The "listening device" was "blocks away" according to an unnamed source. It was probably a cell-phone. It's not even listed in the affidavit.

There's a lot of speculation going on here, but none of it is grounded in fact. The affidavit did not list that these men had bugs or equipment necessary to tap a phone on them. That probably means they didn't actually have that equipment on them and weren't planning on actually bugging the phone line. We'll probably get evidence to what was turned up (and if it actually included a means for bugging a phone) when they were searched later. What they were planning on doing is another matter.

I looked at the statutes mentioned in the affidavit:

Entry onto property owned by the United States through false pretenses arguably applies, though I'd want to check precedent. Since the offices are open to the public, they might not have violated this. I'd want more facts. Unless they can point to an additional intent to commit a felony once there, the punishment is a fine or up to 6 months in jail.

The interference with the phone lines, etc., claim seems too weak to be looked at seriously. I have to assume they were just trying to fill up space. There could be more facts that made this applicable, but nothing in the affidavit leads me to believe this will make it past the wishful thinking stage.

They attempted to criminally tresspass on portions of the building where the general public is, for obvious reasons, not allowed. That they had a listening device is about 75% supportive of criminal intent.

I think there are some places where it is illegal to pose as a telephone company employee to gain entry into a place. It has been a few years but i recall its being discussed as an anti-rape measure.

IMHO it should be legal for a citizen to secretly record their conversations with all politicians/public employees.

I recently read a science fiction novel that posited (among other things) a society where all conversations by politicians had to be done electronically (they were not allowed to hold face to face meetings with lobbyists, for example), those conversations had to be recorded, and the recordings then had to be made available to the public. The penalty for violating this was VERY severe (I seem to recall death being mentioned). A very interesting notion.

The maggots were out to destroy people. Our prison system sucks, partly as a result of the way that the party for whom they are engaging in these crimes run a country. Too bad for them, and their discomfiture is of their own making.

I appreciate the link leading to the affidavit. Thank you for that. It does seem to suggest that the wire-tapping allegations may be somewhat premature.

I am going to wait for more information before I even attempt to draw any conclusions. Like charges brought forward, for example. After all the dust settles.

Affidavits are usually prepared with the least amount of information required to garner a warrant. Much of the real detail in any case comes to light long after any initial charges or arraignments.

On the face of it there does seem to be an indication that this episode will be viewed with a bit more gravity than the ACORN shenanigans. I don't know if this is a 'good thing' or not.

You're absolutely right. I think speculation on what actually happened is very premature.

The four men have all already been released on bail ($10,000) on the charge of entering a federal building under false pretenses to commit a crime.

The problem is that there are criminal and civil procedings going on in several states against the maggots. There's also the fact that one of them is the son of a federal prosecutor who would already be gone had "Diapers" Vitter not put a hold on the nomination of his replacement.
