Has anyone been following the West Memphis Three?

I am only referring to the legal system in the US as favoring the defense more so then other countries. Not putting any others down. Just stating an observation.



And they have not demonstrated a miscarriage of justice in 17 years of trying.

The incompetence is self-evident. You would know this if you had read/witnessed the evidence and testimony.

The just misconduct has already been brought up and ruled on. Next.

ETA: The new allegation is not something I believe to be true. Because jury misconduct has already been explored in the appeals process and ruled on. They found nothing.

Did I say that? I don't recall having done so. Did you attend the WM3 trial?
 
Well now, I'm not Merikan, so I'll defer to your knowledge of the US justice system. However if this is true, then it is extraordinarily unjust. I'm no fan of the record of British justice, but this is certainly not the law on this side of the pond.

Yes. The prosecution proved its case to the satisfaction of 12 jurors and a judge. That's why the WM3 are sitting in jail.

An absolutely valid ground of appeal is that the prosecution did not in fact prove its case, and that the jury's verdict was unsound.

True. But that isn't the case here, at least so far.

Take Sion Jenkins again as an example. A trial, two appeals and two re-trials. It was never proved 100% that he was innocent, it just took that long to get the system to acknowledge that the evidence against him had never been sufficient to support the conviction in the first place.

So? Because one person was found not guilty on appeal, the WM3 are not guilty?
 
If, after a guilty verdict, the accused then have the burden of proof settle on them to prove a negative (that they didn't do it) to a standard of 100% certainty, then I have to respectfully say you are deluded in that belief.

The WM3 and their advocates have been trying to demonstrate a miscarriage of justice for 15-16 years, but the original trial judge blocked their every attempt for much of that time.

Are you by any chance among the incompetent law enforcement officials in Arkansas responsible for this judical horror?

Gary Gitchell, the former Chief Of Police in West Memphis, Arkansas during the WM3 case has moved across the Mississippi river into Shelby County, Tennessee. He is in charge of security in the Shelby County School system.

Yes. The prosecution proved their case. That's why the WM3 are in jail. How many times does that have to be explained to you? Just because you don't like the outcome doesn't mean they didn't prove their case.

Exactly. They are unaware of what evidence was used at the trial, cannot point to testimony to back up their claims, nor have any idea of what has happened in anything during the appeals process.

All they have is smoke and mirrors. Lies and conspiracy theories. They saw a ridiculous documentary and have never looked at anything else.

Reminds me of the Mumia Abu-Jamal case. People get on these "innocence" kicks and won't let them go. We all remember how "innocent" Jack Abbott was.

There was a similar case in St Louis about a year or two ago. The supporters of this poor murderer who was really innocent got a lot of press attention and demands for a retrial or even better, complete exoneration. What about A and B and C they cried! If only they would look at that evidence, it would be obvious he was guilty. The Circuit Attorney (aka Prosecutor) said they would take another look. Months passed. Why hasn't the Circuit Attorney agreed to retry the case? What is she hiding, they cried! Circuit Attorney - No comment. A few more months passed - an innocent man is in jail! What about A and B and C? Circuit Attorney calls a press conference - "What about D and E and F and G and H and I and J and....". Defenders - "Oh". And everyone went home.

Rinse and repeat.
