Continuation Part 2 - Discussion of the Amanda Knox case

Wouldn't you want the names before believing what anyone reported? Isn't Journalism 101 supossed to be about accurate sources?

Why do I need the names of Nara's children? If Paul told me that he spoke to her children then he spoke to her children. I have no plans on visiting Perugia and meeting Nara's family and I don't plan on mailing any letters their way so I really see no need to know their names.

Paul is a credible source. The information he provided didn't require the names of the children. I don't know their eye color or shoe size either.

If the bickering about who said what and who Frank likes is all over, I know I'm going back over old territory for most people because I'm looking at things from 2008-2009. I have to admit that based on the conclusions from the court documents and reasons given, I'd have voted guilty too, my trouble is that a number of those reasons now seem to have started evapourating and are no longer applicable. Anyway here's the questions, would appreciate any direction to find the answer, thanks.

1) The claim is made the Amanda's DNA was found on Meredith's bra. Is this claim true?

2) Claim was made that Amanda's DNA was found on the bra clip with Rafelle's. Is this true? I have also heard that there was other people's found on it, whose?

3) The claim is made that Amanda's blood was found mixed with Meredith's in the bathroom, I have also heard that while her DNA was found that it wasn't blood, which is true?

4) The claim is made that Amanda's shoe print was found under the pillow on the bed. Is this true, or was this the footprint that was claimed to be Rafelle's and then turned out to be Rudy's?

5) Claim is made that "bare bloody footprints" lead from Meredith's bedroom to the bathroom and about the house, including both Filomena's and Amanda's. These are claimed not to be Rudy's due to the size. Is this true? How would they have gotten there otherwise?

6) Claim was made that Meredith's bra was removed after her death because there was no blood where it would have been. I have also seen it claimed that as blood was found on her breast area, that it was removed before she died. Which is correct?

7) When did Allessandra Formica see Rudy?

8) Has Hekuran Kokomani's testimony been properly refuted?

9) What did Amanda tell Filomena when she rang at 12:08pm the day after the murder?

10) What evidence is there for when the postal police arrived at the cottage other than the camera footage?

11) A claim was made that traces of glass were found leading out of Filomena's room and out the front door. Can this be verified or refuted?

12) Was Meredith's blood mixed with Knox's DNA found in Filomena's room?

Answers or directions to conclusive answers would be helpful thanks.

Anyway here's the questions, would appreciate any direction to find the answer, thanks.

1) The claim is made the Amanda's DNA was found on Meredith's bra. Is this claim true?

No.

2) Claim was made that Amanda's DNA was found on the bra clip with Rafelle's. Is this true? I have also heard that there was other people's found on it, whose?

No to Amanda's being there. They have never publicly identified any other "donors."

3) The claim is made that Amanda's blood was found mixed with Meredith's in the bathroom, I have also heard that while her DNA was found that it wasn't blood, which is true?

Only DNA.

4) The claim is made that Amanda's shoe print was found under the pillow on the bed. Is this true, or was this the footprint that was claimed to be Rafelle's and then turned out to be Rudy's?

Someone else can answer this one.

5) Claim is made that "bare bloody footprints" lead from Meredith's bedroom to the bathroom and about the house, including both Filomena's and Amanda's. These are claimed not to be Rudy's due to the size. Is this true? How would they have gotten there otherwise?

There are no footprints from Meredith's room to the bathroom. Usually, the guilters say there are bloody footprints between Amanda's room and the bathroom, and the innocenters say the footprints show remnants of cleaning fluids. I think there may be bloody footprints between Amanda's room and the bathroom. If so, it would be because Amanda walked in her bare feet before and after her shower, and Rudy's bloody shoe prints were in her path.

6) Claim was made that Meredith's bra was removed after her death because there was no blood where it would have been. I have also seen it claimed that as blood was found on her breast area, that it was removed before she died. Which is correct?

Apparently it was removed after her death. Charlie Wilkes is the expert in the blood dispersal on the chest and bra.

7) When did Allessandra Formica see Rudy?

She didn't necessarily see Rudy. She saw a black man. RWVBWL knows the timing and the incident.

8) Has Hekuran Kokomani's testimony been properly refuted?

He was dismissed by the court as not believable.

9) What did Amanda tell Filomena when she rang at 12:08pm the day after the murder?

According to Murder in Italy by Candace Dempsey, Filomena said that Amanda had told Filomena that Amanda had slept at Raffaele's house, and when she went home in the morning, she'd found the door open and blood in her bathroom. She had taken a shower and now was scared and was going to call Raffaele.

