was holding or hitting him, he is no longer sure. Those are the statements he gave SPD, and the FDLE. Why would I think at this point he will say something different ?

I am sure you know this, but the 'professionals' couldn't even agree in their reports on the color pants TM was wearing, so ....

However - Witness 6 took a photo of the body (as well as the photo of GZ head) - so we should have a definitive answer on that one.

One other item from that link I posted above:

I believe that is witness number 18 in the article - and her statements are all over the place. She lives North of the Tee. She is a sad lady looking for attention, I think.

I am not aware of anyone who saw him without a bloody nose and then he magically had one later ?

My son, his friends. And I agree, they don't say homie. They don't have fake gold teeth, they don't get suspended from school, they don't smoke dope ... they don't have much in common with an inner city youth from a dysfunctional home, so I am not sure whether they say homie or not is important.

Trayvon's older brother is a college student studying engineering. All accounts say Trayvon was was a bright, funny kid. He smoked a little weed. He got suspended from school a couple of times. Aside from that he didn't do anything worse than me at that age. Is it because his parents are divorced? Is Megan McCain from a dysfunctional home as well? Is she also an "inner city youth"? This is the kind of subtle racism that informs far too much of this case. It's sad to hear you say this.

OK, but you are not disagreeing that the state will need to prove murder beyond a reasonable doubt, are you ?

Nope.

He claimed that is why he was tapping it, and Serino(?) agreed it didn't work as well.

How would Serino know this? He was playing good cop. He was just agreeing with George to keep him talking. Let's stick to what we know. The flashlight fell on the ground and sort of disappeared from the narrative.

It's a valid point, I'm curious to know where the flashlight was. Maybe it was in his pocket like TMs phone ? Unless you think TM had his phone out ?

Yes, I think his phone was out in his hand and George was holding his flashlight. I think George had wandered down toward where the confrontation happened with his flashlight out looking for the "suspect".

That's untrue. Witness 6 stands by his statement that GZ was on the bottom. That GZ was yelling for help. That TM was holding or hitting him, he is no longer sure. Those are the statements he gave SPD, and the FDLE. Why would I think at this point he will say something different ?

Because he's already changed his story once? I'd like to hear him on the stand before anticipating what he'll say.

I believe that is witness number 18 in the article - and her statements are all over the place. She lives North of the Tee. She is a sad lady looking for attention, I think.

How could you possible know who she is, whether or not she is sad, that she is looking for attention, and that she is all over the place? Talk about confirmation bias. You should be embarrassed by this.

ETA: Even if he Trayvon was on top and even if George was panicked for his life, if George followed and pursued Trayvon, which is what all the evidence points to IMO, he would still not have a defense against murder. You don't get to provoke people and then claim self-defense. If his claim of heading back to the truck and then getting jumped falls apart and the state can convince the jury George went looking for Trayvon again after that call, he's at fault and can't claim SYG.

No, this is totally untrue. The law states that if you are at fault for starting the incident, you must attempt to withdraw before being able to claim self defence. Even if GZ did start it, if Trayvon was sitting on him preventing him from withdrawing, then if GZ was in genuine fear for his life, he was legally entitled to shoot.

If this wasn't so, then if you followed someone and they decided that was provocation enough to attack you, then your two choices would be to either allow them to beat you to death, or commit murder. That's just stupid.

I know. But he was let back out on bond again.

Yeah, for a bond amount nearly ten times the original, and with much stricter bond conditions. And the new judge denied the defense's motion to amend the conditions of the bond.

So remind me... why did the bond amount go from $150,000 to $1 million, and why is Zimmerman required to wearing a GPS tracking device and not allowed to leave Seminole county? Why is he not allowed to have a bank account? Why he is not allowed to go near an airport? Why is he not allowed to possess a passport? Why does he have to report to the authorities every two days?

No, I'm saying he and his wife could have been done in buy an attorney telling them exactly what GZ said he told them. That 37k GZ mentioned doesn't amount to a spit in the ocean of what MOM anticipated he would end up spending for court costs, etc.

They had in excess of $150,000. Read the motion to revoke bond.

He didn't have hundreds of grand at that point in time, IIRC. Again, IIRC, everyone was quite shocked that he had raised as much as he did. If MOM thought the defense fund was going to amount to 40-50 thousand dollars, I don't think it beyond the pale to suggest that he ignore that while considering filing for indigency.

