How can we punish the TSA Gate Rapers?

1) Use Viagra before you fly and insist on a pat-down.

2) Wear a t-shirt that reads "TSA has the best fluffers in the business" and insist on a pat-down.

3) 1+2

And/or:

4) Eat lots of broccoli and beans prior to your trip and let 'er rip when the guys face is level with your anus for the genital groping.

And this, IMHO, is the only way this policy gets changed. Once the airlines start losing passengers, and the government starts losing the tax revenue that goes with it, then maybe the policy changes.

That's why the best way to address this is to stop flying. Duh.

Wear a spike collar around your junk.

I guess a hundred rat traps, and a hundred small recording cams, could be sewn into a new type of clothing and worn springs to be sprung.

This retro outfit would of course have to be stenciled:

"Go for the junk."

"Make my day".

By all means, punish the poor paid by the hour work a day guy or gal who has to implement a policy someone else dreamed up. You think it's a picnic for them? To have to touch strangers all day, plus put up with travelers' lousy attitudes, and probaly encounter some pervs to boot.

I was "gate raped" today. He didn't want to do it anymore than I wanted it done. Messing with the TSA agents won't do anything but ruin their day. Gotta send giant dildos to Pistole instead!

Well, they implement these policies and they are not law enforcement personnel. Yet the implemented policies appear to be contrary to Bill of Rights, and in many cases where the passenger doesn't provide explicit consent legally constitute assault.

Now, consider the charge of assault for a second.

Who would it be leveled against? The perp.

Not the agency. It'd be interesting to hear the arguments made by the TSA attempting to bump the such a case from the local DA and county court into federal court.

Next question?

Concert promoters can demand a search. Hell, they could demand a strip and body cavity search. Nobody says you have to go to the concert. There's no assault if you consent.

On what basis would the TSA policy be struck down? Flying is not a right. You can walk to your destination and not be searched. If there's some other legal aspect, I haven't seen it.

I do think that the policy is stupid, though.

Not my fault they couldn't find honest work.

For starters, the 4th amendment applies - generally - to the actions of the federal government against the individual. The TSA agents are federal employees, and the TSA is an administrative federal agency.

The 4th amendment does not apply to a concert promoter's actions in private contracts with individuals.

Yes, I'm aware of that. The 4th Amendment does not constrain the government when individuals consent to a search. If a cop shows up at my house and asks me if he can search it top to bottom and put his finger up my butt, if I say yes, he can do it. He doesn't need a warrant or probable cause.

Flying is a voluntary activity - a privilege. You consent to the search. So, on what basis would there be a constitutional challenge? I'm not saying there isn't one. I just don't know what it would be.

I know, which is why it was in a separate paragraph addressing the issue of assault by the examiner.

You know, us residents of that lesser known 50th State called Hawaii, have no other real choice, but to travel by plane...

At which point we can get a successful lawsuit/public outrage and bin the whole nonsense.

How sure are you about that? Granted they could get crazy & try a body cavity in full view of the public, but it is (imo) more likely that they would simply cause you to miss your flight & point out that t you were being an ass.

For the record I agree that the new rules are over the top, I just don't see screwing with the grunts as the way to stop it.

But the people at the gate aren't the ones who made the policy. How does "punishing" them help?

As far as I'm concerned, the Fourth Nuremberg Principle fully applies here. They know damn well that it is illegal and immoral to sexually assault people, even if they are “just following orders”. They know that as government officials, they are obligated to obey the Constitution, including the Fourth Amendment. They know that what they are doing is wrong, and they are fully culpable for going along with it. I have no sympathy at all for these criminals.