According to Amanda's trial testimony: "So first I called Meredith, who didn't answer, and then I think I called Filomena, and she explained to me that Laura was in Rome, and that I should call back Meredith and then return to the house to see if there was anything stolen. I told her, look, everything seemed to be there, not as if someone entered and took things away, because my computer was still in my room, I saw that the television was still in the living room. For me, I hadn't even thought that there was robbery. I thought maybe someone went in and out really quickly, because if someone leaves faeces in the toilet, maybe something had happened and they had had to leave really really fast. Maybe. So Raffaele and I went out and went to my house to look around and see how things were. This time we opened the doors, for example the door to Filomena's room, and I saw that her window was broken and there was a big mess. That's when I thought, oh gosh, it was a robbery. And I was running around everywhere."

10) What evidence is there for when the postal police arrived at the cottage other than the camera footage?

The correct version of the timing of their arrival was established during the trial. It is no longer in question that the postal police arrived shortly after Raffaele called the Carabinieri.

11) A claim was made that traces of glass were found leading out of Filomena's room and out the front door. Can this be verified or refuted?

I have never seen this claim, much less any support for it.

12) Was Meredith's blood mixed with Knox's DNA found in Filomena's room?

I have heard this claim but I don't know if it is true. I don't know how Meredith's blood would have gotten into Filomena's room without also getting on the floor between there and the last of Rudy's shoe prints.

Answers or directions to conclusive answers would be helpful thanks.[/QUOTE]

This is a quick and dirty version, since I saw your post had been sitting here all lonely for 2 hours. ;) More thorough answers may be found in Massei or on Injustice in Perugia, Friends of Amanda, Science Spheres, The View from Wilmington, The Ridiculous Case Against Amanda Knox and Raffaele Sollecito, etc., etc.

from page 362 of Massei, regarding Kokomani:

To uphold the thesis of non-acquaintance they pointed to the unreliability of witnesses Gioffredi and Kokomani, and this Court considers reasonable what they highlighted on this point: the activity on Raffaele Sollecito’s computer makes an encounter with him in the time-span indicated by Gioffredi scarcely plausible; also the red coat which Amanda apparently wore at that time, a coat of which there was no other evidence, does not allow [us] to consider as believable the circumstances related by Gioffredi, and according to which he allegedly also saw Rudy accompanied by Raffaele, as well as by Amanda and by Meredith.

The inconsistencies in Kokomani’s statements are even more obvious. It is enough to think of the black bag which then revealed itself to be two people and of the throwing of olives and of a mobile phone which had allegedly been used to make a video which was subsequently shown to others and, furthermore, the time he had seemingly seen Amanda, a time predating her arrival in Italy and the mention of an uncle of Amanda’s of whose existence no one was able to supply confirmation.

ETA: PhantomWolf, it's good to keep in mind that Massei is, for the most part, speculation. The judge imagines what could have happened, based on what the prosecutor imagined could have happened. At certain points, the judge discusses the evidence as presented by the prosecutor, without noting that it was validly refuted by the defense. I think that may be the case with the mixed DNA allegedly found in Filomena's room.

I can answer some but not all of these.

I never heard that one before. The prosecution certainly never tried that line in court, and we know their standards aren't exactly high. I'm happy to dismiss that one.

2) Claim was made that Amanda's DNA was found on the bra clip with Rafelle's. Is this true? I have also heard that there was other people's found on it, whose?

The bra had a mess of DNA on it, so much so that independent experts have said that cherry-picking Raffaele's profile out of it was scientifically questionable even if everything else about the bra clasp was legit.

The guilters and the prosecution have no particularly good story about where that mess of DNA came from, but are nonetheless adamant that the sample wasn't contaminated. I struggle to follow that reasoning.

3) The claim is made that Amanda's blood was found mixed with Meredith's in the bathroom, I have also heard that while her DNA was found that it wasn't blood, which is true?

According to the Massei report it was blood.

I'm pretty sure it doesn't matter though. There is a perfectly good excuse for Amanda's blood being in the bathroom (she had an infected piercing) and absolutely no grounds to think Amanda was injured in a hypothetical struggle with Meredith (no injuries on her person when she was arrested and no sign of Amanda's DNA on Meredith anywhere). So even if they did find a mixed blood sample it wouldn't prove anything.

The Massei report concluded that this was evidence Amanda murdered Meredith then washed her hands in the sink, but their reasoning is not explicated and my own view is that once again Massei was just making **** up.

4) The claim is made that Amanda's shoe print was found under the pillow on the bed. Is this true, or was this the footprint that was claimed to be Rafelle's and then turned out to be Rudy's?

There was a sort of distorted print thing on the pillow. The prosecution claimed it matched Amanda's foot size, but also had to admit that it didn't actually fit any of her shoes, and that it hadn't checked the feet of the other girls. In any case, it turned out to be compatible with Rudy's feet anyway.