They had in excess of $150,000. Read the motion to revoke bond.

So here's the real question for you TheL8Elvis: If O'Mara lied to the court, and Zimmerman is aware that he lied to the court, why does Zimmerman still retain O'Mara as his attorney? Why does Zimmerman trust the man who thoroughly screwed him over with his life?

No, this is totally untrue. The law states that if you are at fault for starting the incident, you must attempt to withdraw before being able to claim self defence. Even if GZ did start it, if Trayvon was sitting on him preventing him from withdrawing, then if GZ was in genuine fear for his life, he was legally entitled to shoot.

Zimmerman tells conflicting versions in which he immediately went to the ground after being punched, and another in which the fight moved and he stumbled around before being taken to the ground.

Since one of those versions would allow him an opportunity to withdraw, how do you know which one to believe? Is is it automatically the version that benefits his self-defense claim?

Really which one? Since Trayvon didn't have any injuries indicating he had been struck during the fight, any fight that moved would have had to consist of GZ, the only one with fight injuries, being struck by Trayvon, the one without fight based injuries, and followed as he stumbles backwards. At which point in that was there a chance to withdraw?

Now that assumes that the fight occured as claimed, which is basically from the first claimed punch, until the gun was fired.

Or is it your contention that, on the assumption that his story is correct, GZ could have run away while being attacked and beaten by Trayvon?

Martin also didn't have any fight-related injuries on his hands.

So maybe the magical healing properties he possessed to remove any trace from his hands of the blows he was raining down on Zimmerman also extended to his face and head? I don't know. I'm just spit-balling here.

If Zimmerman was still on his feet, he still had the opportunity to run away. After all, he wasn't yet helplessly pinned under a teenage boy he outweighed by 50 pounds.

And then there's the fact that Martin's body was found almost 50 feet from where Zimmerman claimed the altercation began. The stumbling seemed a justification for how Zimmerman ended up so far way from where the fight supposedly began.

So if he's stumbling around for 50 feet or so, seems ample opportunity to flee.

Now that assumes that the fight occured as claimed, which is basically from the first claimed punch, until the gun was fired.

Or is it your contention that, on the assumption that his story is correct, GZ could have run away while being attacked and beaten by Trayvon?

People on their feet and moving around up to a distance of 50 feet would seem likely candidates for someone who could run away, yes.

So was Zimmerman on his feet from where he claims the fight began to the point where Martin's body was found, or did he immediately go to the ground?

Martin also didn't have any fight-related injuries on his hands.

I guarantee they will try to refute you by bringing up the tiny 5 mm (was it even that long) scratch on one of his hands.

And there is no way that scratch could having come from using his hand to block a blow!! Impossible! Why? Well simply because it doesn't fit the pro-Z mindset.

No injuries on M means Z did not attack. Do not even consider that it might mean that Z is just a failure at attacking...

He did have a minor cut on his hands, but as someone that used to do a lot of fighting when I did Karate, I can say quite definately that you are more likely to show injuries as the reciever of a punch than the thrower. The whole busted and bleeding knuckles from a few punches thing you see on TV is a bit of a myth.

If you look for this video on YouTube (v=78Bokbfc170) you'll find a bare knuckles boxing match. Althought the quality is poor, you can see that the hands of the guy in the jeans don't appear overly damaged even after 7-8 minutes of fighting, and several blows being landed that are enough to stagger his opponent.

(I'm not properly linking to it since to my knowledge it depicts an illegal event and so I'm not wanting to break any rules around that.)

If Zimmerman was still on his feet, he still had the opportunity to run away. After all, he wasn't yet helplessly pinned under a teenage boy he outweighed by 50 pounds.

Yes because it is so easy to run away when someone is following you throwing punches. It's almost like you have never been in a fight before.

As to the whole 50 pounds thing, it's a total red herring. Again, I know as a fact that size (and Trayvon was actually taller) and weight have very little to do with winning a fight or being able to take someone down and pin someone, especially when that 50 lb, and a bit more, is fat not muscle.

And then there's the fact that Martin's body was found almost 50 feet from where Zimmerman claimed the altercation began. The stumbling seemed a justification for how Zimmerman ended up so far way from where the fight supposedly began.

Well we also know from the witnesses that the fight moved, not just from GZ, how much, no one knows. I personally suspect that if GZ was at the T when TM appeared, that the more likely explaination is that the two of them closed with each other as they exchanged words.

