#3 is the part he needs to be worried about. Even if he skates on the shooting, he is almost certain to be convicted of that should they pursue it.

Even the judge wondered out loud why they didn't pursue it today. I would guess it is because they know the hole in their case, and the judge doesn't.

You are simply fantasizing into Nancy Grace/Sylvia Browne CT territory one more time.

If the judge was pissed at anyone, it was because the prosecutor *failed* to cite that, and he very specifically pointed that failure out.

He also called the prosecutor on his blatant lie about the passports.

Zimmerman can have a hearing for increased bond based on his actual assets any time he wants it.

The spin is all yours.

In fact, I think that inability to mount a defense is strong evidence that he was not prepared for the assault - which shows that he did not initiate it.
EXACTLY! ^^^ This, 1000x over ^^^. It amazes me that so many people that want to vilify GZ as the violent aggressor who "chased down Martin intent on not letting him get away" don't get the above. If GZ was the violent aggressor who was intent on chasing Martin he'd have likely been ready with hand on gun, and not caught by surprise. Instead I think he wanted to keep an eye on him from a distance, was in fact careless and had no idea TM was close by, and was therefore caught by surprise. That makes sense, it fits with his story, it fits with the evidence, and fits with how he got beaten up.

Correct... and the judge said he wasn't going to entertain 3rd party speculation from O'Mara on what Zimmerman might have been thinking, he wanted to hear Zimmerman explain it himself.

Only then can the judge legally decide if Zimmerman was deliberately defrauding the court or not, and if he should get a higher bail or not.

You'd think if GZ thought he could use that money for bail, he wouldn't have used the houses as collateral.

Anyway, if the state wants to put GZ in jail for murder 2, he'll have to be very lucky or have very good lawyers to stay out of jail.

Based on what? So far, all the prosecution has offered is allegations of 'inconsistent' statements, which isn't even close to 'proof beyond a reasonable doubt'.

Either they are hiding something (which after their passport lie, wouldn't surpise me), or they are going to need all the luck.

He wondered out loud why the *prosecution* didn't bring that up... and after his calling them on their passport lie, the answer is very likely that they can't meet the burden of proof for that crime either.

I think O'Mara needs to get this cleaned up quickly and get Z back into hiding. I think the state has a very weak case and is in bad need of a "jailhouse confession", which can't happen if he isn't in jail.

Yup- Zimmerman was a racist, see. He doesn't like darkies. He was also a violent person. Hell, he even tried to beat up a cop. So one night, Zimmerman hits the Daily Double - a young black kid to beat up - and he brings nothing? Really?

I'm not sure the implicit assumption that he would either be going for a kill or not doing anything is a wise one to make. Leaves out such possibilities like he was attempting to give him a good hiding without using lethal force. Which might have blown in his face.

ETA: I'm glad we aren't doing false dichotomies here. Because that would be... sad.

I missed it. Can someone fill me in on the passport lie? I was hoping someone uploaded it to youtube but can't find it.

The passport was a non-issue. Zimmerman lost his passport some years ago and applied for a new one. When he was arrested and set free on bond, he handed his passport to O'Mara to surrender.

After he left custody, he packed his stuff to move because of the issues surrounding the case. In the course of packing, he found the old passport and self-reported that one to O'Mara. O'Mara drafted a notice to the court of the new passport, but failed to file it.

It sounds a bit like a fish-tale, but O'Mara wisely printed the directory listing to show the creation date of that file and provided that to the judge, along with the old passport, when he was in court today.
 
Well, thumbnail sketch, GZ is still his own worst enemy, the judge seems sharp, the prosecution is slimy, O'mara is capable, but has his hands full with GZ.