5) Claim is made that "bare bloody footprints" lead from Meredith's bedroom to the bathroom and about the house, including both Filomena's and Amanda's. These are claimed not to be Rudy's due to the size. Is this true? How would they have gotten there otherwise?[/quote[

This is an outright guilter lie. There were bare footprints revealed with luminol but they didn't go anywhere, they tested negative for blood, they aren't precise enough to say for certain they belong to anyone in particular and there's no evidence whatsoever they had anything to do with the murder.

The guilters love to call them "bare, bloody footprints" but that characterisation is simply false.

6) Claim was made that Meredith's bra was removed after her death because there was no blood where it would have been. I have also seen it claimed that as blood was found on her breast area, that it was removed before she died. Which is correct?

Different people here are still arguing over this one. My POV is that it was definitely removed after she was stabbed but before she died, because that is the only explanation for aspirated blood both on her bra and on the skin below where her bra would sit.

7) When did Allessandra Formica see Rudy?

No idea. I pass.

8) Has Hekuran Kokomani's testimony been properly refuted?

Even Massei thought so:

Massei said:
The inconsistencies in Kokomani’s statements are even more obvious. Going on...

9) What did Amanda tell Filomena when she rang at 12:08pm the day after the murder?

No idea, I pass.

10) What evidence is there for when the postal police arrived at the cottage other than the camera footage?

I pass, but I'm sure we had a solid answer to this one.

11) A claim was made that traces of glass were found leading out of Filomena's room and out the front door. Can this be verified or refuted?

Never heard that one before.

12) Was Meredith's blood mixed with Knox's DNA found in Filomena's room?

Massei report seems to indicate it was DNA, not blood, but there was a mixed sample in there.

They didn't try to conclude anything from this, probably because not much follows from it unless you think Amanda was in there cleaning up with mixed blood from herself and Meredith still dripping from her hands. The most conservative explanation is that the two of them lived there and there was ample scope for cross-contamination between rooms so the result doesn't mean anything.

But really now....
from thatone line from Mary's whole post you take the gargantuan giant step and declare an earth shattering personal vision and illuminating intellectual insight; a tremendously important personal transformation toward, your understanding of "how guilters fail to evaluate evidence properly (and therefore) end up on the wrong side of this argument."

Excellent! I presume you are rather kindly trying to make my point for me by deliberately failing to "evaluate" the evidence before you (my words as written) and ascribing to them a meaning which was not there. Very clever!

(Although I should point out that putting words in quotes that I did not say is sometimes frowned upon by mods here. Just a tip for future reference.)

mixed DNA does not equate to mixed blood

Answers or directions to conclusive answers would be helpful thanks.

PhantomWolf,

2. A discussion is here. The are probably at least two more contributors to the bra clasp profile, but the profiles are very much incomplete, and my opinion is that it would be difficult to attribute them to anybody.
3. Even Stefanoni acknowledged (Massei translation, p. 226 and p. 277) that mixed blood is not equivalent to mixed DNA. Charlie Wilkes showed the electropherogram of the cigarette butt with Raffaele's DNA mixed with Amanda's DNA. Amanda does not smoke, suggesting that her DNA got there by secondary transfer. Mixed DNA is hardly a rare phenomenon.
10. From the time that the Carabinieri called to ask for directions, the fact that the time stamp of the CCTV footage is in error and the direction of the error (fast or slow) is established. I have forgotten the rest of the analysis.
12. A luminol-positive blob was found in Filomena's room, but luminol is a presumptive test for blood, not a conclusive one. There were also about fifteen luminol-positive areas at Raffaele's flat, none of which are related to the crime. I am not 100% certain about this blob, but I believe that most or all of the luminol stains that had DNA were checked with TMB, and the TMB tests for blood were always negative. My conclusion is that one cannot conclude that the blob is blood.

Comodi asked for common sense

5) Claim is made that "bare bloody footprints" lead from Meredith's bedroom to the bathroom and about the house, including both Filomena's and Amanda's. These are claimed not to be Rudy's due to the size. Is this true? How would they have gotten there otherwise?

PhantomWolf,

There are three prints, all right foot prints, IIRC. They do not lead anywhere, and their origin is unclear to me. They are luminol-positive, but there is no good reason to believe that they are set in blood. Charlie Wilkes discussed this some time ago.

2) Claim was made that Amanda's DNA was found on the bra clip with Rafelle's. Is this true? I have also heard that there was other people's found on it, whose?

No on the bra possibly on the clasp along with a male said to be Raffaele's and 2 other unidentified female partial profiles one of which could be Amanda's. According to Nadeau one of Raffaele's defense experts quit over this issue thinking it could be Amanda's profile. I don't know if this is accurate but it is the most likely source of this information if I am not mistaken.