So if he's stumbling around for 50 feet or so, seems ample opportunity to flee.

As noted above, I personally don't believe that the fight started at the T, so I doubt that the fight moved fifty feet. Also TM's body was only around 40 feet from the T, not fifty (that was the phone) If both men had walked towards each other at the beinging where TM is alledged to have demanded why GZ was following him, and GZ was demanding to know why TM was there, the fight could easily have started 15 to 30 feet from the T depending on how far away TM was when he challenged GZ. (eg. if he was 20m away and they both closed the same distance, that would put them 10m or 30 feet from the T)

People on their feet and moving around up to a distance of 50 feet would seem likely candidates for someone who could run away, yes.

Again I'd have to ask if you have been in a fight.

So was Zimmerman on his feet from where he claims the fight began to the point where Martin's body was found, or did he immediately go to the ground?

No one knows since no one else was there, which includes the two of us. Speculation and based on other witnesses, I'd say there was some movement though how much, no idea. Based purely on my speculation above, anywhere from 10 feet to 25 feet.

But hey, I guess it's about the only thing someone dedicated to believing Martin punched Zimmerman repeatedly can say when neither Martin's hands nor Zimmerman's face exhibit signs of repeated punching.

A Youtube video of a single instance that supposedly supports something you're claiming as a generality? Wow. Now I am convinced.

Yes because it is so easy to run away when someone is following you throwing punches. It's almost like you have never been in a fight before.

Please explain what about either being punched or being followed in a wide open area prevents one from running away.

Another bare assertion. I find it almost as compelling as your last one.

Something that does not exist in any of Zimmerman's statements.

Do you just automatically believe whatever version of events best serve Zimmerman?

And if Zimmerman did approach Martin, after following him in the dark, at what point did Martin have the right to feel threatened and defend himself? Or is Zimmerman always the victim no matter how many times we rearrange the facts to suit him?

As noted above, I personally don't believe that the fight started at the T, so I doubt that the fight moved fifty feet. Again, you're manufacturing details that Zimmerman did not claim. But I can't say I blame you. I'm not sure how else someone would be able to make sense of all the things he says otherwise.

Again I'd have to ask if you have been in a fight.

Perhaps I've just never fought someone with super-human strength and speed that prevented me from running away because his devastating punches somehow made my legs stop working.

No one knows since no one else was there, which includes the two of us. Speculation and based on other witnesses, I'd say there was some movement though how much, no idea. Based purely on my speculation above, anywhere from 10 feet to 25 feet.

So the fight moved and Zimmerman was actually standing and free from Martin's inescapable death-pin for an area of 10 to 25 feet (a detail Zimmerman obviously forgot to mention because of trauma), but even though they were in a wide open area, Zimmerman was completely and totally unable to escape.

Is that because Martin could teleport?

Or maybe he had stretching powers like Mr. Fantastic so that no matter how hard Zimmerman tried to get way, Martin's punches always found him?

I'll guess we'll never know. The only thing we can be sure of is that despite the changing and conflicting details of Zimmerman's various accounts, there was no possible way he could have escaped Martin's unrelenting murder attempt. That's just a fact.

I guarantee they will try to refute you by bringing up the tiny 5 mm (was it even that long) scratch on one of his hands.

Apparently it's a myth that people's hands are injured when they punch someone, so that scratch couldn't have been from a punch because of karate science.

And there is no way that scratch could having come from using his hand to block a blow!! Impossible! Why? Well simply because it doesn't fit the pro-Z mindset.

Or it could have been a paper cut. One thing we know for certain, it wasn't from a punch, because it is scientifically unpossible for a hand to receive an injury from a punch. Silly stuff like that only happens in the movies.

No injuries on M means Z did not attack. Do not even consider that it might mean that Z is just a failure at attacking...

Yeah, we now have a version of events in which not only did Zimmerman follow Martin, but he actually approached him. Apparently, in that scenario, Martin was just supposed to wait and see what happened and not feel at all threatened.

Yeah, we now have a version of events in which not only did Zimmerman follow Martin, but he actually approached him. Apparently, in that scenario, Martin was just supposed to wait and see what happened and not feel at all threatened.

