Let's see. A guy pulled out a genius, brilliant job of removing all of his traces from the crime scene and it didn't occurred to him to not base his alibi on easily provable lies? I don't think I'll buy it.
Why wouldn't he include true verifiable facts in his alibi, that he had plenty at hand? Where is Popovic in his story? What about that phone call from his father? What about that cartoons and movies he watched? No mention of Naruto in his story, no mention of Amelie. Why would he lie in such a way?

Can you piece it together somehow? It's not the first thing that doesn't add up in your version.

Remember they turned off their phones as part of their well thought out plan. Even though, I think it was stupid because it would have been better to leave the phones at Raf's and on thereby any texts or call would ping there and add to their alibi, but their turning off their phones clearly evidence that they had a plan, according the Mig.

So we know they had a plan (probably hatched on their first pizza date) and Raf would clearly think that the computer could provide some proof. So just before they left he would put on a long movie or music that would play for hours. If they forgot this part of the plan, he could always just say he was having sex and having more sex and sleeping and...

What someone writes in a journal while being held in solitary doesn't seem like viable evidence of anything. Didn't he also write extensively about the total weirdness of being charged for something he knew nothing of?

I'm surprised that they didn't record him talking in his sleep and use that as evidence, because we all know that dreams are always realistic.

The argument about the cops playing around with Raff's computer while he was incarerated revolves specifically around the last access records.

The last access record for Stardust is the one where the cops opened it at the station (hopefully not a deliberate overwrite)

No. The Last Access is the last time a portion of the file was accessed.

There is another timestamp, the Last Opening that is modified when a file is opened, for example by a player. This timestamp remain the same until the file is opened again, while the Last Access timestamp continuosly advances as the file is played and at the end keeps the closing time, that is when the player is shut down or you Close the file.

For example Amélie had the last Opening timestamp of 18:26 and had the Last Access time of 21:10.

I don't know of the Last Opening timestamp of Stardust, but the silence of the defence about it tells something. :)

The Spotlight database is diferent from these. The above are file timestamps that are automatically handled by the system for all files, while Spotlight is a database which is notified by Spotlight-aware applications to record various data. Even though Naruto's timestamps have been overwritten in the days after Nov 1/2 the player sent a notiication to Spotlight and that has been preserved.

I don't know if Stardust has such a Spotlight Opening record, but it should if it was indeed played. The last playing time should be definitely there.
Again no boasting of it by the defence, so probably there is not.

None of the basic foundations of actually proving the case have ever been satisfactorily addressed by the prosecution.

Perhaps some of the guilters can start with answering the basic question in proving a defendant's guilt and address these fundamental questions?

The facts as best as I can gather from this case.

Meredith Kercher was killed sometime between 21:00-23:59 on Nov. 1, 2007. RG's DNA should not have been located on her body.


Connection between the killers?

The prosecution never supplied any connection between RG and AK other than a few inconsequential exchanges of salutations and perhaps some small talk. The prosecution failed to provide any evidence at all that RG and RS have ever met outside of court proceedings.

I have never read of a case where three people have come together without a basis or foundation of a minimal acquaintanceship (never mind the limited ability to communicate due to Amanda's weak native language skills at the time) and kill a person. I cannot rule out the possibility of this phenomena happening, but the prosecution never gave any proof of its existence in the form of anything such as expert's testimony, etc.


Motive?

The prosecution alleged at least five different motives in the original case.

1. Sex game gone bad
2. Drugs
3. Robbery
4. Hatred/Jealousy towards MK by AK
5. AK is a sociopathic killer.

Which would be fine if they had bothered to prove just one of those theories.

Let's look at the the last one just for fun, since that seems to be Mignini's M.O. for prosecuting and gathering facts. If AK were a sociopath, there would be a history of violence, or at the very least serious anti-social behavior in her past. Fights and criminal charges would suffice to show a pattern. At the very least, there should be a record of educational (teachers/administrators) or psychological evaluations that raised red flags. The prosecution provided not one shred of evidence supporting this assertation.

Opportunity?