3) The claim is made that Amanda's blood was found mixed with Meredith's in the bathroom, I have also heard that while her DNA was found that it wasn't blood, which is true?

Impossible to say, there was blood and there was DNA, Stefanoni was unable to show that Meredith's blood was mixed with Amanda's blood anywhere and testified to this in court. Some of the samples contained Meredith's bllod and amanda's DNA and one sample on the sink contained Amanda's blood (claimed from an ear piercing)

4) The claim is made that Amanda's shoe print was found under the pillow on the bed. Is this true, or was this the footprint that was claimed to be Rafelle's and then turned out to be Rudy's?

The prosecution expert tried to show it was Amanda's "size", the defense expert showed it was Rudy's. Massei did not conclude either way stating his belief that Amanda was barefoot in Meredith's bedroom (so how could she have left a shoeprint).

5) Claim is made that "bare bloody footprints" lead from Meredith's bedroom to the bathroom and about the house, including both Filomena's and Amanda's. These are claimed not to be Rudy's due to the size. Is this true? How would they have gotten there otherwise?

All tested negative for TMB and most do not even contain Merediths DNA so the claim that they are Meredith's blood seem unlikely. There is no pattern to them that I can see. I believe there are three sets made at three different times with only one of those times being after the murder.

9) What did Amanda tell Filomena when she rang at 12:08pm the day after the murder?

I have posted extensively on this one along with my belief that Massei is very disingenuous in the relaying of the facts. I will link to a few of those posts.

10) What evidence is there for when the postal police arrived at the cottage other than the camera footage?

It is the camera footage with a time-stamp used in conjunction with cell phone records that is important, not just the camera footage. You can view the postale.pdf on my docstoc page. A link to a good analysis from thoughtful at PMF was provided on the conspiracy thread, Bruce has some comments at IIP as well. Basically it boils down to if the prosecution claim that the time was 10 minutes fast is correct then the carabaneiri called Amanda's cell phone for directions about 15 minutes after they got there (LOL). In addition the many calls made by Raffaele in that time frame the prosecution claims would have been noted by one of the police if that was the actual time involved.

I agree, for a long time I believed the bra was cut. Though recently I have moved to it being ripped at the seams. Which after looking at the close up pictures, I'm still curious as to how the prosecutions crack team of experts didn't pick up on that one.

10) What evidence is there for when the postal police arrived at the cottage other than the camera footage?

AS I recall, the logs from the postal police HQ of the times of the reporting of the discovery of Meredith's phones make it impossible for them to have arrived at the cottage any earlier than c. 12.55.

RoseMontague,
The source of the story about the defense expert (Pascali?) quitting because he found Amanda's DNA appears to be PMF**, and I find this claim to be dubious. I don't believe that more than about two loci have interpretable* peaks from other people besides Meredith and Raffaele. In other words the profiles are very nondiscriminating (in the US thirteen loci are needed for a full profile). People who say that Amanda's DNA was found on the clasp are playing fast and loose with the facts, and those of us who care about the facts ought to be furious. MOO.
*an expert working with the electronic data files might be able to cull some more information from the raw data. Too bad the defense never got them, despite asking for them.
EDT
The most important point about the unidentified DNA is that the unidentified people who deposited DNA there probably deposited it via secondary transfer or contamination. If their DNA got onto the clasp via one of these mechanisms, why should we exclude the possibility that Raffaele's DNA also was deposited by secondary transfer or contamination?
**possibly PMF got it from Nadeau (I am not sure). I still think the story is nonsense.

With all due modesty (ahem) may I note that I stated last September that the bra was yanked off? No doubt I was not the first.

(Incidentally, in my opinion, Dan O. is consistently underrated as a source.)

I used to think the bra was cut too. (Didn't everyone?)

We assumed it was cut because we were told it was cut by the investigators. Yet its clear it was ripped at the seems and not cut. This is information that was obvious after looking closely at the pictures of the bra. Which back to my point. How could the investigators miss something that should have been obvious to them? The only explanation is they were so fixated at trying to put a knife in 3 peoples hands and Meredith being subdued that they missed evidence of her possibly fighting back. Though some will point to incompetence, I'm willing to go with they were just to busy trying to help Mignini get evidence against Knox that they overlooked evidence that might have thrown a wrench in their whole theory of how the attack occured.

Good call Mary_H!!

I agree with you that Dan O is a great source and a good one to rely on for an objective and logical analysis. Looking at Amanda's lamp in her room I agree with Dan O that there would be plenty of light during the day but I just don't see missing that the lamp was missing, imo. Maybe once but not on several visits to the room. I still believe that the lamp was brought in there the night before (and she missed it at least once), or it was introduced on the scene after the murder.