But seriously, this is progress. This actually matches what DD said happened and explains why they ended up so far south. I agree that George likely approached Trayvon, and it sounds like others are slowly coming around to accept that the action likely didn't happen at the T like he claimed. Baby steps.

So it's a myth because you say it is?

No it's a myth because I have actually been in bare fisted fights where people ended up with bleeding noses and black eyes and didn't end up with bleeding and bruised knuckles. I'm talking from actual experience of having been in fights, hence why I questioned if you have been.

But hey, I guess it's about the only thing someone dedicated to believing Martin punched Zimmerman repeatedly can say when neither Martin's hands nor Zimmerman's face exhibit signs of repeated punching.

See this is why I dropped out of this thread months ago. Some people stake out their camp of belief and then paint anyone that doesn't agree with them as being in the diametrically opposing group, if they aren't with you, they are against you, if they don't believe the same, they must believe the exact opposite. It's an absolutely dumb position to take, and yet time and time on this board of so call skeptics it happens.

I am not "dedicated to believing Martin punched Zimmerman repeatedly". I have no idea if he repeatedly punched him or not, and neither do you, unless you were there. All I am saying is that forming a belief that it didn't happen because Trayvon's hands weren't damaged is wrong, as having personally experienced fights and punching people in the head and nose, and being repeatedly punched in the head and nose, your hands don't end up battered and ripped up.

A Youtube video of a single instance that supposedly supports something you're claiming as a generality? Wow. Now I am convinced.

I'm not claiming it as a generality, I'm saying that the claim that hands are always damaged and bruised is wrong. To bust the claim that Trayvon's hands must be damaged if he repeatedly punched George, only one instance needs to be shown.

Please explain what about either being punched or being followed in a wide open area prevents one from running away.

Seriously? Have you never been in a real fight? For a guy with Karate in his name you seem rather unlearned about them. The first thing an untrained person does in a fight is basically curl up to protect their head and upper body from the hits, that is why when you train in a martial art or boxing you do a lot of practice fights to learn about getting hit and how to control the instincts to protect your head and vital organs. The last thing that is going through the mind, especially when the attacker follows you as you go backwards is to run, the first is to protect yourself from the blows.

Another bare assertion. I find it almost as compelling as your last one.

Once again I really have to question if you have ever been in a fight. If you ever do find yourself in a fight, especially against multiple opponents, the small one is the most dangerous.

Something that does not exist in any of Zimmerman's statements.

Well duh, could that be why I said "I suspect" as in I am speculating that this occured?

Do you just automatically believe whatever version of events best serve Zimmerman?

As you just said, GZ never stated that.

As to the rest of it. YOU were the one that created this senario, you brought it up, and I have been working on the speculation that the senario YOU brought up was the correct one, I even noted this mutliple times

I personally suspect
Speculation and based on other witnesses
Based purely on my speculation above

Get it? I'm speculating on the senario you created based on the evidence available. It has nothing to do with what GZ said. Based on the other evidence I don't believe he got most of it correct, but that doesn't mean that by using logic and speculation based on witness statments I can't come up with something that actually fits the evidence.

And if Zimmerman did approach Martin, after following him in the dark, at what point did Martin have the right to feel threatened and defend himself? Or is Zimmerman always the victim no matter how many times we rearrange the facts to suit him?

You don't have a right to "defend" yourself against someone doing no more then following you, even if it is dark. Having said that, it's clear from the 911 call that GZ lost sight of TM and even DeeDee claims that TM told her he had lost GZ, so you'll have to really pull some magic out of your backside to show that GZ was constantly following TM throughout the entire time.

Following someone is not illegal, in the light or in the dark. Punching someone for following is illegal. (and that's just a general comment there not a claim that TM punched GZ for following him.)

Again, you're manufacturing details that Zimmerman did not claim. But I can't say I blame you. I'm not sure how else someone would be able to make sense of all the things he says otherwise.

Shucks, perhaps that is what speculation means. Funny you accuse me of believing GZ's story and then you accuse me of making up things that aren't in his story. Which is it? Am I follow his story or not?

The reality is that I am following the evidence. The evidence is that regardless of what George says, the fight started below the T, and reality says that if someone approaches you demanding to know things, then it is entirely natural to close the distance to get into speaking range, you don't just stand there waiting for them to get to you looking like a knob. We do these things automatically without even thinking about it.

