The House Judiciary Committee passed a bill yesterday that would make it a federal crime for U.S. residents to discuss or plan activities on foreign soil that, if carried out in the U.S., would violate the Controlled Substances Act (CSA) -- even if the planned activities are legal in the countries where they're carried out. H.R. 313, the "Drug Trafficking Safe Harbor Elimination Act of 2011," is sponsored by Judiciary Committee Chairman Rep. Lamar Smith (R-Texas), and allows prosecutors to bring conspiracy charges against anyone who discusses, plans or advises someone else to engage in any activity that violates the CSA, the massive federal law that prohibits drugs like marijuana and strictly regulates prescription medication.

Surely this should be struck out on 1st amendment rights.

"Hey, while we're in Europe, let's pop over the border to Holland and have a couple of joints" 10 years in the slammer.

The bill:

To amend the Controlled Substances Act to clarify that persons who enter into a conspiracy within the United States to possess or traffic illegal controlled substances outside the United States, or engage in conduct within the United States to aid or abet drug trafficking outside the United States, may be criminally prosecuted in the United States, and for other purposes.

People in the US can be prosecuted for conspiring to traffic drugs overseas. Simple solution; Don't conspire to traffic drugs. I think the Huffpo article blowing things out of proportion.

Do you suppose the drongos who found time to legislate this sort of crap could find time to do something about stopping the mortgage companies from throwing everybody out in the streets?

I posted in another thread about the wisdom of "cracking down" on the medical marijuana movement in California... Which appears to be the only profitable business in the state and one that's generating large amounts of tax money for strapped local cities.....

You left out the words "to possess" it's not just trafficking (why did you do that?). So what if it were? In some countries it's probably legal to traffic what the US deems to be illegal. Goto central america and coca is acceptable why would the federal authorities care that someone picked a few leaves and gave them to a mate. Lock 'em up for dealing in cocaine - 10 years yer 'onour

That's not even allowed in Holland any more, unless you're Dutch.

Wrong. It's currently still possible and legal to hop across the border and buy yourself weed as a foreigner. Bringing it back is a different matter, and depends on your own country's laws, not the Dutch one(s).

Stop getting hysterical over nothing.

It's interesting to see how much intrusive legislation is being sponsored in the name of safety.

I am reminded of the old comment by Benjamin Franklin

He who gives up liberty for safety deserves neither.

The law is pretty much clearly unconstitutional, but that won't help the poor suckers who get harrassed for existing. Come on, how can they even gather data? All they can do is operate on hearsay evidence and the "tips" provided by people with a grudge to settle.

But DEA is a bureaucracy. They, naturally, need and want to expand.

And maybe they want nice cozy SAFE places to operate in. Not like the Texas border....no...no....no...

The constitution allows drug trafficking?

When will this god damned 60s generation die and get the eff off the face of the earth?

They had kids, got jobs in state bureaucracies and they taught the next generation in schools and universities.

Absolutely not. We need to keep the fat cats happy, and the poor downtrodden are like so many catnip stuffed mice.