The prosecution alleges the crime occurred around 23:00-23:30 which contradicts Mr. Curatolo's testimony (AK and RS would be otherwise occupied) putting the two at the cottage on the night in question, if he is not already disqualified as a credible witness by his heroin usage and his confusion over the night in question (in regards to non-existent disco busses running on the night in question).

The more likely time of death is probably around 21:00-21:30 due to the digestive process found on the victim, given the testimony of her friends she had her last meal, and the known facts of her last hours.

The prosecution never supplied any connection between RG and AK other than a few inconsequential exchanges of salutations and perhaps some small talk. The prosecution failed to provide any evidence that RG and RS have ever met outside of court proceedings.

The ony credible witness puts AK and RS at RS's place at 20:45. So, the only thing we know for reasonable certainty, if we disregard AK and RS, is that the couple were outside the cottage on the night in question with RG nowhere in sight.

In Conclusion

For the guilters, here is a thought experiment. Imagine some rich bitch is accused of murdering her husband. We all know she did it. The prosecution claims the motive was money, she was having an affair, and she hired a close friend and an limited acquaintance to kill her husband. Case closed.

Except, they never provide any evidence of any adultery, or any financial incentive. The two people she supposedly hired have no history of murder for hire. There is no evidence of any conversations, statements, or payment that would implicate her or one of the alleged accomplices. The murder weapon is never located. One of her alleged hit men was a small time burglar whose DNA was located at the scene of the crime. The accused has no record. Finally, throughout the trial the prosecution and police continually are found to be guilty of lying and misconduct.

What is more likely the accused with no history of violent acts or a criminal record orchestrated a murder or was even involved? Or the person with history of breaking and entering with a knife panicked and escalated his criminal behavior?

If this crime happened the way the prosecution claims, then it was a highly improbable occurence and they need to meet a high burden of proof to prove their case. Unfortunately, the prosecution never bothered to meet even the minimum level.

Which is why I find the whole affair so nauseatingly frustrating. Barbie Nadeau's latest "guilty or innocent-it's complicated" crapfest has sent me over the edge. No, it's not too complicated, if you can ever bother to think critically for yourself and not hide behind the safety of the crowd. Not to mention how she tries to minimize her involvement in creating this circus. Nadeau is the Judith Miller of this sordid affair. It takes stenographers like them and the masses blind faith acceptance of their dictation to create these sorts of clusterf@*#$. Valerie Plame got pilloried while Scooter Libby got fast tracked and his sentence suspended on his way to an eventual presidential commutation, while Bush, Cheney et al got away scot-free. In this case, Amanda Knox has been demonized as Rudy Guede has gotten his sentence continually reduced, while Giuliano Mignini, et al have so far gotten away scot-free.

Similar to Toto, high on heroin, he mistook the Oct 31 and confused with Nov 1. This is why the Prosecution dropped the "1am Story" from their theory. Not to mention the fact that Meredith was alive on Oct 31, making it all non-critical for the investigation.

This was such a glaring factual error, I did not even bother with all the rest of the very lengthy 'argument' against guilt and mostly against those who believe in guilt.

This was one of the umpteenth things in the Massei Report pushed me towards innocence. The way Massei made a long break of no activity as so sinister and obviously evidence of guilt, when there was a 10 hour break on Nov. 1 when AK, MK, and RS had no activity on either of their cell phones. Are we sure the three of them didn't kill someone earlier in the day? Perhaps we have finally find our motive.

I liked the reminder that the prosecution avoided their complete failure in connecting the three , there was not even one spec of evidence, they had met up with Rudy on Nov 1.

They had failed horrifically in bringing Rudy into the multiple person theory.

Meo Ponte, noticed this from day 1 and was a main factor why he called it a prosecution's case built on fiction.

He deliberately lied about Popovic, going out, his father phone call and SMS, not watching movies that he watched, browsing web when he didn't, not listening to music when he did listen etc. To make up so many lies when he had very good, corroborated truth in those time periods, it was quite an effort, but to what purpose?

He could have said less defeatable versions but he underestimated the interrogation.