See this is what I meant right at the begining. I looked at the evidence, evaluated it and determined the logical actions based on the what the witnesses were saying and the other evidence. I then came to a conculsion on what I suspect happened based on that evidence. It has zero to do with what GZ claims, other than taking it into consideration with the other evidence. In most cases I think GZ's claims are wrong, that things didn't happen as he claims. But because my conclusions don't match your's, you instantly assume I am in the GZ camp and believe everything he says. You are so blinkered by your own biases, you can't see the forest for the trees.

Perhaps I've just never fought someone with super-human strength and speed that prevented me from running away because his devastating punches somehow made my legs stop working.

From your postings I really have to question if you have ever fought anyone in a real fight. Strangely enough one of the first thing we learned in Karate is that all those fancy kicks you learn mean nothing in a real fight because your legs will go wobby and stop working. The fact you think that it is easy to just disengage from someone throwing punches at you and run for it also speaks volumes.

You really have never been in a fight have you? Do you honestly think that people stand back and thrown punches from four or five feet away from each other? Perhaps you need to watch more boxing matches. Not really a good example of street brawling, but you'll quickly see that they go into a "huddle". It happens in real fights too, because by grabbing and holding your opponent you can limit their attacks on you. Real fights are closer to wrestling matches with punches being thrown at close quarters than two people standing waving their fists at each other. The only time you really get fighters standing back and circling each other is either at the very start, or where both have classical training of some sort.

Is that because Martin could teleport?

Or maybe he had stretching powers like Mr. Fantastic so that no matter how hard Zimmerman tried to get way, Martin's punches always found him?

If you actually knew more about fights happen in the real world you might be funny, as it is, really?

I'll guess we'll never know. The only thing we can be sure of is that despite the changing and conflicting details of Zimmerman's various accounts, there was no possible way he could have escaped Martin's unrelenting murder attempt. That's just a fact.

Again you really have no idea do you?

~~~~
So George really screwed up. 20m away when they sighted each other. How about George doesn't try to close that distance?
1, Less threatening
2, It's going to take Martin 12-15 seconds to closed the distance,
That's time for George to provide a lot of information
"I'm George, of Neighbourhood Watch on patrol. just wondering, are you local?"
"Perhaps we stand where we are. The cops are on the way, they can sort it out.
"Again stand back, I am armed and will defend myself"
SYG defence slam dunk.
No, this is totally untrue. The law states that if you are at fault for starting the incident, you must attempt to withdraw before being able to claim self defence. Even if GZ did start it, if Trayvon was sitting on him preventing him from withdrawing, then if GZ was in genuine fear for his life, he was legally entitled to shoot.
So if you want to get rid of someone in a SYG state you just need to start a fight with that person and pretend to be losing it? Talk about a license to kill...
So George really screwed up. 20m away when they sighted each other.
Don't take that distance as set and truth, I'm guessing based on lighting and what I think occured. It could be less, though I doubt it was more.
How about George doesn't try to close that distance?
I think they both did, which is natural. If someone is talking to you and moving towards you, it's natural to respond by moving towards them.
1, Less threatening
If someone is walking towards you and talking to you, walking towards them isn't actually a threatening action, in fact exactly the opposite, we consider it a form of politeness. It's considered rude and agressive to make someone walk all the way over to you. In fact we even have a saying about it. Meeting someone halfway.
2, It's going to take Martin 12-15 seconds to closed the distance,
"Again stand back, I am armed and will defend myself"
You won't get an arguement that the alledged response to the alledged challenge would be dumb and that identifying yourself would have been far more logical, however most people don't just stand there looking silly as someone comes over to them for the reasons given above.
SYG defence slam dunk.
Except that if he had not moved for that reason, I'd be standing in line to say guilty. That or giving him Randi's million because he'd be either have killed in a premediated manner, or was psychic.
Once again I really have to question if you have ever been in a fight. If you ever do find yourself in a fight, especially against multiple opponents, the small one is the most dangerous.
So you complain about film stereotypes (which ones I don't know, most movies show the hero's hands unbruised after a long fistfight), and then you have the audacity of advancing an anime trope?
The small one is the most dangerous?!? Why? Is he over 9000?
That is a bloody idiotic thing to say, and there's a lot of idiotic thing said in this wreck of a thread... One small reminder: LARP is not fighting, and D&D character sheets don't apply to real life.
Sheesh... you were really using the "I doubt you've ever been in a real fight" gambit?
