Would it not be simpler to assume the lack of one negates the need for the other?
 
Do you not think that might be of some benefit to find out before continuing with this particular discussion? The fundamental principles of the system in the US might be of some help before you continue to refuse to believe that something you know nothing about works differently to your imagination?

I still doubt that attorneys will just accept all kinds of crazy claims in lawsuits. They must have some form of professional pride, if nothing else for their future reputation.
 
The thought experiment I gave was about the wife LYING about the husband raping for example their 2-year-old child. The man's reputation in society will get totally destroyed and it will take months or even years before the lawsuit is settled. Can a wife really file such lawsuit and get away with it?


Oh so parity hurts, what is the husband is the one lying? I think that there would be a forensic examination of the child, and whatever other evidence there.

Holy smoke! That's really scary. Some people love to hurt other people for example (sadists) and the legal system may be severely misused.
Oh my people abuse a system, imagine that. So you would screen out suits without having a judge hear the evidence?
Other people want to get rid of their competition and can do nasty things for that reason if they are sociopaths or psychopaths. At the same time people must be allowed to file lawsuits, because what if some outrageous claim turns out true after all. Nasty situation. Very nasty.

And when there is no evidence what happens then?

My point is that if a wife for example falsely accuses her husband of having raped their 2-years-old child, then the man's reputation will go down the drain. Because it may take a long time before the truth about the matter is known. And then it doesn't matter that he is completely innocent. The lawsuit will cause harm even when as in this example it is a completely fraudulent claim.

No. Not all lawsuits are criminal matter. You are describing CIVIL action being brought against the imaginary father. How do we know? Because the mother is suing him in a lwasuit rather than pressing charges with her local law enforcement agency.

Civil, Licensing, Matrimonial, and Criminal law are entirely seperate entities.

Knowingly filing fraudulent lawsuits is illegal I have been told today. So that means that Keenan likely filed the lawsuit at least himself believing it to be valid.

Well the first step would appear to be go on the internet and tell people it is all true honest. Then some doofus believes it with out question, comes here, and displays his ignorance of the legal system he started a discussion about.

Well, who says that there are not, for one thing you can be sued in a counter suit, and for defamation, libel and slander. A judge might find you in contempt of court, you might be charged with the criminal offense of perjury.

And you think lawyers prejudge cases, I means eriously they do what they get paid for.