Just think of his reply to his father about walking around with the penknives: "Those idiots can't find it". And he went in the police station with the knife. You probably say that it is a sign of innocence, but it is only a sign that it was not a murder weapon. Otherwise it is a sign of stupidity even from a fully innocent man, there was a reason that his father had warned him.
He was smart enough to selectively erase his DNA, fingerprints, footprints. Now you say he told the lies because he was dumb? I don't buy it. Even a cretin would think hard about his alibi after such a horrible crime!
Anyway, neither he, nor Amanda could name the film they allegedly watched that night.

Do you mean Amanda didn't tell him and he had no idea Popovic called off the ride? That makes no sense, why didn't he drive out as agreed before? And why did he lie about it? Why lie about not meeting Popovic at all? What was he trying to hide?

If you mean the call around 20:42 then it is out of the time of interest.
The other call, which would have been at the right time around 23:14 and would have provided a very good alibi, however, miraculously could not make it to his phones.

Are you trying to say that Raffaele lost hist mind because of the pressure of interrogation and hallucinated imaginary calls and imaginary events in place of real ones?
But didn't he lie cunningly? And those were purposeful lies - he didn't admit to watching the movies; He tried to hide that 2:42 phone call; he lied about midnight ride with Popovic (!). He decided it's better to tell the obvious lie about going out and then browsing the web then admit to all those things..

There is only Naruto. He could not name any of those famous cartoons and movies he allegedly had watched and none were found, either.

Someone does not even have to be in an altered state to give a confused recollection. Memory is so overated. One night as an exercise (in following another convicted, but likely innocent case) I had dinner with four other people. After the dinner, I wrote down everything as best as I remembered it, what everyone ate, the order of the evening, topics disscussed, times, etc. Then the night before we met for our weekly dinner, I talked with the other four and asked them to describe the events I recorded. Two of the people got most of the "facts" basically right but had a few things wrong, the other two's version of the night was dramatically different than what transpired. None of them were lying, but they would be framed that way by a prosecutor.

This is a one time opportunity for the innocent side to inform the media that there is very simple, logical and obvious explanation for Meredith's murder. Many in the media do not seem to understand that. If they understand it they might actually report it. If the media report it the average Joe might understand it. The average Joe will not figure it out by himself.

An understanding of the most obvious explanation of the murder is the most powerful way of showing how ludicrous the prosecution's theory is ... in my opinion.

The explanation:

  • The perpetrator was a cat burglar.
  • One who was described as very dangerous.
  • One who had threatened occupants with a knife when caught.
  • One who would throw a rock through a window to gain entry.
  • One who had broken in through a second story window.
  • One who had been caught and released without charge by the police.
  • One who admitted to being with Meredith that night.
  • One who left his fingerprints and his shoe prints embossed in Meredith's blood.
  • One who left his DNA inside Meredith.
  • One who left his DNA on Meredith's purse.
  • One who was known to the police by the name of Rudy Guede.

This cat burglar Rudy Guede broke into the cottage that night. Meredith came home around 9 PM and caught him in the act of burglarizing the cottage. He used his knife to rob, rape and murder her.

After murdering Meredith Rudy went dancing. Later he fled to Germany.


That sounds like the illogical and more importantly BORING "Bruce Fisher" narrative.

Two sadistic sexual maniacs, one of whom is a woman, joining forces with an even more sexually sadistic cat burglar, to terrorize a woman is far more plausible and a lot more appealing*cough titillating* to the media.
 
Often in scanning Forums, I admittedly use methods learned from speed reading.
Specifically read fully first and last sentences, as well as first and last full paragraphs of longer posts.

This was such a glaring factual error, I did not even bother with all the rest of the very lengthy 'argument' against guilt and mostly against those who believe in guilt.

Speed reading has more to do with taking in groups of words rather than in focusing on one word at a time. Of course, in order to speed read you need to understand all the words and names. Most of the posts are so short that you can read them in under a minute, if not in seconds.

If you comment on a post, read and understand the entire post.

By the way, what do you mean by 'pardoning of Scooter Libby'? You're going to make me look that up! I hope it's worth my time.

OK, I've looked it up. Still don't know how it applies to the Amanda Knox case.
