Merged April Gallop / Gallop lawsuit thrown out / Appeal denied

I would still like Lyte to explain why the HEAVILY TOUTED, "Researchers Editoin" is no longer available for pre-order?
There was talk at one point that Dylan's production company could potentially sue Lyte over it and even Dylan commented that this could happen.
So Lyte fess up WHO IS SUING YOU?

April Gallop's Suit Thrown Out

No surprise here. I would love to read the decision, but don't want to spend the money on PACER. I will wait until someone posts it.

http://911blogger.com/node/22940

just got this from William Veale, the attorney representing April Gallop.

"Judge Chin has just dismissed the Gallop case. He said that the allegations are frivolous and based on fantasy and delusion. I will attach the decision."

Restores my faith in the justice system.

Paging our Godess of Legaltainment (*Bows three times towards Toronto*)!

You call THAT an invocation? Allow me...

*chants* subpoena duces tecum...

O Goddess of Legaltainment, let us bathe in the font of your wisdom, and let us revel in the lulz that Thou doth provide from your bounteous files... let the schadenfreude shine forth and fill the souls of your humble clerks... this we ask in the name of Blackstone...

*chants* sine die...

*bows three times towards Toronto*

Requoting for the sublime lulz:

"Judge Chin has just dismissed the Gallop case. He said that the allegations are frivolous and based on fantasy and delusion."

:big: :big: :big:

Thanks for the laughs, JamesB.

Unfortunately the .pdf of the decision appears to be a scan of the written document, so no cut-n-paste is possible. I have retyped the money quote:

Even assuming the factual allegations of the complaint are true, Gallop's claims are not plausible. It is simply not plausible that the Vice President of the United States, the Secretary of Defense, and other high-ranking officials conspired to facilitate terrorist attacks that would result in the deaths of thousands of Americans. If anything, the allegations are the product of cynical delusion and fantasy.

A court may dismiss a claim as "factually frivolous" if the facts alleged are "clearly baseless", that is, "fanciful", fantastic" or "delusional" Denton v. Hernandez, 504 U.S. 25, 32-33 (1992) (quoting Neitzke v. Williams, 490 U.S. 319,325,327,328 (1989)) Courts have not hesitated to dismiss complaints asserting delusional claims of conspiracy.3 Indeed, courts have dimissed other cases alleging delusional conspiracy theories about the attacks of September 11,2001. BecauseGallop's claims are factually baseless -- indeed, because they are fanciful, fantatic, and delusional -- they are dismissed.
Pity I haven't the energy to transcribe footnote 3- it's a short list of really insane claims made in dismissed suits brought by crazy people- the sort of thing that probably had judges wondering whether they would have done better to go to medical school instead of into the law.

Previous portions of the ruling make it clear that Gallop presented the court with a load of all-too-familiar troofer claims- including some obviously derived from the Cap'n Bob and Aldo Show.

If anyone wants to read the whole thing, PM me an email addy and I'll send you the .pdf.

I thought I heard someone calling my name... (jhunter's invocations work every time!)

Just got the document from PACER, and will post it as soon as I read it and host it.

ETA: Okay, let's see if this works. (Googlepages have moved so I'm not entirely sure if this link will work)

See if that works. If not, let me know.

A Judge discovers 911 truth is based on fantasy and delusions. I bet Balsamo's affidavit help prove the delusional side.

http://www.centerfor911justice.org/news/Filed=20Affidavit=20Balsamo.pdf

I like the end of the affidavit where you say the "The foregoing is true and correct"; in Balsamo case should read " the foregoing is moronic rant made up due to insanity".

http://www.centerfor911justice.org/news/ How long will the nut case junk be posted on the internet?

:dl:

There are times when Beechnut makes me literally, honestly laugh out loud. This is one of them! I would love to see someone do a joke by scaning Balsamo's original affadavit, crossing out that line, handwriting in what Beechnut said, and scribbling in "FTFY" at the end. It'd be nothing but pure bloodymindedness to poke fun at the truthers, but I'd laugh my patootie off if anyone ever did that.

This one always got me.

From Capt. Boobies rant.
(4.) The record of data stops at least one second prior to official impact time.

How does ANYONE know the SECOND it hit? I'm sure there is some "official" time. But how?

"If anything, the allegations are the product of cynical delusion and fantasy." - page 11

Oh this is going to be so much fun :D

The download links work great LashL, thanks!

Boobie thinks the FDR should have recorded the impact and also shows the plane was too high to hit the Pentagon in the final altitude, so he assumes it was further away when the recording stops.

Of course, he's an idiot...

Heh, those footnotes are great. I love the cyborg.

It is obvious the judge was bought off!

If I were a dim witted and intellectually stunted 9/11 CTist, I would focus on this:
Even assuming the factual allegations of the complaint are true, Gallop's claims are not plausible. It is simply not plausible that the Vice President of the United States, the Secretary of Defense, and other high-ranking officials conspired to facilitate terrorist attacks that would result in the deaths of thousands of Americans.
and say the judge didn't even look at the facts and simply used an argument from ignorance, thus proving they are afraid of the evidence and are trying to whitewash the truth.

I'm sure this was the right decision, but the reality is, it won't matter to the morons.

Link works perfectly for me, LashL.

--------

And an interesting note on the decision: It's a dismissal with prejudice. This is perhaps mean of me, but I chortle with schadenfreude at that. There's nothing like a direct slap in the face by the courts to let conspiracy peddlers know their fantasies are seen by others to be utterly without merit. Let the excuse-making begin.

Boobie thinks the FDR should have recorded the impact and also shows the plane was too high to hit the Pentagon in the final altitude, so he assumes it was further away when the recording stops.

Never mind that the FDR shows full-scale high acceleration on the very last sample, and a RADALT of seven four feet...

Of course, he's an idiot...

You can say that again.

This is just more evidence that the Truth Movement is so long dead that even zombies would have buried it by now. We live in a country where people can successfully sue a restaurant over its coffee being too hot, but Truther garbage is summarily and categorically mocked and curb-stomped. By induction, this demonstrates that the Truth Movement and everything it believes is beyond frivolity.

The only part of the opinion the truthers will quote:

"Gallup alleges that ... fighter jets had sufficient time to intercept the hijacked planes but failed to do so.... [T]hese factual allegations are true."
